AN ORDINANCE OF THE TOWN OF LOS GATOS REPEALING SECTIONS

THROUGH 7.10 INCLUSIVE T0, ORDI ANCE NO. 392, AS AMENDED,
DESIGNATED AS THE ZONING ORDINANCE OF THE TOWN OF LOS GATOS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS:
Section 1. Sections 7.00 through 7.31 of the Ordinance cited in the title
above are repealed.
Section 2. Sections 7.00 through 7.1u inclusive, are hereby added to the
Ordinance cited in the title above to read as follows:
SECTION 7.00 C -1 NEIGHBORHOOD COMMERCIAL ZONING DISTRICTS.
SECTION 7.01 APPLICATION
The regulations set forth in this Section 7.00 shall apply in all C -1
Districts.
SECTION 7.02 INTENT
The C -1 District is intended to provide high quality architecturally
designed buildings compatible to surrounding residential development, permitting
a limited number of retail, service and administrative establishments whose main
purpose is that of service to a neighborhood and is not intended to provide those
amenities provided by C -2 (General Commercial) shopping facilities.
SECTION 7.03 ARCHITECTURAL AND SITE APPROVAL
Architectural and site approval shall be secured for the establishment and
conduct of any use in the C -1 District as provided in Section 14.00 of Ordinance
No. 392.
SECTION 7.04 USES PERMITTED
a. Bakery goods store
b. Banks
c. Barbershops and beauty shops
d. Book stores
e. Candy stores, soda fountains and ice cream parlors
f. Cleaning and laundry agencies, not including the plant, but including
pressing and laundromets
g. Drug store
h. Food stores, delicatessens and supermarkets
I. Gift shop
j. Hobby shop
k. Insurance office
1. Package liquor store
m. Professional offices
n. Restaurants, except drive-ins
o. Real Estate office
p. Shoe repair

SECTION 7.05 USES PE;IMITTED SUBJECT TO SECURING A USE PERMIT
The following uses are permitted in C-1 Districts subject to securing
a use permit as provided for in Section 18.21 as amended, of Ordinance No. 392, as
amended:
a. Automobile service stations limited to the selling of petroleum
products, tires, batteries and accessories, servicing of autos,
including minor automotive repair, but excluding auto body, fender,
major engine repair or rebuilding, outside display of goods except
for petroleum products, and outside repairs of any kind.
b. Bakeries
c. Dry cleaning plants
d. Neighborhood variety stores
e. Other uses customarily found in neighborhood shopping areas and
compatible to the particular neighborhood.
SECTION 7.06 DEVELOPMENT STANDARDS
The following development standards shall apply in the C -1 Districts:
SECTION 7.07 MERCHANDISE SALES REQUIREMENTS
a. All businesses, services and processes shall be conducted entirely
within a completely enclosed building except for parking and loading
spaces, outdoor dining areas, and the sale of gasoline and oil at
service stations.
b. All products produced on the site of any of the permitted uses shall
be sold at retail only and on the site where produced.
c. No use shall be permitted and no process, equipment or materials shall
be employed which are found by the Commission to be objectionable by
reason of odor, dust, smoke, noise, vibPation, illumination, glare,
or unsightliness,
SECTION 7.08 YARDS
The following regulations shall apply:
a. Where a Cbl District abutts, sides on or is across a street or
highway from residentially zoned land the following regulations shall
apply:
1. Front yard, twenty -five (25) feet; said yard shall be landscaped
and maintained.
2. Side yard abutting adjacent residential property twenty (20)
feet; said side yard shall be increased in proportion to the
height of building to provide a forty -five (45) degree light and
air factor from property line when applicable due to building
design.
A six (6) foot high masonry wall shall be required at side
property line.
3. Side yards abutting street, same as front yard.
4. Rear yard, twenty (20) feet; said rear yard shall be increased
in proportion to the height of building to provide a forty -five
(45) degree light and air factor from property line when applicable
due to building design.
A six (6) foot high masonry wall shall be required at rear

