Ordinance 1129 - AMENDING ORDINANCE NO..867, EFFECTING ZONE CHANGE NO. _ 72 �, TO R -1 20,000 -PD. & REPEALING ORDINANCE NO. 1123ORDINANCE NO. 1129 ORDINANCE OF THE TOWN OF LOS GATOS AMENDING ORDINANCE NO..867, EFFECTING ZONE CHANGE NO. _ 72 �, TO R -1 20,000 -PD. & REPEALING ORDINANCE NO. 1123 THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS SECTION 1 . Rezoning of Property. Ordinance No. 867 is hereby amended to change the following described real property from the R- 1:20,000 (Single Family Resi- dential, 20,000 square foot minimum lot size) to R- 1:20,000 -PD (Single family Residential- Planned Development Combining) Zone Classification. All that real property situated within the Town of Los Gatos, County of Santa Clara, State of California, consisting of approximately 32 acres and located at the northerly terminus of Bicknell Road and east of the easterly terminus of Montclair Road, more particularly described on the attached map. Ordinance No. 867 is further amended to change the zoning map to conform to the map attached hereto. SECTION 2. Uses and Improvements Authorized The PD (Planned Development Combining) Zone established by this Ordinance authorizes the development on the above described real property of 48 single family residential building sites and other improvements shown and required on the "Official Development Plan" on file with the Town Clerk and Planning Department. SECTION 3. Official Development Plan. Prior to the issuance of any permits in compliance with the hereby approved, precise plans shall be submitted and approved by the Planning Commission of the Town of Los Gatos pursuant to Sect ion 20 .11 of Ord i na nce 86 7. for compliance with Sections 20.6 through 20.9 of the Town Zoning Ordinance and are on file in the Office of the Town Clerk and the office of the Town Planning Department. 1. Preliminary Development Plan of the entire 32 acre parcel illustrating the division of the property into 48 subdivision lots, plus one lot held in common owner- ship by the owners of the 48 lots, a pedestrian - equestrian trail system, land area calculations, and street sections. 2. Building envelope plan which demonstrates the maximum limit of construction within the boundaries of each lot. 3. Examples of how each residential unit will be sited on the sloping parcels, typical floor plans and typical building elevations. In addition to the foregoing plans, the following performance standards are a part of the "Official Development Plant': 1. Streets shall be as shown on the approved Preliminary Plan except that a 24 -foot curb -to -curb road shall be constructed to provide access to Lots 11 -15. 2. A pedestrian pathway system, including a proposal for the extension of the system northerly of the project, shall be provided to the satisfaction of the Site and Architecture Committee. 3. A plan for "off - street" guest parking spaces shall be provided to the satisfaction of the Site and Archi- tecture Committee. 4. Final plans shall indicate a proposal for the improve- ment of Bicknell Road, between Verona Court and Oakwood, 5. Grading criteria shall be established in accordance with re(-,,nmenda t i ons of a qualified Jo i l s Engineer, and approved by the Site and Architecture Committee. 6. No Building Permits shall be issued until all fees due the Town of Los Gatos have been paid, including drainage fees in accordance with Chapter 27 of the Los Gatos Town Code, street tree fees at 40 cents per front foot, and plan check and inspection fees in accordance with the prevailing fee schedule. 7. One lot be removed from Cluster 19 -25 and additional lot be gained in Cluster 26 -29 to offset the loss for the reasons as stated on Page 23 of the draft EIR. 8. Final plans presented to the Town pursuant to Sections 20.11 and 20.12 shall include provisions for the main- tenance of trees as noted on Pages 16, 17, and 18 of the draft EIR. This will require illustrating all trees on each lot; the precise location of the residence, driveway, etc.; and the treatment of the ground to insure the tree preservation. SECTION 4. Repea] of Ord i nan ce 1 1 23 Town Ordinance 1123 effecting zone change 71 to R1- 20,000 -PD is hereby repealed. THIS ORDINANCE SHALL TAKE EFFECT and shall-be in force thirty (30) days after the date of its adoption. The Town Clerk of the Town of Los Gatos shall cause this Ordinance to be published once within fifteen (15) days after its adoption, in the Los Gatos - Saratoga Observer, a newspaper of general circulation, published and circulated in the Town of Los Gatos. The above and foregoing Ordinance was duly and regularly in- troduced at a regular meeting of the Town Council of the Town of Los Gatos held on the 20th day of Ault , 1973.
