1996-120-Approving Town Participation In Lot Line Adjustment That Would Transfer Approximately 500 Square Feet Of Open Space Land To Two Adjacent Property OwnersRESOLUTION 1996 -120 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS APPROVING TOWN PARTICIPATION IN LOT LINE ADJUSTMENT THAT WOULD TRANSFER APPROXIMATELY 500 SQUARE FEET OF OPEN SPACE LAND TO TWO ADJACENT PROPERTY OWNERS IN EXCHANGE FOR THEIR MAINTENANCE OF THE IMPROVEMENTS ON THE PROPERTY AND AUTHORIZING THE MAYOR TO EXECUTE THE APPLICATION OF LOT LINE ADJUSTMENT ON BEHALF OF THE TOWN WHEREAS, the development of Tract No. 8280 created a fence and valley gutter system that serves the development and homes; and WHEREAS, during actual construction, the fence and gutter were located on property dedicated to the Town for open space because such a location would avoid damage to a large oak tree that merited protection; and WHEREAS, the owners of the adjoining parcels are willing to take responsibility for the fence and gutter as originally intended, and this will relieve the Town of responsibility for those improvements; and WHEREAS, to clearly define title and responsibility, a lot line adjustment transferring the approximately 500 square feet involved to the two adjacent properties would be the best procedure as generally shown in Exhibits A and B hereto; and WHEREAS, Government Code § 54221 allows the Town to transfer title to such a small area without offering it to other agencies for purchase; and WHEREAS, the property involved has not been used of public park or recreation purposes no is it usable as a bicycle facility; and WHEREAS, the Planning Commission has determined that this transfer would be consistent with the Town General Plan pursuant to Government Code § 65402. N.ASHARETLNG1009. 14 THEREFORE, BE IT RESOLVED: 1. The proposed transfer of the property generally shown in Exhibits A and B is approved on behalf of the Town as the property owner of the property to be transferred. 2. A formal application for a lot line adjustment shall be submitted by the developer and reviewed for technical compliance with the Town Subdivision Code. Town. 3. The Mayor is authorized and requested to execute that application on behalf of the PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 7th day of October, 1996 by the following vote: COUNCIL MEMBERS: AYES: Joanne Benjamin, Steven Blanton, Linda Lubeck, Patrick O'Laughlin, Mayor Randy Attaway.
