AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF SIEMENS INDUSTRY, INC. AND AUTHORIZE RECORDING BY THE
CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Siemens Industry, Inc. and authorize recording by the Clerk Administrator.
BACKGROUND:
Downtown Los Gatos is a popular destination for both residents and visitors due to its unique
setting which features many local businesses and restaurants. The streetscape and trees along
Santa Cruz Avenue and Main Street are a key feature of the aesthetic beauty in the downtown
area.
The condition of the tree lights in the downtown area has been less than ideal due to the type of
lights and method of installation in the tree foliage. Maintenance has been an ongoing challenge
as well. The Town has received numerous public inquiries regarding the condition of the tree
lights downtown and requests that the Town pursue an installation that is more aesthetically
pleasing.
DISCUSSION:
Staff consulted with agencies, both public and private, to evaluate outdoor tree lighting
improvement options. It was determined that the best approach both aesthetically and
operationally is to install new LED lights on downtown trees by "wrapping" the tree trunks,
rather than the system of light strings among the tree branches.

DISCUSSION (cont'd):
Staff prepared a bid package for the installation of new LED tree lights for downtown and
solicited bids for the project according to'the Town's informal bid process that is applicable for
projects under $100,000 in construction cost.
On October 15, 2012, Town Council awarded the contract to Siemens Industry, Inc. After the
installation of the new lights, further refinements and adjustments to the tree light system were
made by the contractor at the direction of the staff, to ensure the tree light layout and
presentation meets the community expectations and enhances the downtown area.
The contracted work has been satisfactorily completed by Siemens Industry, Inc. and is being
recommended for acceptance by the Parks and Public Works Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Siemens Industry, Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated in the fiscal
table on the following page.
