AN ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING THE ZONING ORDINANCE ADDING
SINGLE FAMILY RESIDENTIAL, DOWNTOWN
(R -1D) ZONE
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS:
SECTION 1.
Section 3.41.030, subsection 2, of the Zoning Ordinance
of the Town of Los Gatos is amended to read:
Sec. 3.41.030 Parking Requirements
(2) Multiple -unit dwellings in all zones and
two- family dwellings in the R -lD zone
One and one -half times the number of living
units in such dwellings.
SECTION 2.
Section 3.50.110, subsection 2, of the Zoning Ordinance
of the Town of Los Gatos is amended to..read:
Seca 3.50.110 Expansion of Nonconforming Buildings
(2) The expansion of nonconforming multiple family
dwellings in the RC, HR, R -1, R -D, or R -ID zone
is prohibited.
SECTION 3.
Section 3.50.130, paragraph 2, of the Zoning Ordinance of
the Town of Los Gatos is amended to read:
Sec. 3.50.130 Rebuilding Nonconforming Building
If a nonconforming multiple family dwelling located
in an R -1M, R -11), R -M, or any office, commercial or
industrial zone (section 4.50.010.and 4.70.010) is
destroyed, it may be rebuilt on the same foundation, with
the same number of units, in substantially the same manner
as it existed before its destruction.
SECTION 4.
Section 4.05.010 of the Zoning Ordinance of the Town of
Los Gatos is amended to read:
Sec. 4.05.010 Residential Zones
Residential zones are the RC, HR, R -1, R -IM, R -D,
R -M and R -11) zones.
SECTION S.
Section 4.10.020 of the Zoning Ordinance of the Town of
Los Gatos is amended to read:
Sec. 4.1`0.020 : - F`ence's; Hedges 'and "Walls
In residential zones, fences, hedges and walls not
over six feet high -are allowed on or within all property
lines. No owner or occupant of any corner lot or premises
in the Town shall erect or maintain upon such lot or
premises any fence higher than three feet above the curb
for a distance of thirty feet measured horizontally in
any direction from the point of intersection of the property
lines at street corner.
SECTION 6.
Section 4.10.040 of the Zoning Ordinance of the Town of
Los Gatos is amended to road:

Sec. 4.10.040 Pa tio Covers
In residential zones, patio covers may be permitted to
project into the required rear yard, but shall cover no more
than 40 per cent of the yard.
SECTION 7.
Chapter 4.34 is added to the Zoning Ordinance of the Town of
Los Gatos to read:
CHAPTER 4.34: R -11) OR SINGLE FAMILY RESIDENTIAL, DOWNTOWN,
ZONE
Sec. 4.34.010 Application
The R -1D zone should be applied to areas generally
developed in the late 1800's and early 1900's that are
adjacent to the Central Business District.
Sec. 4.34.020: Intent
The R -1D zone is intended to provide for the preserva-
tion and rehabilitation of architecturally and historically
valuable structures and neighborhoods by assuring adequate
light, air, privacy and open space for each dwelling,
mini traffic and parking congestion, and reduce hazards _
from encroachment of industry and commercial activity. The
zone also allows the continued use of multiple family
dwellings that lawfully existed at the time the property
is rezoned to R -11).
Sec. 4.34.030 Permitted Uses
(1) Single family dwelling, provided that there not be
more than one principal residential structure located
on a single lot or parcel.
(2) Two family dwelling.
(3) Small family day care home.
(4) Residential care facility -- small family home.

Sec. 4.43.040 Conditional Uses
. In addition to the activities authorized by section 4.34.030,
the activities listed in the table in section 5.20.205 are allowed
if a conditional use permit is issued.
Sec. 4.34.050 Lot Area
The minimum lot area is:
(1) 5,000 square feet for single family dwellings
(2) 8,000 square feet for two family dwellings
Sec. 4.34 060 Yards
(1) Front: 15 feet minimum
(2) Rear: 20 feet minimum
(3) Side: 5 feet minimum
(4) Side abutting street: 10 feet minimum
Se c. 4.34.070 Height
The maximum height of any building is 30 feet.
Sec 4.34.080 Architecture and Site Approval
Architecture and site approval is required for all additions
and new construction of a two family dwelling.
All new structures, additions and remodelings proposed to be
constructed in the R -11) zone shall be designed so as to architect-
urally harmonize with the surrounding structures. The factors to
be considered when reviewing the design of such proposed structures
include:
- the height in relation to adjacent structures;
- building materials;
- colors;
- appearance of building facade .facing the street
in terms of its resemblance to a single family
dwelling;
the inclusion of architectural features such as
bay windows and front porches to permit compati-
bility of design with other structures in the
immediate neighborhood.
SECTION 8.
Section 5.20.030, subsection 2, of the Zoning Ordinance
of the Town of Los Gatos is amended to read:
Sec. 5.20.030 Approval Required
(2) Two .family dwellings in the R -1M, R -D, R -M and
R -1D zones.
SECTION 9.
Section 5.20.205, subsections 2, 4 and 5, of the Zoning
Ordinance of the Town of Los GAtos is amended to read:
Sec. 5.20.205 Table of Conditional' Uses
Add a column for the R -1d zone with an "x" opposite the
following uses.
(2) Community Services
a. Public buildl.ng; police, fire, community
center, library, art gallery, museum
C. Public transportation facility
d. Park, plaza, playground
f. Private sports recreation club
g. Convalescent hospital
h. Public schools or college not otherwise
specified

i. Private school or college not otherwise
specified; including a new private school
or college to be located on grounds or within
buildings formerly occupied by a public school
j. Nursery school, provided that each shall be
on a site not less than 20,000 square feet
in area and in a building not less than 2,000
square feet in floor area
o. Church, monastery, convent, and other
institutions for religious observance
q. Public utility service yard, station,
transmission lines, storage tank, drainage or
communication facilities
S. Large family day care home
u. Residential care facility -- large family home
V. Residential care facility -- group home
(4) Residential Uses
f. Accessory living quarter (guest house without
kitchen)
(5) Other
a. Botanical nursery
j. Changing the activity in a nonconforming
building
k. Swimming pool for non- incidental use
SECTION 10.
This ordinance takes effect 30 days after the date it is
adopted. Within 15 days after this ordinance is adopted, the
Town Clerk shall cause it to be published once in a newspaper of
general circulation published and circulated in the Town.
