AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING
ARTICLE III OF CHAPTER 25 OF THE TOWN CODE RELATING
TO NON- LIABILITY FOR SEWER OVERFLOW WHERE BACK WATER
VALVE NOT INSTALLED AND OPERATIONAL
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY ORDAIN:
SECTION 1
Section 25 -24 is hereby enacted and added to Article III of Chapter 25 of
the Town Code and to read as follows:
Section 25 -24 Non- liability for failure to install operation back
The Town shall not incur any liability or responsibility for damage
resulting from a sewer overflow where the property owner or other person
has failed to install a back water valve, as defined Section 103(e) of
the Uniform Plumbing Code, and maintain said device in a functional
operating condition.
SECTION 2
This ordinance takes effect 30 days after it is adopted. Within 15 days
after this ordinance is adopted the Town Clerk shall cause it to be published
once in a newspaper of general circulation published and circulated in the
Town.
This ordinance was introduced at a regular meeting of the Town
Council of the Town of Los Gatos on November 21 1988 and adopted by the
following vote as an ordinance of the Town of Los Gatos at a regular
meeting of the Town Council of the Town of Los Gatos on D ecember 5 1988•

Section 103 —B—
(a) Backflow— Backflow is the flow of water or other liquids, mix -
tures or substances into the distributing pipes of a potable supply of
water from any sources other than its intended source. (See Back-
Siphonage.)
(b) Backflow Connection — Backflow connection or condition is
any arrangement whereby backflow can occur.
(c) Backflow Preventer —A backflow preventer is a device or
means to prevent Backflow into the potable water system.
(d) Back- Siphonage— Back - siphonage is the flowing back of used,
contaminated, or polluted water from a plumbing fixture or vessel in-
to a water supply pipe due to a negative pressure in such pipe. (See
Backflow.)
(e) Backwater Valve —A backwater valve is a device installed in a
drainage system to prevent reverse flow.
(f) Boiler Blow•off —A boiler blow -off is an outlet on a boiler to per-
mit emptying or discharge of sediment.
(g) Branch —A branch is any part of the piping system other than a
main, riser, or stack.
(h) Branch, Fixture —See Fixture Branch.
(i) Branch, Horizontal —See Horizontal Branch.
(j) Branch Vent —A branch vent is a vent connecting one or more
individual vents with a vent stack or stack vent.
(k) Brazed Joint —A brazed joint is any joint obtained by joining of
metal parts with alloys which melt at temperatures higher than 800 °F
(427 °C), but lower than the melting temperature of the parts to be
joined.
(1) Building —A building is a structure built, erected, and framed of
component structural parts designed for the housing, shelter,
enclosure, or support of persons, animals, or property of any kind.
(m) Building Drain —The building drain is that part of the lowest
piping of a drainage system which receives the discharge from soil,
waste and other drainage pipes inside the walls of the building and
conveys it to the building sewer beginning two (2) feet (.6m) outside
the building wall.
(n) Building Sewer —The building sewer is that part of the horizon-
tal piping of a drainage system which extends from the end of the
building drain and which receives the discharge of the building drain
and conveys it to a public sewer, private sewer, individual sewage
disposal system or other point of disposal.
(o) Building Supply —The building supply is the pipe carrying
potable water from the water meter or other source of water supply to
a building or other point of use or distribution on the lot. Building sup-
ply shall also mean water service.

(a) Cesspool —A cesspool is a lined excavation in the ground
which receives the discharge of a drainage system or part thereof, so
designed as to retain the organic matter and solids discharging
