RESOLUTION AUTHORIZING THE EXECUTION
OF AN ANNEXATION AGREEMENT
RESOLVED by the Town Council of the Town of Los Gatos that the Mayor
is authorized and directed to execute the attached annexation agreement
for Ralph Lopez, Mary Lopez, Doyle Hastings and Carolyn Hastings, joint
owners of Lot 3 of Tract 4665 located in a subdivision commonly known as
Aztec Ridge Montezuma Hills, Tax Appraiser's No. 532 -26 -080.

at a regular meeting held this

WHEREAS, Ralph Lopez, Mary Lopez, Doyle Hastings and
Carolyn Hastings are joint owners of Lot 3 of Tract 4665
located in a subdivision commonly known as Aztec Ridge
Montezuma Hills, Tax Appraiser's No. 532- 26 -08p, more
particularly described by Exhibit "A" attached hereto and
incorporated with reference;
WHEREAS, said property is located in the County of
Santa Clara; and
WHEREAS, said property falls within the Zoning Ordinance
CS -12, Article 34; and
WHEREAS, the Town of Los Gatos desires said property to
be annexed into the Town of Los Gatos; and
WHEREAS, the above -named parties do not object to such
annexation nor in any way oppose said annexation; and
WHEREAS, it has been proposed that Article 34 be amended
in a way which would permit the County to issue a Use Permit
if it is found "the property is not contiguous to a City boundary
and the public health and safety will not be endangered by the
lack of City services and that the proposal will not interfere
with the orderly growth of the City and the efficient and
economic utilization of community resources "; and
WHEREAS, it is anticipated that in addition to the above -
proposed amendment, it will be required that all avenues of
annexation be exhausted prior to the issuance of such Use Permit;
and
WHEREAS, the Town of Los Gatos is appreciative of the hard-
ship being suffered by the above -named people caused by a dealy
in issuance of such Use Permit;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
In consideration of the Town acknowledging to the County
of Santa Clara that Ralph Lopez, Mary Lopez, Doyle Hastings,
and Carolyn Hastings have exhausted all avenues of annexation
and so far as the Town of Los Gatos is concerned, complied with
the proposed Amendment to Article 34 heretofore referred to,
Ralph Lopez, Mary Lopez, Doyle Hastings and Carolyn Hastings
hereby agree that said property heretofore described may be
annexed into the Town of Los Gatos when and if such annexation
is possible, either by a change in the present annexation laws
or the annexation of contiguous properties to the above -
described property. It is further agreed by the above -named
persons that such annexation agreement will be binding upon
their heirs, successors and assigns.
The above agreement to annex shall remain in full force
and effect until day of , 19 , it being
understood and agreed by the above -named parties in the Town
of Los Gatos if such annexation has not occurred by such date
that this agreement shall then become void.
It is further agreed by the above -named parties that this
agreement or memorandum of such agreement will be recorded in
connection with the above- described property and the same will
remain in effect until such annexation occurs or this agreement
becomes void on the day of , 19
