A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO SUBMIT A PROPOSAL
TO THE OFFICE OF CRIMINAL JUSTICE PLANNING
FOR A CAREER CRIMINAL APPREHENSION PROGRAM GRANT
WHEREAS, The Town of Los Gatos desires to undertake a certain project
designated The Los Gatos Police Career Criminal Apprehension Program to be funded in
part from funds made available through the Career Criminal Apprehension Program
administered by the Office of Criminal Justice Planning (hereafter referred to as OCJP).
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Los
Gatos that the Town Manager of the Town of Los Gatos is authorized, on its behalf, to
submit the attached proposal to OCJP and is authorized to execute on behalf of the Town
Council of The Town of Los Gatos the attached Grant Award Agreement including any
extensions or amendments thereof.
BE IT FURTHER RESOLVED that the applicant agrees to provide all matching
funds required for said project (including any amendment thereof) under the Program and
funding terms and conditions of OCJP and that the cash match will be appropriated as
required subject to Council approval of a Town budget with a line item for this purpose.
IT IS AGREED that any liability arising out of the performance of this Grant Award
Agreement, including civil court actions for damages, shall be the responsibility of the grant
recipient and the authorizing agency. The State of California and OCJP disclaim
responsibility for any such liability.
BE IT FURTHER RESOLVED that grant funds received hereunder shall not be used
to supplant expenditures controlled by this body.

3. Federal Grants of $500,000 and Above
All applicants for federal grant funds of $500,000 or more will submit a copy of their
EEOP (developed for the implementing agency), or federal letter of compliance, to OCJP

4. EEOP Updates for Continuing Federal Grants
Projects who have previously received a total of $25,000 or more in federal grants, or
a single award in the amount of $500,000 or more, and have an approved EEOP on file
with OCJP, are required to submit an annual update of their EEOP if funds are
continued. The timeframe for EEOP updates are the same as identified in Section B,
2 and 3 above.

Statement, established by their agency, posted in a prominent place accessible to

II. CALIFORNIA DRUG -FREE WORKPLACE ACT OF 1990 AND FEDERAL DRUG-FREE
WORKPLACE ACT OF 1988 REQUIREMENTS
The above -named organization(s) will comply with the California Drug -Free Workplace Act of 1990 of
California Government Code Section 8355, et. seq., and the Federal Drug -Free Workplace Act of 1988,
and implemented as 28 CFR, Part 67, Subpart F, for grantees, as defined in 28 CFR, Part 67, Sections
67.615 and 67.620 by:
A. Publishing a statement notifying employees that unlawful manufacture, distribution,
dispensation, possession, or use of a controlled substance is prohibited and specifying actions to
be taken against employees for violations, as required in Government Code Section 8355(a).
B. Establishing a Drug -Free Awareness Program as required by Government Code Section 8355(b),
to inform employees about all of the following:
1. The dangers of drug abuse in the workplace;

