Ord 1561 - AMENDING CHAPTER 21 OF THE TOWN CODE TO (1) STATE THAT CONFIDENTIAL AND MANAGEMENT EMPLOYEES AS DESIGNATED IN THE PERSONNEL RULES ARE NOT SUBJECT TO CIVIL SERVICE (SEC. 21- 2[f]); (2) PROVIDE THAT EMPLOYEES TRANSFERRED FROM A CIVIL (COMPETITIVEORDINANCE NO. 1561
ORDINANCE AMENDING CHAPTER 21 OF THE TOWN CODE TO (1) STATE THAT
CONFIDENTIAL AND MANAGEMENT EMPLOYEES AS DESIGNATED IN THE PERSONNEL
RULES ARE NOT SUBJECT TO CIVIL SERVICE (SEC. 21- 2[f]); (2) PROVIDE
THAT EMPLOYEES TRANSFERRED FROM A CIVIL (COMPETITIVE) SERVICE POSI-
TION TO AN EXEMPT POSITION ARE GUARANTEED THE RIGHT TO RETURN TO
THEIR FORMER CIVIL SERVICE POSITION (SEC. 21 -13); AND (3) PROVIDE
THAT AN EMPLOYEE OF THE TOWN MAY APPLY FOR A PROMOTIONAL EXAM
(SEC. 21 -13.5)
The Town Council of Los Gatos hereby ORDAINS:
SECTION 1.
Section 21 -2 of the Town Code is amended to read as follows:
"Sec. 21 -2 . A licability of Chapter.
The provision of this chapter shall apply to all offices, positions
and employments in the service of the Town except the following, which
are exempt from this chaoter unless otherwise stated herein:
(a) Elective officers and their duly appointed deputies;
(b) Members of appointive boards, commissions and committees;
(c) Persons engaged under contract to supply expert, professional
of technical services;
(d) Volunteer personnel, such as volunteer firemen, who receive
no regular compensation from the Town;
(e) The town manager; department heads; the town attorney; and
the tax and license collector;
(f) Management employees, as designated in the Town's Management
Compensation Plan
(g) Confidential employees, as designated in the personnel rule
SECTION 2.
Section 21 -10 of the Town Code is amended to add the following sub-
paragraph:
" (1) Designation of confidential employees and the establishment of
rules regarding their employment
SECTION 3.
Section 21 -13 of the Town Code is amended to read as follows:
" Sec. 21 -13 Appointments to competitive service - Probationary period
All regular appointments to the competitive service, including
promotional appointments, shall be for a probationary period of not
less than one year, except that, as to any class or position, the rules
may provide for an extension of the period for not more than an addi-
tional six months. During the probationary period, the employee may be
rejected at any time without right of appeal or hearing.
Any employee rejected during the probationary period from a position
to which he has been promoted shall be reinstated to the position from
which he was promoted, unless he is dismissed from the Town service as
provided in this chapter and the personnel rules.
An employee in the competitive service promoted or transferred to
a position not included in the competitive service shall be reinstated
to the position from which he was promoted or transferred if, w}tbin - ene

miss him, unless he is discharged in the manner provided in this chapter
and the personnel rules for positions in the competitive service."
SECTION 4.
Section 21 -13.5 is added to the Town Code as follows:
" Sec. 21 -13.5
Right to apply for promotional exam
All Town employees shall be eligible to apply for a promotional
examination."
WITIMIFIRIMUS
This Ordinance takes effect 30 days after the date it is adopted. Within
15 days after this ordinance is adopted, the Town Clerk shall cause it to be
published once in a newspaper of general circulation published and circulated in
the Town.
This Ordinance was introduced at a regular meeting of the Town Council of
