May 20th at 7pm in the Town Council Chambers The Albright Citizens group is ok with increasing the present site from 250,000 sq. ft to 350,000 square feet, but not ok going to 550,000 square feet. When combined with the North 40 and other projects at that end of town, over 60,000 cars a day will drive on all or parts of Lark Avenue. People who currently get onto 17 or 85 will be severely impacted and will start heading to the Hwy 9 entrance. All big projects cause backflow to other areas of thow that don't expect the impact to hit them (like those of us living at the south end of town). We are asking for your support. The two projects total over 1,000,000 square feet. Campbell, Less than one mile away is also proposing another 1,000,000 square feet on Dell. Your small town character is going to be changed and we're asking for you to come to the town council meeting. Please speak if you can, or let me know if you will read a speech written by another member of our group. Strength comes in numbers, and I believe the best way to influence the decision of the Town Council is to have a large crowd opposing this development at 550,000 sq ft. If you need a written script to read at the meeting, please email me by Saturday, May 18th and we will provide one for you. You will have 2-3 minutes to make a statement. Major issues: Traffic congestion with noise and pollution, aesthetics (4 stories, block mountain vistas, not compatible with the Town of Los Gatos General Plan), loss of small town character, etc. Bring your family members, neighbors, and friends. Print Editor- Silicon Valley Business Journal Email j Twitter The fate of Netflix's expansion lies in the hands of the Los Gatos Town Council. On Monday night, Netflix Inc. will know if construction of a new 550,000-square-foot campus moves ahead or falls by the wayside. Just getting to this point has been a steep climb. The developer, John Shenk, has reworked the plans multiple tunes to appease the town. It experienced starts and stops, a lawsuit and delays that now has the project running out of time. After three years, Netflix is bursting at the seams in its current facilities. If the council says no, Netflix will most certainly look north to friendlier cities like San Jose and Santa Clara — cities that are chomping at the bit to put out the welcome mat for the streaming media giant. If Los Gatos kills the project, the pitches will begin in earnest and most likely include concessions to accommodate Netflix's growth needs. If that's how it plays out, Los Gatos will be the ultimate loser. The town will lose $2 million in annual sales taxes. Netflix's sales taxes make up roughly 6 percent of general fund revenue. That's a lot of cash to throw away. It also will lose developer fees — originally pegged at $1.6 million — that would be applied toward community benefits, transportation improvements and school district needs. If Los Gatos nixes Netflix, it will also send a crushing message to big business: Not in our town, thank you very much. We like things just the way they are. The logic against the project isn't there. Yes, it's big, on 21 acres. But those acres are on the fringe of the town, right next to Highway 85. If approved, it would be a terrific gateway into Los Gatos, instead of the bundle of aging buildings that currently stands there. Many in the town argue it would impact traffic and create congestion. But the most recent proposal took out the residential component and reduced building heights, two big rubs for some residents. Is an anti -business climate really what Los Gatos wants to be known for? How about doing something very unlike Los Gatos — take a pro -business position and give Netflix the green light Will Netflix remain in Los Gatos or move on? For the second time, the Los Gatos Town Council is poised to decide Monday whether to give Netflix Inc. the space it needs to stay where it grew up. If it declines, observers say, the digital rental giant could plant its flag in another city. "Is that a concern? Absolutely," said former Mayor Steve Rice, who supports the project but is no longer on the council. "They're already out of space." Netflix has about 1,000 workers in its Los Gatos offices and its presence is a lucrative one for the town of 30,000. Netflix sales taxes provide about $2 million annually to the town, which has an annual budget of $35 million — a significant consideration for a town without a large retail base. The latest proposal seeks permission for 550,000 square feet of office space, spread among four, four-story modern -style buildings topping out at 65 feet tall. The project is to be located on the 21.5-acre site at the intersection of Albright Way and Winchester Boulevard, across from Netflix's current corporate headquarters. The latest incarnation is a significant change from a previous proposal that also sought 168 senior housing units and five -story, Mission -style office buildings 20 feet taller. A neighborhood opposition group challenged that version in court on environmental grounds. A judge in April 2012 ordered a full environmental review and voided the prior approvals, forcing the developer to start from square one. The Council's "yes" vote on Monday is not guaranteed. In an advisory 4-3 vote last month, the town's Planning Commission set aside city staff's recommendation and urged the council to deny the project. At the meeting, some residents, mostly from the adjacent Charter Oaks neighborhood, objected to the magnitude of the scaled -back project. But developer John R. Shenk, who represents property owner LG Business Park LLC, said the new proposal has been reconfigured to address residents' concerns while still meeting Netflix's needs and those of other potential tenants down the road. "This is an opportunity for the town to allow us to reinvest in a very significant way. It's an opportunity to attract and retain wonderful jobs and fulfill many goals of the General Plan," Shenk said. Commercial real estate observers say the decision is bigger than Netflix, and will signal whether the picturesque community will share in the office revival sweeping the Valley — or shut the door to tenants. "If you want to have a major corporate user in town, you have to provide them suitable modern facilities," said Erik