PROBLEM STATEMENT
The Los Gatos Police Department has relied upon the traditional patrol allocation strategies of
responding a patrol unit to all calls for service as quickly as possible, performing random patrol and
self - initiated activity during non - committed time. Such strategies have been proven to be
ineffective. The goal of management of patrol operations is to enhance the capabilities of the police
department to achieve patrol performance objectives. The objectives are: 1) to increase the
efficiency of response to calls for service and thereby increase the portion of patrol time devoted to
what has traditionally been called random patrol; and 2) to replace random patrol with field service
activities directed toward specific crime and service- oriented problems. By changing to a
management of patrol operations philosophy as espoused by C -CAP, the Los Gatos Police
Department will be able to maximize its patrol resources. Strategies used to gain greater efficiency
will include the analysis and revision of the beat structure, the development of "beat books" (which
will list known problem areas and information specific to each beat), greater use of telephone
reporting, and the deployment of officers where indicated by the occurrence of crime and other
problems. Identifying specific crime problems and attending to them through the use of directed
patrol strategies will increase the effectiveness of police patrol, and improve the quality of life in the
community.
Criminal investigations are presently assigned by the Detective Supervisor, based upon a
subjective determination of solvability. Because case assignments are made based upon the type of
case (property crime, crime against persons, etc.), there is little consideration of the caseload of any
one detective. Thus, one detective may have a caseload much larger than another. Because the
detectives have no ability to access data other than that directly provided by patrol officers who
make an effort to contact the detective about a specific case or suspect, many leads, first established
by the patrol officers and recorded on Field Interview cards, remain undeveloped, unless the
detective recalls seeing or hearing about a suspect. Compounding this problem is the fact that the
staffing of the Detective Bureau has not risen for over 15 years.
The management of criminal investigations will provide the process by which cases are
evaluated for solvability and for assignment. By using a case tracking process, investigations will
be monitored and evaluated for continued investigation. Emphasis will be placed on the career
criminals identified by the crime analysis function. Liaison with the District Attornev's office is
already done through the Detective Bureau. The management of criminal investigations will
strengthen that liaison, as cases are tracked and information is exchanged about career criminals
brought for prosecution.
Overall, as information is shared among the various divisions, the Department will become
more effective in its efforts to determine the crime patterns and identity, and ultimately in the
successful prosecution of, the career criminal.

SUMMARY OF PRIOR YEAR'S ACCOMPLISHMENTS
In year one the Los Gatos Police Department received the Central Processing Unit, (HP 3000 -
937RX), with hardware and software installed. Personal computers were installed and training was
completed for all personnel on the use of the equipment. In year two our computer aided dispatch,
(CAD), system software was received, installed, and finally brought up. A two part training program
was presented to personnel on the use of CAD. The CAD system went live February 1, 1995.
The Crime Analyst, Nicole Headley- Edwards, who was hired in September, 1993, left on a
disability. She left July 19, 1994, and returned in January, 1995. To help ensure that we meet our
goals, a replacement Crime Analyst, Sharon Tafoya, was hired on a temporary basis.
Accomplishments during the 94 \95 schedule include the development and distribution of weekly
crime bulletins and known offender /wanted person bulletins. In addition, we have established a
weekly traffic summary, various officer safety bulletins and weekly shift summaries. Hardcover
binders have been established with photos and personal information of resident sex offenders and
narcotic registrants. These binders are located in the briefing room and are available to all of patrol
and the detective bureau. We established contact with state parole, adult, and juvenile probation.
We can now receive information concerning parolees who are being released in the Los Gatos area.
This would include intensive supervision of probationers who reside in Los Gatos.
A crime analysis survey was developed and distributed throughout the department to determine the
effectiveness of our C -CAP products. An analysis of the survey responses was conducted and results
were also distributed throughout the department. In addition, with the assistance of Ray Rule from
the Santa Clara County Sheriffs Office, we have developed a program for the identifying career
criminals.
There has been a review and revision of all policies and procedures that is affected by the
implementation of MPO /MCI and a workload analysis of the detective bureau.
A preliminary geo -file for the Computer Aided Dispatch, (CAD), software has been installed, and
both parts of a two part training program have been completed.
In year one, information request and feedback forms were developed and are now being successfully
utilized. Various reports have been generated in response to the officers' utilization of these forms,
and positive feedback has been received concerning the information generated.
Idaho Computer Services, (ICS), provided training in March of 1995 for its 'Datanow'software. This
two day training consisted of writing programs to retrieve data for crime analysis.
A Records Management System, (RMS), committee has been developed and the first meeting was
held April of 1995. Members of the committee were assigned tasks to prepare for the table building
workshop scheduled for June of 1995.
Management Patrol Operationc,(MPO), is scheduled to be installed in April of 1995. A MPO
committee has been identified with training set for June of 1995.
January 3, 1995, Captain Jeff Miller took over responsibilities for the management of the C -CAP
project. On February 5, 1995, Sergeant Tam McCarty took over responsibilities for the supervision
of the C -CAP project.
It is projected that the new project manager and the new project supervisor will attend the necessary
training to successfully meet all C -CAP requirements.
OBJECTIVES AND ACTIVITIES (MPO /MCI Phase)
OBJECTIVE 1: Increase the effectiveness and efficiency of patrol operations.
Projected completion dates for the following activities:
A. Analysis and modification of beat structure will be completed by August, 1995. Assessment
and changes will be made during the next six months, with final modifications completed and
effective in February, 1996.
B. Development /revision of field officer's handbook will be completed by June 30, 1996. The
Field Officer's Handbook will become operational- effective July 01, 1996.
C. Development and implementation of alternatives to patrol service delivery will be completed
and implemented by July 1, 1996.
D. Development and implementation of patrol practices such as expansion of the preliminary
investigation by patrol personnel, the use of tactical units, the use of directed patrol, call
prioritization and Problem Oriented Policing, will be completed and effective in August,

