TOWN OF LOS GATOS
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
LOS GATOS REQUESTING THAT THE BOARD OF SUPERVISORS
OF SANTA CLARA COUNTY REFER THE ISSUE OF MUNICIPAL
COURT CONSOLIDATION TO EACH CITY WITHIN THE COUNTY
FOR SUCH CITIES' COMMENTS AND RECOMMENDATIONS
WHEREAS, it has come to the attention of the Town Council of the Town of
Los Gatos that the Santa Clara County Board of Supervisors has agendized the
subject of Municipal Court Consolidation on its September 19,1978 agenda: and
WHEREAS, the Municipal Courts are available to the citizens to adjudicate
small claims disputes, landlord- tenant matters, a variety of civil disputes,
traffic offenses and criminal matters; and
WHEREAS, consolidation of Municipal Court functions could result in
citizens being required to travel great distances to obtain the adjudication of
disputes; and
WHEREAS, the Town Council believes that any change in the existing court
structure could have a significant impact upon the citizens of Los Gatos; and
WHEREAS, it would be in the best interests of not only the citizens of Los
Gatos but all other citizens of Santa Clara County if the Board of Supervisors
were to refer this important issue to all of the cities in the County for such
cities' comments and recommendations;
NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Los
Gatos respectfully requests the Board of Supervisors to:
1. Submit to the cities within the County any draft proposal for Municipal
Court Consolidation before any action is taken upon said proposal by the Board
of Supervisors,
2. Direct the County Executive to keep each city within the County apprised
with respect to this matter.
3. Direct the County Executive to notify each city within the County when
this item will be agendized for further study or action of the Board of Supervisors.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Clerk be directed to
send a copy of this resolution to the Board.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos held on the 18th day of September, 1978, by the following vote:
AYES: COUNCIL MEMBERS Ruth Cannon, Thomas J. Ferrito, John B. Lochner,
Peter W. Siemens and Mardi Gualtieri