b. Where a C -1 District abutts, sides or is across the street from any
other zone district, the following regulations shall apply:
1. Front yard fifteen (15) feet; said yard shall be landscaped
and maintained.
2. Side yard abutting adjacent property zoned for commercial or
industrial purposes. none,except for CH zone the said side yard
shall be a minimum of six (6 - 0'5 feet.
3. Rear yard: None
SECTION 7.09 HEIGHT
The maximum height for any building or structure in the C-1 District
shall be thirty -five (35) feet.
SECTION 7.10 LOT AREA COVERAGE
The maximum building coverage for the C -1 District, including any type
of accessory building shall be 50 %.
SECTION 7.11 GARBAGE AND WASTE CONTAINERS
All areas used for the storage of garbage cans and waste containers shall
be enclosed by a wall or fence at least six (6) feet high.
SECTION 7.12 PARKING
The parking requirements shall be as follows:
The amount of space required for off-street parking shall be established
by the Planning Commission through the architectural and site approval procedure.
The Commission shall require sufficient offs- street parking facilities for employees
and customers to prevent traffic congestion. The Commission shall adopt off - street
parking standards for classes of land uses'to serve as a guide in determining
parking requirements. Standards for the classes shall be based on the parking -
generating characteristics of the uses within the classes.
Said parking areas shall have a minimum of 3 of its area landscaped with
trees and shrubs. Required yard landscaping shall not be applied to satisfy
this percentage.
Said parking area shall be developed to all the standards required in
Section 15.02.2 of Ordinance No. 392 as amended.
SECTION 7.13 LOADING AREAS
All loading areas shall be as follows:
Sufficient off- street space for loading and delivery purposes shall be
required by the Planning Commission through the architectural and site approval
procedure to prevent traffic congestion.
SECTION 7.14 SIGN CONTROL.
Any exterior sign displayed shall pertain only to a use conducted within
the building; shall be attached flat against a wall of the building and parallel
with its horizontal dimension and shall front the principal street, a parking area
so 3^
in the rear or in the case of a corner building on that portion of the side street
within fifty (50) feet of the principle street. In no case shall a sign project
above a height which is five (5) feet below the coping or roof line,,
SECTION 7..15 CONTROL OF LIGHTING
Electrical reflectors, spotlights, floodlights, and other sources of
illumination may be used to illuminate buildings, landscaping, signs, parking and
loading areas on any property, provided they are equipped with proper lenses or
other devices concentrating the illumination upon the buildings, landscaping,
signs, parking and loading areas or any property,.and prevent -ing arty bright,
direct illumination upon adjacent property or any public right of way. No
unshielded lights, reflector or spotlights shall be so located and directed that
they are shining towards or are directly visible from frequently travelled public
rights of way, and no shoe string lighting shall be permitted.
SECTION 7.16 USE OF DWELLINGS
No building or structure designed for or intended to be used, or which
has been used as a dwelling shall be used for the conduct of any business, store
or shop in the C -1 District; providing, however, that any business use existing
in a dwelling in a C -1 District at the time of the adoption of this Ordinance
shall be considered as an existing use, but may not be extended, expanded, enlarged
or changed to any other use unless and until a permit for same has first been
obtained as provided under the Use Permit procedure of this Ordinance.
SECTION 7.17 EXISTING YARD REQUIREMENTS
No building in a C -1 District used for residential purposes shall have
its yard requirements reduced in size from those which existed at the time of the
adoption of this Ordinance.
SECTION 7.18 REVISION OF CLASSIFICATION
Should land classified to a C-1 District not be used and /or developed
for the uses permitted in said District within two (2) years from the effective
date of the reclassification, the Planning Commission shall hold a public hearing
and the applicant shall state his reasons why the land has not been developed
and if cause is not shown, the Commission shall cause the land to be reclassified
to single family residential.
Section 3. This Ordinance shall take effect and be in force thirty (30)
days from and after date of its passage and before the expiration of fifteen (15)
days after its passage it shall be published once with the names of the members
voting for and against the same in the Los Gatos Times- Saratoga Oberver, a
newspaper published in the Town of Los Gatos.
