RESOLUTION GRANTING AN APPEAL OF A PLANNING COMMISSION DECISION
DENYING A PLANNED DEVELOPMENT TO CHANGE THE ZONING DESIGNATION
FROM C -2 TO C -2 PD TO CONSTRUCT A 27 ROOM ADDITION TO THE TOLL
HOUSE HOTEL AND AN AMENDMENT TO THE CENTRAL BUSINESS DISTRICT
STREETSCAPE IMPROVEMENT GUIDELINES

PROPERTY LOCATION: 140 S. SANTA CRUZ AVENUE.
APPLICANT /APPELLANT: PACIFIC VALLEY INVESTMENTS, INCORPORATED.
PROPERTY OWNER: LOS GATOS VENTURE LTD.
WHEREAS:
A. This matter came before the Council for public hearing on August 3, 1998, on an
appeal by Pacific Valley Investments, Incorporated, appellant, from a decision of the Planning
Commission and was regularly noticed in conformance with State and Town law.
B. The Council received testimony and documentary evidence from the appellant and all
interested persons who wished to testify or submit documents. The Council considered all testimony
and materials submitted, including the record of the Planning Commission proceedings and the packet
of material contained in the Council Agenda Report dated July 22, 1998, concerning the development
application.
C. On June 10, 1998 the Planning Commission denied the request for the planned
development for a zone change from C -2 to C -2 PD to allow the addition of 27 rooms to an existing
hotel on 1.798 acres. The Commission denied the application on the basis that the proposed design
violated Town standards in terms of parking, setbacks and height without sufficient justification. In

addition, the Commission was concerned about the height and mass of the project and the impact to
the residents on Broadway.
D. Appellant appealed the Planning Commission's decision because they believe that the
Planning Commission erred or abused its discretion, and further, that new information is available that
was not available for the Planning Commission's initial review.
E. New information was made available to the Council in the form of significantly revised
site plans for the proposed development that the Planning Commission did not have the benefit of
evaluating. The revised site plans demonstrate greater flexibility by the applicant towards reducing
the auditory and visual impacts of the proposed project.
RESOLVED:
The appeal of the decision of the Planning Commission on Development Application DEV -97-
004 is therefore granted and is remanded to the Planning Commission for further review with the
following direction:
a. Reduction of noise impacts on neighboring properties on Broadway and noise
projecting upwards from the site, including consideration for moving driveways toward the front of
the project site;
b. Reduction of the visual impacts on neighboring properties on Broadway;
c. Reduction of appearance of mass and bulk resulting from any proposed addition
to the front of the project site;
d. Signage and other steps to direct guests to available parking in the garage;
e. Emphasize excellence in design; and
f. Number of required parking spaces must be provided without exception.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 8th day of September, 1998 by the following vote.