different times by January 20, 1996. A total of approximately 45 patrol and investigative
personnel will attend one or the other course.
D. A two -hour training course on the use of case tracking will be conducted at two different
times by January 20, 1996. A total of approximately 45 patrol and investigative personnel
will attend one or the other course.
E. Other Training consisting of a four -hour training course on such topics as the expansion
of the preliminary investigation by patrol personnel, the use of tactical units, the use of

OBJECTIVE 4: Increase the number of career criminals identified and arrested.
A. During the third year, the Department expects to identify a total of 13 -20 career criminals.
B. During the third year, the Department expects to arrest a total of 10 career criminals.
OBJECTIVE 5: Increase the number of cases referred and accepted for prosecution.
A. During Year Three, the Department expects to refer 10 career criminal cases to the
District Attorney for prosecution.
B. During Year Three, the Department expects the majority, if not all, of these cases to be
accepted by the District Attorney for prosecution.
C. During Year Three, the Department expects that the total number of felony cases referred
to the District Attorney's Office for prosecution will be 163.
D. During Year Three, the Department expects that the total number of felony cases accepted
for prosecution by the District Attorney's Office will be 148.
OBJECTIVE 6: Review and enhance accomplishments for Year Three.
Projected completion dates for the following activities:
A. Evaluation of the patrol practices implemented to increase the effectiveness and efficiency of

patrol operations will be completed by May 31, 1996. Recommendations for changes
approved by the Chief of Police will be incorporated into the Field Officer's Handbook no
later than June 30, 1996.
B. Evaluation the case screening process for patrol, the case management process and the case
tracking process in effect will be completed by May 31, 1996. Recommended changes
approved by the Chief of Police will be implemented by November 30, 1996.
C. Evaluation of the effectiveness of training through the use of evaluation and feedback forms
from trainees and the practice of training materials by patrol and investigative personnel, with
needed changes implemented, will be completed by June 30, 1996.
D. Review of the process of identifying and arresting career criminals will be completed, with
needed changes implemented by June 30, 1996.
E. Review the process of referring and accepting career criminals cases for prosecution will
commence in April, 1996. Approved changes will be implemented by June 30, 1996.

