AN ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING THE ZONING ORDINANCE EFFECTING
ZONE CHANGE NO. 6 FROM HR -1 to HR -1 -PD
SECTION I
The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the
zoning on property located at the southerly end of Oak Knoll Drive shown on the map
which is attached hereto marked Exhibit A and is a part of this ordinance, from HR -1
(Hillside Residential, 1 -5 acres per dwelling unit) to HR -1 -PD (Hillside
Residential, 1 -5 acres per dwelling unit - Planned Development).
SECTION II
The PD (Planned Development Overlay) zone established by this ordinance
authorizes the following construction and use of improvements:
1. Street and other improvements shown and required on the Official
Development Plan.
2. Uses permitted are those specified in the HR (Hillside Residential) zone by
Section 4.24.020 (Permitted Uses) and 4.42.030 (Conditional Uses) of the
Zoning Ordinance, as those sections exist at the time of the adoption of
this ordinance, or as they may be amended in the future. However, no use
listed in Section 4.24.030 is allowed unless specifically authorized by
this ordinance, or by Conditional Use Permit.
SECTION III
COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS
All general provisions in Article 3 of the Zoning Ordinance apply, and the
provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official
Development Plan specifically shows otherwise.
SECTION IV
Architecture and Site Approval is required before any grading or construction
work is performed, whether or not a permit is required for the work, and before any
permit for grading or construction is issued. Grading or construction permits shall
only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance.
SECTION V
OFFICIAL DEVELOPMENT PLAN
In addition to Exhibit A, the attached Exhibits B -D (Tentative Map, and Exhibit
E-(Street and Culvert Sections) are part of the Official Development Plan. The
following performance standards are part of the Official Development Plan and must
be complied with before issuance of any grading or construction permits:
g. Fence Santa Clara Valley Water District right -of -way and install curb
cut and gate from Oak Knoll Drive, to the satisfaction of the Santa
Clara Valley Water District.
h. Slope stabilization, erosion control and bank protection improvements
in Daves Creek and debris basin.
3. The applicant shall enter into recordable agreement with the Town to
provide perpetual maintenance of Daves Creek, south of the debris basin, to
the satisfaction of the Town Engineer.
4. The applicant shall trim and prune the large eucalyptus trees at the
southerly terminus of Oak Knoll Drive, under the supervision of the Town
Superintendent of Parks and Forestry.
5. Hydrants shall be locted as required by the Central Fire Protection
District.
6. Hydants shall be installed prior to construction of any buildings, and
shall be accepted by - the Central Fire Protection District.
7. Driveway, turnaround, and hydrant on Lot #9 shall be installed prior to
construction of any buildings.
8. The building pad on Lot 9 should be moved northerly 20 to 30 feet and
easterly an adequate distance to be determined through Architecture and
Site approval.
9. Pending a Town Council decision on the adjacent Bandov subdivision
(Alternate A, M- 81 -10A), the following conditions from the City of Monte
Sereno shall be included:
a. Alignment and improvement requirements for Oak Knoll Drive within the
City of Monte Sereno shall be as required within the City of Monte
Sereno. Specifically, pavement width to be 33 ft., flow -line to
flow -line, with City standard rolled concrete gutters. Right -of -way
is to be 50 ft. Right -of -way less than 50 ft. may be allowed at the
City's discretion. Street improvements may be narrowed to protect
select trees. The developer shall enter into a street reimbursement
agreement providing for sharing /reimbursement of road improvement
costs by other undeveloped properties on Oak Knoll Drive. Alignment
of Oak Knoll Drive is to be relocated to enter Daves opposite Palos
Verdes Drive. In the absence of rights -of -way to allow this
relocation, temporary access may be taken along the existing Oak Knoll
Drive. In such event, the temporary improvement shall be 24 ft. of
pavement. At such time as the right -of -way for the new alignment of
Oak Knoll Drive is acquired, all use of the existing Oak Knoll Drive
shall be abandoned and a 2 ft. fee title reserve strip along the Daves
Avenue right -of -way dedicated to the City of Monte Sereno.

