ORDINANCE AMENDING THE SUBDIVISION
ORDINANCE OF THE TOWN OF LDS GATOS
CONCERNING CONDOMINIUMS AND PLANNED
DEVELOPMENTS.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
SECTION 1.
Section 27 -9.5 is added to the subdivision ordinance
of the Town of Los Gatos to read:
SEC. 27 -9.5 COVENANTS, ETC. FOR CONDOMINIUMS
AND PLANNED DEVELOPMENTS
When the proposed subdivision is a condominium
or a planned development, the subdivider shall
present with the tentative map a copy of any
instrument or document such as covenants,
conditions and restrictions which is intended to
be used to affect the subdividing of the land.
The regulation imposed by this section is not
limited to the instruments commonly referred to
as covenants, conditions and restrictions, and
includes legends on subdivision maps, deeds of
easement, articles of incorporation and bylaws.
SECTION 2.
Section 27 -12.5 is added to the subdivision ordinance
of the Town of Los Gatos to read:

SEC. 27 -12.5 REVIEW OF COVENANTS, ETC.
In addition to considering all aspects of the
physical design and plans for improvement of the
subdivision, the Planning Commission shall consider
the material required to be presented under the
provisions of section 27 -9.5 in determining whether
the proposed subdivision complies with the standards
for approval of state law and of this ordinance.
SECTION 3.
Section 27 -24.5 is added to the subdivision ordinance
of the Town of Los Gatos to read:
SEC. 27- 24.5: COVENANTS ETC. TO BE PRESENTED
In addition to that material required by
section 27 -24 to be provided, the subdivider shall
provide, in final form, all of the material referred
to in sections 27 -9.5 and 27 -12.5 concerning
covenants, conditions and restrictions and similar
or related matter.
THIS ORDINANCE SHALL TAKE EFFECT and shall be in force
thirty (30) days after the date of its adoption. The Town
Clerk of the Town of Los Gatos shall cause this ordinance
to be published once within fifteen (15) days after its
adoption, in the Los Gatos Times- Saratoga Observer, a
newspaper of general circulation, published and circulated
in the Town of Los Gatos.

The above and foregoing ordinance was duly and regularly
introduced at a regular meeting of the Town Council
of the Town of Los Gatos held on the 7 th_ day of
October
1974
PASSED AND ADOPTED as an ordinance of the Town of Los
Gatos, California, at a regular meeting of the Town Council,
held on the 4th day of November , 1974, by the
following vote-.
