Ord 1485 - AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 46 FROM RM:5 -12 AND 0 TO RM:5 -12 -PDORDINANCE NO. 1485 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 46 FROM RM:5 -12 AND 0 TO RM:5 -12 -PD THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: SECTION 1. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property located between West Parr Avenue and Knowles Drive, west of Capri Drive shown on the map which is attached hereto marked Exhibit A and is a part of this ordinance, from RM:5 -12 (Multiple Family Residential, 5 -12 units per net acre) and 0 (Office) to RM:5 -12 -PD (Multiple Family Residential, 5 -12 units per net acre - Planned Development). SECTION 2. The PD (Planned Development Overlay) zone established by this ordinance authorizes the following construction and use of improvements: 1. One hundred and fifteen (115) new and two -story dwelling units to be developed under the Department of Housing and Urban Development Section 8 Program, for low and moderate income families and senior citizens. A total of 77 of these shall be designated to families, while 38 shall be made available to senior citizens, but the 16 one - bedroom units shall be available to senior citizens and non senior citizens on a first come, first served basis. 2. Parking for the family units at a ratio of 1.5 spaces per unit minimum. Parking ratio for the senior citizens units shall be a minimum of .55 spaces per unit. 3. Landscaping, parking and other improvements shown and required on the Official Development Plan. 4. Uses permitted are those specified in the RM (Multiple Family) zone of section 4.32.020 (Permitted Uses) and 4.32.030 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this ordinance, or as they may be amended in the future. However, no use listed in section 4.32.030 is allowed unless specifically authorized by this ordinance, or by conditional use permit. 12/4/80/oh SECTION 3. COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official Development Plan specifically shows otherwise. SECTION 4. Architecture and site approval is required before any grading or construction work is performed, whether or not a permit is required for the work, and before any permit for grading or construction is issued. Grading or construction permits shall only be used in a manner complying with section 4.82.120 of the Zoning Ordinance. SECTION 5. In addition to Exhibit A, the attached Exhibit B (Preliminary Development Plan), Exhibits C -F (Unit Floor Plans), G and H (Architectural Elevations and Typical Sections), I (Conceptual Grading and Drainage), J (Conceptual Utility Plan), and K (Landscape Site Plan) are part of the Official Development Plan. The following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits: 1. The applicant shall dedicate storm drain, sanitary sewer, public utility and emergency vehicle access easements, as required, to the satisfaction of the Town Engineer. 2. The applicant shall guarantee by contract and bond, the following improvements, to the satisfaction of the Town Engineer: a. Interior street and parking areas, including curb, gutter, sidewalks, street lighting and paving. b. On -site utilities, including storm and sanitary sewers and water mains. c. Emergency vehicle access and road including 5- foot -wide concrete sidewalk with 6 foot 6- inches of Grasscrete on either side, bordered by a 6- inch -wide flush concrete band. -2- 3. The applicant shall provide final grading, drainage, traffic circulation, parking, and lighting plans, to the satisfaction of the Town Engineer. 4. A second standpipe shall be added next to the open lawn play field, to the satisfaction of the Central Fire Protection District. 5. The building on the south side of the rose garden shall be sprinklered or provided with approved alternate protection, to the satisfaction of the Central Fire Protection District. 6. All vehicles (with the exception of emergency vehicles) shall be prohibited from the emergency access corridor. 7. All road surfaces shall be capable of sustaining 70,000 pounds loading and shall have a maintained vertical clearance of 15 feet over the entire width of the road. 8. Gates or other obstructions of any kind shall not be built or allowed across any portion of any access road. 9. All trees in proximity of grading and building shall be surrounded by protective fencing prior to construction, to the satisfaction of the Superintendent of Parks and Forestry. 10. Any underground utility lines within th.e extent of th.e root system of the exising large Pepper tree shall he hand- trenched and coordinated with. the Superintendent of Parks and Forestry. 11. Residence in the 38 units of the senior citizen portion of this project shall be restricted to persons who are sixty years of age or older, or married couples living together when at least one spouse is sixty years of age or older. Higher minimum age limits established by private restrictions are permissible. 12. A minimum of 5% of the family units and 10% of the senior citizen units shall be designed for use by the handicapped. -3- 13. The on -site parking shall be reviewed one year after the project has been completed. If it is proven that more parking is needed than was provided for, the setback on Knowles Drive shall be reduced in order to widen Knowles Drive to create a parking lane in front of the property. 14. Thirty -eight units shall be for senior citizens only. The 16 one - bedroom units in the family area shall be available to senior citizens and non senior citizens on a first come, first served basis. 15. The developer shall enter into a development agreement with the Town which would cover a long -term maintenance agreement. 16. Occupancy of the units shall be in accordance with the following preferences: A. Senior citizen occupancy preference (1) FIRST PREFERENCE: Senior citizens who live in the Town of Los Gatos. (2) SECOND PREFERENCE: Senior citizens who have lived in the Town of Los Gatos. (3) THIRD PREFERENCE: All other applicants eligible according to income criteria. B. Family occupancy preference (1) FIRST PREFERENCE: Persons who live and work in the Town of Los Gatos. (2) SECOND PREFERENCE: Single heads of households with dependent children who live in the Town of Los Gatos. (3) THIRD PREFERENCE: Persons who live or work in the Town of Los Gatos. (4) FOURTH PREFERENCE: Persons who have lived in the Town of Los Gatos. (5) FIFTH PREFERENCE: All other applicants eligible according to family size and income criteria. M C. Handicapped occupancy preference (1) Handicapped persons will be given preference over non - handicapped for those units especially designed for the handicapped. SECTION 6. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at an adjourned regular meeting of the Town Council of the Town of Los Gatos on December 2, 1980 and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos on December 15, 1980 AYES: COUNCIL MEMBERS Peter W.
