A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF LOS GATOS REGARDING STATE
MANDATED COSTS.
WHEREAS, the concept of state compensation for mandated costs
became effected on January 1, 1973 through the passage of Senate
Bill 90; and
WHEREAS, SE 90 did not provide state compensation for costs
mandated prior to January 1, 19737 and
WHEREAS, the state legislature has advoided payment of costs
mandated upon local governments since January 1, 1973 by use of
cost "disclaimers and
WHEREAS, recent constitutional amendments have imposed new
property tax limits on local agencies.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town
of Los Gatos that:
1. All state decisions mandating actions and costs on local
agencies be reviewed to determine whether state reimbursement has
been provided.
2. The state legislature should provide reimbursement to local
agencies in all instances where there is no, or inadequate, reimburse-
ment for mandated actions or costs.
3. All future legislation mandating actions or costs should be
accompanied by adequate reimbursement.
4. The use of cost "disclaimers" should be eliminated.