Hallgrirnson, a broker with Cassidy Turley who is active in the West Valley market. A Netflix spokesman declined to comment for this story, but the company has been a visible presence at public hearings throughout the process. Netflix has signed a lease for the first of the 137,500-square-foot buildings and has options to take down the rest of the space, a signal that the company is committed to the project. "I'm optimistic we can get to a decision expeditiously on this, because it does matter," CFO David Wells told the town Planning Commission on April 24. "We are bumping up against our ability to stay where we are ... We would love to stay here. We like it. Our employees like it ... We're more than committed to Los Gatos. It's our intent to stay here. But we're just out of options at this point." Necessary space Shenk said the project would give Netflix the breathing room it desperately needs. The company's headquarters currently occupies 160,000 square feet, but Netflix has leased up nearby older office buildings as a fast clip in recent quarters. After a rough couple of years, the company has returned to a growth story and its stock is up big-time. "Netflix wants to stay and grow in Los Gatos," Shenk said. "Town residents are in an enviable position. The way we do that is to provide them with the Class A space to operate efficiently." He added the campus would benefit the town to the tune of $1.4 million a year in property taxes. The developer is also expected to offer a package of "community benefits" to the city, Town Manager Greg Larson said. "This is an opportunity for the town to allow us to reinvest in a very significant way. It's an opportunity to attract and retain wonderful jobs and fulfill many goals of the General Plan," Shenk said. The current business park contains about 250,000 square feet of older office/R&D space, most of which is vacant, which would be demolished to make way for the new campus. Building the first phase would take about 14 months. One point of tension is building height. Some opponents say the developer should work within the existing 35-foot height limit, or lease existing space. The new buildings would rise 65 feet, though the developer says that screening with trees and careful site planning means they wouldn't loom over their neighbors. Hallgrimson said a 35-foot height limit would not provide the kind of space Netflix and other high-tech tenants need. Class A office vacancy in Los Gatos stood at a miniscule 3.5 percent in the first quarter, but the town had zero availabilities of space 20,000-square-feet and up. Further, tech tenants don't want to spread out, and would prefer to keep employees close together, he said. "You have to go bigger for it to make economic sense, and Netflix wants a larger scale project," he said. "You can decide that as a town you don't want that," he added. If that's the case, he said, "Netflix will focus their facility search elsewhere. They will likely move." Mayor Barbara Spector, who voted against the previous iteration, declined to say which way she was inclined to vote this time around. "We have probably several feet of documentation on this we are going to have to review," Spector said. "We have a very engaged population, especially on this issue." The nearby residents are like people who bought next to an airport, and then complain when it expands on its own land. Situated in low lying ground, they have no view to loose. Additionally, and most importantly, this development is crucial to the funding of the town and schools, and keeping successful businesses in our town. The alternative, like what happened with the Ford dealership, is high density housing and cruddy retail/office development that decimates our school districts with overcrowding and our downtown with competition. You can continue to believe that we can go back to a world of the 1950s, where Los Gatos had 10,000 residents and a grocery store on S Santa Cruz, but it won't happen. Businesses and shoppers will go elsewhere. The best thing this town did recently was to allow Apple downtown. The next best thing will be to keep Netflix and all of its employees. They seem to feel that the developer's plan for four building and a parking garage almost twice the 35 foot Los Gatos height restriction must be accepted without compromise or the town's "economic vitality" will be jeopardized. I'm sorry that they have so little faith in our town's resourcefulness and ability to effectively manage its services. Did they attend the last town meeting on Albright Way? Netflix's president spoke that evening. I didn't hear him say that Netflix would move if the project was not built to the developer's current design. Buildings with three, office space stories and within the town height restriction are possible by recessing floors including parking below ground level. The first floor could be graded for maximum light. A park like setting with more convenient parking would be attractive to Netflix and other Class A tenants. I personally asked the developer why they hadn't chosen to recess floors. The answer was that it was too costly. What price would you set for the sacrifice of my community's future views and privacy? All commercial residences of Albright Way will pay taxes. If not Netflix, then another company will find our location desirable. The We Support Los Gatos people seem to forget or ignore other sources of revenue. They lament new housing construction that will possibly bring more children but definitely more tax dollars. The North Forty development will increase commercial revenue. Smaller buildings and new construction alone Los Gatos Boulevard are revenue generators. Our focus should be on future opportunities. Those in favor of the currently proposed Albright Office Park are investors, contractors, relators and tenants whose profit depends on building size. The larger the building the more money generated. How many town people without a profit motive have spoken for this project at council meetings? If Albright is approved, every new developer will be able to point to the precedent in designing their buildings. How would you like a four story complex looming over your house and yard? What will happen to our small town appeal? Soon Los Gatos will look like downtown San