RESOLUTION OF NECESSITY TO CONDEMN
PROPERTY AT THE NORTHEAST CORNER OF
MAIN STREET AND PLEASANT STREET
WHEREAS, notice of a hearing to consider a Resolution of Necessity
to condemn real property was given as required by Section 1245.235 of
the Code of Civil Procedure; and
WHEREAS, no request to appear and be heard was received; and
WHEREAS, on November 6, 1978 the Town Council of the Town of Los
Gatos held a hearing and heard any protests by persons requesting to be
heard.
RESOLVED:
1. The public interest and necessity require the taking of the real
property as shown on the attached Exhibit "A ", which is incorporated in
this Resolution by reference,for public street purposes, a public use,
under authorization of Government Code Section 37350.5.
2. The Town Council finds and determines:
(a) The public interest and necessity require the construction
of traffic islands to improve the safety of the intersection
of Main Street and Pleasant Street.
(b) The taking and acquisition of the property is necessary for
such public use and it is necessary for the Town of Los
Gatos to condemn and acquire such property.
(c) The proposed traffic islands are planned and located in the
manner that will be most compatible with the greatest public
good and the least private injury because they require a

very small area of land occupied only by a sign and landscaping.
(d) The property described in this Resolution is necessary for the
project because there will not be sufficient right -of -way for
the proposed project unless the easement is acquired.
3. The Town Attorney of the Town of Los Gatos is directed to commence
an action in the Superior Court to condemn and acquire, in the name of the
Town, said property for the use of the Town.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos held on the 6th day of November
19785 by the following vote:
AYES: COUNCIL MEMBERS Ruth Can Thomas J. Ferrito, Peter W.
Siemens and Mardi Gualtieri
NOES: COUNCIL MEMBERS
ABSTAIN: COUNCIL MEMBERS
