A RESOLUTION OF INTENT TO IMPLEMENT THOSE
PORTIONS OF THE ABAG ENVIRONMENTAL MANAGE-
MENT PLAN RELATING TO WATER QUALITY.
WHEREAS, the Association of Bay Area Governments (ABAG) was designated by the
U.S. Environmental Protection Agency (EPA) and State Water Resources
Control Board ( SWRCB) to prepare an Environmental Management Plan
(EMP) for the San Francisco Bay Area; and
WHEREAS, ABAG has prepared an initial EMP that includes water quality, air
quality, solid waste management and water supply elements; and
WHEREAS, the water quality element of the EMP contains policies and actions
for surface runoff that were developed by the counties of the Bay
Area; and
WHEREAS, ABAG has received more than 1,500 pages of public comment on the
draft EMP, and these have been considered fully by the responsible
ABAG approving bodies; and
WHEREAS, the initial EMP has been reviewed, modified and approved by the
ABAG Environmental Management Task Force, Regional Planning Committee,
Executive Board, and General Assembly; and
WHEREAS, the Town Council of the Town of Los Gatos, California, has reviewed
the initial EMP: and
WHEREAS, EPA and SWRCB policy is that significant water quality management
agencies named in the EMP must indicate their willingness to
implement the EMP before EPA and SWRCB can give unconditional approval
and /or certification to the initial EMP; and
WHEREAS, the Town Council of the Town of Los Gatos is a significant management
agency for the purpose of implementing portions of the initial EMP
relating to water quality; and
WHEREAS, flexibility in implementation of the initial EMP is implicit in the
plan so as to include good faith efforts to implement; and
WHEREAS, ABAG has developed a continuing planning process so that the initial
EMP can be updated and revised on a regular basis; and
WHEREAS, although additional local expenditures resulting directly from the
EMP are not large relative to previous or ongoing environmental
management activities, local government fiscal resources are strained
by the Statewide passage of Proposition 13 on June 6, 1978;
NOW, THEREFORE, BE IT RESOLVED THAT THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
approves and adopts those portions of the EMP relating to water quality for
implementation; and
BE IT FURTHER RESOLVED THAT THE TOWN COUNCIL OF THE TOWN OF LOS GATOS agrees
to continue with its good faith effort to implement those portions of the
initial EMP relating to water quality (see attachment for listing) that are
within this jurisdiction's responsibility; and
BE IT FURTHER RESOLVED that implementation of actions financed wholly or in
part by Federal and /or State funds will be conditioned on the availability of
that money; and
BE IT FURTHER RESOLVED THAT THE TOWN COUNCIL OF THE TOWN OF LOS GATOS, because
of the impact of Proposition 13, reserves the right to postpone implementing any
provision in the EMP involving additional local expenditures; and
BE IT FURTHER RESOLVED THAT THE TOWN COUNCIL OF THE TOWN OF LOS GATOS will seek
to modify the initial EMP as appropriate during the continuing planning process
if implementation does not proceed according to the EMP's approved schedule;
and
BE IT FURTHER RESOLVED THAT this resolution is adopted on the condition that
the water quality portion of the initial EMP will be certified without change
by the State, with regard to those items on the attachment; and
BE IT FURTHER RESOLVED THAT upon additional information regarding the severity
of water quality problems and /or the effectiveness of various control measures,
actions included in this resolution may be modified.
PASSED AND ADOPTED BY THE TOWN COUNCIL OF THE TOWN OF LOS GATOS, CALIFORNIA,
at a regular meeting held on the 21st day of August ,
1978, by the following vote:

ATTACHMENT TO "RESOLUTION OF INTENT TO IMPLEMENT THOSE PORTIONS OF THE

The Town of Los Gatos
hereby agrees to implement or continue to implement the following surface
runoff Management activities indicated in the Surface Runoff Management Plan
for Santa Clara County:
• Street cleaning
• Litter control
• [atchbasin cleaning
• Stn -n sewer cleaning
• Erosion control ordinances
• Participation in the establishment of a count.nvide Surface Runoff
Management Coordinating Committee
• Assisting determination of water monitoring needs and evaluation
of effectiveness of existing programs
• Assist in preparation of an Annual Report for Surface Runoff
Management in Santa Clara County
The Town of Los Gatos
further agrees to implement or continue to implement those porti
following EMP actions applicable to its jurisdiction:
Water Quality Management Plan Recommendations
Policy 11: Improve Waste Water Disposal Practices in Unsewered Areas
Action 11.1
Participate in establishing minimum regionwide standards
for on -site disposal systems (incorporate new standards
in local building codes and ordinances).
Action 11.2
Inspect periodically new on -site wastewater disposal systems,
including septic tanks, and establish procedures to ensure
Proper maintenance (inspection will be by public agencies).
Action 11.3
Establish procedure for inspection and maintenance of
existing on -site systems where appropriate (public
management and procedures for establishment are deter-
mined by California Health and Safety Code, Section 6950
et. seq.)
Solid Waste Management Plan Recommendations
Action 13.4
Improve procedures for preventing and handling spills
of hazardous wastes. This would include:
Participate in
a) evaluating preventive measures for oil and chemical
spills on land and recommend improvements as
appropriate
Participate in
b) designating a single responsible agency for each
county for notification and handling of spills,
such as the County Office of Emergency Services,
or the County Health Department.
Implementation of the activities indicated above is conditioned upon the
provisions of the "RESOLUTION OF INTENT TO IMPLEMENT THOSE PORTIONS OF
THE ABAG ENVIRONMENTAL MANAGEMENT PLAN RELATING TO WATER QUALITY" to
which this is attached.
