AN ORDINANCE AMENDING CHAPTER 16 OF THE TOWN CODE
RELATING TO DESIGNATION OF HOLIDAYS FOR THE
PURPOSE OF TIME LIMIT PARKING
The Town Council of the Town of Los Gatos hereby ordains:
SECTION 1.
Section 16 -1 of the Town Code is hereby amended to read as follows:
Sec. 16 -1 Definitions.
For the purpose of this chapter, the
following words and phrases shall have the
meanings respectively ascribed to them by this
section:
General. Whenever any words or phrases
used in this chapter are not defined herein,
but are defined in the Vehicle Code of the
state, such definitions are incorporated
herein and shall be deemed to apply to such
words and phrases used herein as though set
forth herein in - full.
Bicycle. Every device propelled by
human power upon which any person may ride,
having two tandem wheels either of which is
over twenty inches in diameter, including any
device generally recognized as a bicycle
though equipped with two front or two rear
wheels.
Business District. Any portion of any
street between adjacent cross streets, fifty
percent of which is occupied by buildings in
use for retail or wholesale business, and any
intersection adjacent to such business street
or any intersection, two or more of the
corners of which are so occupied.
Crosswalk. That portion of - the roadway
included within the prolongation of curb and
property lines at street intersections.
Curb. The lateral physical boundary of
the roadway of a street, whether marked by
curbing construction or not so marked.
Driveway. That portion of a street
between a curb ,line and adjacent property line
designed to give vehicular access to the
adjacent property and so constructed as to
support the weight of any motor vehicle.
Holiday.
(a) Every Sunday
(b) New Year's Day (January 1)
(c) Martin Luther King Day Ord Monday of January)
(d) Lincoln's Birthday (February 12)
(e) Washington's Birthday (3rd Monday in February)
(f) Memorial Day (Last Monday of May)
(g) Independence Day (July 4)
(h) Labor Day (First Monday of September)
(i) Admission Day (September 9)
(j) Columbus Day (2nd Monday of October)
(k) Veterans Day (November 11)
(1) Thanksgiving Day (4th Thursday of November)
(m) Christmas Day (December 25)
(n) Every day appointed by the President or Governor
for a public fast, thanksgiving or holiday, which
is also designated as a town holiday by the mayor
through written directive.
Intersection. That area of the roadway
embraced within the prolongation of the
property lines of two or more streets which
join at any angle, whether or not one such
street crosses the other.
Leave standing. To stop a vehicle for
any purpose unless required by traffic
conditions, whether or not the engine is
running and whether or not there is in the
vehicle a person capable of operating the
same.
Limited access highway. Every highway,
street, or roadway in respect to which owners
or occupants of abutting property or lands and
other persons have no legal right of access to
or from the same, except at such points only
and in such manner as may be determined by the
public authority having jurisdiction over such
highway, street or roadway.
Loading zone. The space adjacent to a
curb reserved for exclusive use of the vehicles
during the loading or unloading of passengers or
materials.
Official traffic control devices. All
signs, signals, markings and devices, except
directional signs, not inconsistent with this
chapter or the Vehicle Code of this state,
placed or erected by authority of a public
body or official having jurisdiction, for the
purpose of regulating, warning or guiding
traffic.
Official traffic signals. Any device,
whether manually, electrically or mechanically
operated, by which traffic is alternately
directed to stop and proceed and which is
erected by authority of a public body or
official having jurisdiction.
Operator. Any person who is in actual
physical control of a vehicle.
Park. To stand or leave standing any
vehicle, whether occupied or not, otherwise
than temporarily for the purpose of and while
actually engaged in loading or unloading of
passengers or materials.
Parkway. That portion of a street
other than a roadway or a sidewalk.
Passenger loading zone. The space
adjacent to a curb reserved for the exclusive
use of vehicles during the loading or
unloading of passengers.
Pedestrian. Any person afoot.
Police officer. Every officer and
member of the police department of the town.
Resolution. Resolution of the town
council.
Right of way. The privilege of the
immediate use of the street.
Roadway. That portion of the street
between the physically established curb lines.
Safety zone. That marked portion of
the roadway reserved for the exclusive use of
pedestrians.
Sidewalk. That portion of a street
between the physically established curb lines
and the adjacent property lines.
Stop. When required, complete
cessation of movement.
Stop or stand. When prohibited, any
stopping or standing of a vehicle, whether
occupied or not, except when necessary to
avoid conflict with other traffic or in
compliance with the directions of a police
officer or official traffic control device.
Street. Every way set apart for public
travel, except alleyways, bridle paths and
foot paths.
Traffic. Pedestrians, ridden or herded
animals, vehicles, bicycles and other
conveyances, either singly or together, while
using any street for purposes of travel.
Vehicle. Every device, regardless of
motive power, or animal, by which any person
or property is or may be transported or drawn
upon a street, including devices used
exclusively upon rails.
SECTION 2.
This ordinance takes effect 30 days after the date it is adopted.
Within fifteen (15) days after this ordinance is adopted, the Town Clerk shall
cause it to be published once in a newspaper of general circulation published
and circulated in the Town.
This ordinance was introduced at a regular meeting of the Town Council
held on the 1 day of February , 1988 and,
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 16 day of February , 1988
by the following vote.