1. Right -of -way shall be dedicated to the satisfaction of the Town Engineer as
follows:
a.
Oak Knoll Drive 56 feet wide
with a 42 -foot radius cul -de -sac bulb at
the easterly terminus.
b.
Oak Knoll Drive 50 feet wide
within the City of Monte Sereno south of
Daves Avenue.
C.
Oak Knoll Court 40 feet wide
with a 37 -foot radius cul -de -sac bulb at
the easterly terminus.
d.
Right -of -way for Daves Creek,
as recommended by the Santa Clara Valley
Water District.
e.
Slope, utility and emergency
access easements as required.
f.
Easement rights to Daves Creek, south of the debris basin.
2. Guarantee, by contract and bond, the following improvements, to the
satisfaction of the Town Engineer, with the consultation of the City of
Monte Sereno:
a. Oak Knoll Drive, 36 feet wide with a 32 -foot curb radius cul -de -sac
bulb at the easterly terminus, including curb, gutter, sidewalk,
paving, masonry retaining walls, street lights and storm and sanitary
sewers as required, to be consistent with the upcoming Town Council
decision on the adjacent Bandov subdivision (M- 81 -10A).
b. Oak Knoll Drive (Monte Sereno), 33 feet wide, including rolled curb,
paving, street lights, storm and sanitary sewers as required, and
subject to change by the City of Monte Sereno, to be consistent with
the upcoming Town Council decision on the adjacent Bandov subdivision
(M- 81 -10A).
C. Oak Knoll Court, 24 feet wide with a 32 -foot curb radius cul -de -sac
bulb at the southerly terminus, including curb, gutter, sidewalk (one
side), paving, street lights, masonry retaining walls, storm and
sanitary sewers as required.
d. Private road and driveway from Oak Knoll Court to Lot No. 9, 15 to 18
feet side, including curbs, paving, masonry retaining walls, fire
truck turnarounds, storm and sanitary sewers as required.
e. Kavin Lane, complete closure of Kavin Lane, including curb, gutter and
paving.
f. Emergency access road (12 feet wide) between Oak Knoll and Kavin Lane,
including sidewalk, tree removal, paving and gate and locking devices,
to the satisfaction of the Central Fire District and Police
Department.

b. Storm drain improvements from Oak Knoll Drive subject to review
and approval of Monte Sereno City Engineer. Improvement costs
subject to inclusion in reimbursement agreement required in a.
above.
C. Dedicate a 15 foot wide public service, emergency access, and
pedestrian easement from the public street to the southerly
property line of Lot 7. Locate the easement along the easterly
property line of Lot 7. At the time of any future development of
the adjacent property to the south, a gate shall be installed.
10. Water service to the Dalziel and Ross properties shall be taken from
the improvements made in this project, and that as part of this
project their water service shall be connected.
11. There shall be no unscheduled disruption of water service. The new
water service shall be installed prior to any grading or construction
near the old line.
12. Scheduled disruptions shall be at an absolute minimum.
13. Water meters for the properties of Dalziel and Ross shall be installed
per the requirements of San Jose Water Works.
14. Placement of property line fences on the hillside shall be subject to
Architecture and Site approval.
15. The applicant shall dedicate an open space easement to the Town, to
the satisfaction of the Town Attorney and Planning Director, for all
of that portion of Lot 9 that is above the 120 foot elevation line as
shown on the approved plans. That portion of Lot 9 above the 120 foot
elevation that lies within the revised building envelope may be
excluded from the easement.
SECTION VI
This ordinance takes effect 30 days after the date it is adopted. Within 15
days after this ordinance is adopted the Town Clerk shall cause it to be published
once in a newspaper of general circulation and circulated in the Town.
This ordinance was introduced at a regular meeting of 'the Town Council of the
Town of Los Gatos on September 13th , 1982, and adopted by the following
vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town
Council on September 20th , 1982.
