MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING
OCTOBER 21, 2013
The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday,
October 21, 2013, at 7:00 P.M.
CLOSED SESSION - 5:30 P.M.

MEETING CALLED TO ORDER
The meeting was called to order at 7:00 p.m.
ROLL CALL
Present: Mayor Barbara Spector, Vice Mayor Steven Leonardis, Council Member Joe
Pirzynski, Council Member Diane McNutt, and Council Member Marcia Jensen.
Absent: None.
PLEDGE OF ALLEGIANCE

Sonali Ranaweera, Rolling Hills Middle School, led the Pledge of Allegiance. The
audience was invited to participate.
PRESENTATION

CLOSED SESSION REPORT
Judith Propp, Town Attorney, stated Council met in Closed Session as duly noted on
the agenda and that no action was taken.
COUNCIL/TOWN MANAGER REPORTS
Council Matters
- Vice Mayor Steven Leonardis stated he attended the Housing and Community
Development Advisory Committee Meeting and the West Valley Sanitation District
Board of Directors meeting.
- Mayor Barbara Spector stated she attended the last North 40 Advisory Committee
Meeting.
Manager Matters
- Advised Saturday, October 26 is a Town drop off date for unused prescription
drugs, batteries, and thermometers.
CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION)
1. Approve Council minutes of October 7, 2013
2. Adopt resolution making determinations and approving the reorganization of
territory designated Shannon Road No. 25, containing approximately .26 acres
located at 16330 Shannon Road (APN 532-03-035). File #AN12-004
RESOLUTION 2013-044
3. Ordinance amending Chapter 29 (Zoning Regulations) of the Town Code to
incorporate the following revisions required to implement the State Certified
ORDINANCE 2222
Housing Element
a. Adoption of an Emergency Shelter definition and allowing the use as a
permitted use in the controlled manufacturing zone
b. Adoption of a Universal Design/Reasonable Accommodation Ordinance for
disabled persons
c. Amending the "Family" definition to conform with State Law
d. Adoption of a transitional housing definition and allowing the use as a
permitted use in the Residential Multi-Family Zone
e. Removal of the Multi-Family Conditional Use Permit requirement and
allowing multi- family uses as a permitted use in the Residential Multi-
Family Zone
f. Amending the Group Home and Small Family Residential Care Facility
Definitions to conform to the Community Care Facilities Act
g. Other minor amendments necessary to implement the revisions

VERBAL COMMUNICATIONS
John Bourgeois
- Announced that Mid Peninsula Open Space District will be holding a series of
regional public meetings to discuss the reprioritizing of their goals and objectives.
OTHER BUSINESS
4. Information Report - Potential amendments to Town Policies regarding
Community Benefit
Sandy Baily, Community Development Director, presented the staff report
- Advised traffic impact fees were not agendized and will not be discussed tonight. It
will be scheduled at a future meeting in 2014.
Opened the Public Hearing at 7:19 p.m.
Jak VanNada
- Spoke on the fees charged to developers.
Jeff Loughridge
- Spoke on the term "community benefit" and the concerns around traffic in Los
Gatos.
Closed the Public Hearing at 7:28 p.m.
Council discussed the matter.
Staff Action Items
- For information purposes, staff will provide by the end of November the current fee
schedule including any additional fees, as well as examples of how the fees are
applied to development projects.
- In a study session in February or March, staff will:
Clarify the concept of infill and what types of fees or community benefit are
o
charged or requested under current policies;
Present a traffic impact fee study, including the impacts of any fee increases
o
on different types of projects and comparisons to other jurisdictions.
- To enhance public access to fee information, staff will ensure the fees are available
in one document for the public hearing occurring in April and will explore including
information about the fees associated with development projects in the fiscal impact
section of Town Council reports so that this information is known prior to approval.