PROGRAM EVALUATION (6 -Month Non - funded)
Objective 1: Executive Task Force and User's Group evaluate program's effectiveness and
implement changes, if necessary.
CA services and products will be reviewed by the Crime Analyst and Sergeant McCarty,
Project Supervisor, to identify problem areas and recommend modifications by September 01,
1996. Based on this review and analysis of all prior input and changes, recommendations will
be made to the User's Group by September 15, 1996. The User's Group will review
recommendations and prepare final recommendations for modification to the Executive Task
Force by September 30, 1996. The Executive Task Force will review any recommendations
for change by October 15, 1996 and will forward them to the Chief of Police for approval.
All written procedures will be updated as required by October 31, 1996. Appropriate
Division Captains will be responsible for updating procedures in their areas as assigned by the
Project Manager. All procedures will be fully implemented by November 01, 1996 by the
Crime Analyst and appropriate Division Captains. Patrol response times, quality of
preliminary investigations, case screening, use of alternative service delivery methods, use of
directed patrol operations, and patrol deployment and beat structure will be reviewed by the
Patrol Operations Commander and a selected group of patrol personnel by September 01,
1996. All problems and proposed changes will be identified by September 15, 1996. The
User's Group will review findings and recommendations by October 15, 1996. Final
recommendations, if any, will be provided to the Executive Task Force by November 01,
1996. The Executive Task Force will review any recommendations by November 15, 1996
and will forward them to the Chief of Police for approval. All written procedures will be
updated by the appropriate Division Commanders at the direction of the Project Manager by
November 30, 1996. All recommended modifications will be fully implemented by the Patrol
Operations and Detectives Commander, as appropriate, by December 01, 1996. The Case
Management System and working relationship with the District Attorney will be reviewed by
the Project Manager, Detective Sergeant, Crime Analyst, and the District Attorney's
representative by September 01, 1996. Problems and recommended modifications will be
identified by September 15, 1996. Recommendations for modifications, if any, will be
provided to the Users Group by September 30, 1996. The Users Group will review and
provided recommendations to the Executive Task Force by October 15, 1996. The Executive
Task Force will review any recommendations for modifications and will provide final
recommendations to the Chief of Police by November 01, 1996. All written procedures and
operating agreements will be updated at the direction of the Project Manager by November
15, 1996. All modifications will be fully implemented by appropriate parties by December
01, 1996.
Objective 2: Submit a Program Evaluation report to OCJP that includes an analysis of
Objective 1 measurements. The report should include institutionalization of C-
CAP philosophy. (This report is due to OCJP thirty days following the six-
month evaluation period)
A final C -CAP summary report will be submitted to OCJP by January 31, 1996.

PLAN FOR ASSUMPTION OF COSTS
The Town Council and the Town Manager of the Town of Los Gatos fully support the efforts
of the Los Gatos Police Department toward proactive crime prevention and suppression. They
realize that the CCAP philosophy fits with the Town's long range plan for law enforcement and its
program of training, technical assistance and financial support will allow us to accomplish our goals
more swiftly. Tangible proof of that support is the enclosed Town Council Resolution committing
local match funds in an escalating percentage for three years.
The Operations and Support Services Commanders have worked to assist CCAP personnel
with program implementation, including scheduling training, facilitating ride - alongs, and delegating
tasks appropriate to crime analysis unit. Sworn and non -sworn personnel are involved via the User
Group, through ride - alongs, training, and response to requests for information.
Our progress in the CCAP program has been reported to the Town Council and Town
Manager, on a regular basis, throughout the project. We are confident that the changes wrought by
CCAP and the services provided by the crime analysis unit will be so ingrained in department
practices that they will be indispensable.
Operational Agreement
This Operational Agreement stands as evidence that the Los Gatos Police Department and the
Santa Clara County District Attorney intend to work together toward the mutual goal of providing
maximum available assistance for crime victims residing in the Town of Los Gatos. The agencies
believe that implementation of the Career Criminal Apprehension Program proposal as described
herein will further this goal. To this end, each agency agrees to participate in the program, if
implemented, by coordinating /providing the following services:
The Los Gatos Police Department's project will closely coordinate the following services with the
Santa Clara County District Attorney through:
- Project staff being readily available to the Santa Clara County District Attorney's
Office for service provision through prosecution and sentencing.
Regularly scheduled meetings monthly, or as often as determined necessary,
between David Tomkins, DDA and Career Criminal Project Director for the Santa
Clara County District Attorney's Office, or his designee, and the Los Gatos Police
Department's C -CAP Coordinator to discuss strategies, time tables and
implementation of mandated services.
Specifically: the C -CAP Crime Analyst will:
develop a tracking procedure for felony arrests, and track each case from
arrest to sentencing. The procedure will be coordinated with the Santa
Clara County District Attorney's Office.
Explore the feasibility of an automated tracking of career criminals and
felony arrests.
Identify career criminals so they get special attention throughout the
prevention, apprehension and vertical prosecution process.