Jose. As a professional corporate real estate manager for the past 24 years, primarily in the Bay Area, I have worked with the premier high tech, high growth companies (Apple, eBay, Starbucks, Sun Microsystems, Nortel Networks, etc.) and am very familiar with the real estate needs of these type of evolving and growing companies. On a side note, I grew up in the South San Jose area and had the opportunity to enjoy and spend quite a bit of time in the town of Los Gatos over the years — it is one of my favorite towns. I currently live in Scotts Valley and love the close proximity to LG. One of the great things about the town is its close knit, laid back community and its dedication to the schools and children of the town. Given my background and the love for the town, I believe I would be remiss if I didn't express my whole- hearted support for the Albright project. A few points I would like to express regarding the project are as follows: • The current Albright property is past its useful life, is not efficient (energy, tenant requirements, etc.). Albright is currently an industrial park — as we know, most manufacturing that was done in the Bay Area is now off -shore or in lower cost US locations. The Bay Area is now a knowledge base work community — especially with the vast technology changes (internet, social, mobile, cloud computing, etc.). Companies are looking for the campus feel to support innovation, interaction, collaboration and growth. • The campus design must be in alignment with these attributes. Larger floor plates allow for better adjacencies and cross communication between the groups along with allowing teams to grow without having to be separated. Outdoor and community space allow for individuals, teams and groups to come together on an impromptu basis — the quick connection and communication allows for fast, thoughtful decisions and supports the rapid time to market business requirements. • There is a reason that Apple is building a large, interconnected campus. There is a reason that the new CEO of Yahoo wants to bring back folks from the home office. In order to attract the new world entrepreneurial companies that are going to be the next generation employers, the campus environment is critical. amio 7-1D • I firmly believe the land and the current design of the campus is a perfect match to what will attract the best companies to LG. You approved the project two years ago without all of that listed above. Now, you have provided all of this compromise for the citizens and it's simply time to approve this AGAIN and move ahead. This is a no brainer. You have one nut job from Charter Oaks WHO DOESN'T ACTUALLY LIVE THERE, BUT LEASES HER UNIT OUT FOR PROFIT who wants the existing buildings to remain with no Class A office space to be developed in Los Gatos despite Albright being located along Highway 85. You have one industrial, washed up commercial broker feeding his uninformed neighbors with rhetoric because he wants to stop ANY development in Los Gatos. The definition of NIMBY without any comprehension of the reductions the Council has already forced upon the development. As a parent in the Los Gatos school district, I believe the project will bring critical revenue for the school district, especially when enrollments are ceaselessly growing each year. As a small business owner who provides software product design services to over 2 dozen local technology companies, I see Los Gatos continually falling further and further behind other communities with regard to participation in the vibrant Silicon Valley economy, and thus missing out on many of the economic benefits this brings: tax revenues, local technology jobs that pay well, and a population of younger professionals who spend more money in town. Without this Albright complex, it is difficult to find attractive, modern office space suitable for a technology startup within town limits. I know because I've tried. After riding down Argues as it turns into Scott at Oakmead Village Drive in Santa Clara I became viscerally aware of the negative impact of four story buildings. You initially ride past the scores of two story Silicon Valley buildings in their treed settings and your senses are than accosted by the height and\mass of four stories. You just can't get the impact from looking at cranes or artist drawings. These buildings are out of place for most of Silicon Valley and have as much place in Los Gatos as an oil refinery. It makes no sense except for a builder trying to push for more bucks to allow anything above the restricted heights. You can't make a silk purse out of a pig's ear and that is what is going on here. The site is just wrong: 1--From a traffic standpoint a nightmare in the making 2- Passing under 85 on the Vasona trail and instead of current subtle unobtrusive buildings you will have your senses and your peaceful soul time ASSULTED BY MASSIVE URBAN STRUCTURES 3- Breaking well thought out building codes is immoral and bad precedent that will eventually break down the small town Los Gatos pride that we all love. Paradise lost -In my lifetime I've seen too many times how development destroys the soul of a town. We don't need to bend over and break our own rules. We are doing just fine. Indeed, the city government is thinking and getting too big for a small town and could be easily trimmed when needed.. October 26, 1996 4- The Los Gatos people who will live in the shadow of this mistake overwhelmingly don't want it. Perhaps we should break the code and allow a four story building in their back yards of those supporters who live well away from the project. They would than finally understand what e the Charter Oaks community will have to put up with. Those developers and those who will profit personally from this venture are pushing Los Gatos to become the next San Jose or Santa Clara we don't want to go there. 5- They don't need massive buildings .As someone at SRI who studied what makes for the most productive research parks in both the US and Canada I've found the best parks are those with a footprint similar to the existing park 1-2 stories so all this realtor /developer nonsense that the market needs four stories is just wrong but if they need such buildings put them in cities that have them now, never in Los Gatos.
