URGENCY ORDINANCE OF THE TOWN OF LOS GATOS
CHANGING THE MANNER OF SETTING ANIMAL
LICENSING AND CONTROL FEES.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS does ordain as
follows:
SECTION 1.
The portion of section 5 -2 of the Town Code concerning section B4 -41
of the County of Santa Clara Ordinance Code is repealed.
SECTION 2.
Section 5 -2 of the Town Code is amended by adding:
Whenever Division B4 of the County of Santa Clara Ordinance
Code provides that the Board of Supervisors sets fees by
resolution, as to such matters in the Town, the Town Council
sets the fees, also by resolution.
SECTION 3.
This is an urgency ordinance. It takes effect immediately on
adoption. The facts justifying its adoption as an urgency ordinance
are: (1) Practically all safety- and health - related functions of animal
control are performed for the Town by the County of Santa Clara, (2) The
County's animal control activities are funded principally by license and
similar fees, (3) the County's system for collecting and accounting for
the fees necessitates that the fees be uniform in the unincorporated and
incorporated areas, (4) if the fees are not uniform it will be
impractical or unreasonably expensive to collect them, and (5) the County
may have to reduce or withdraw its essential animal control services.
SECTION 4.
The Town Clerk of the Town of Los Gatos shall cause this
ordinance to be published once within 15 days after its adoption in a
newspaper of general circulation published and circulated by the Town.
Adopted as an ordinance of the Town of Los Gatos, California
at a regular meeting of the Town Council, held on March 5, 1979 by the
following vote:
AYES: COUNCIL MEMBERS Ruth Cannon, Thomas J. Ferr to, John B.
Lochner, Peter W. Siemens and Mardi Gualtieri
