AUTHORIZE THE TOWN MANAGER TO AMEND THE CONSTRUCTION
AGREEMENT WITH BOGARD CONSTRUCTION IN THE AMOUNT OF $9,999.74.
RECOMMENDATION:
Authorize the Town Manager to amend the construction agreement with Bogard Construction in the
amount of $9,999.74.
BACKGROUND:
As a component of the Library Project, several site improvements were recognized as needed for the
civic center complex. One of the sites identified for improvement was the replacement of the current
siding on the Los Gatos -Saratoga Adult Recreation Center. The building siding is approximately 30
years old, and due to sun and weather exposure over the years, is now in need of replacement. In
addition, this building has experienced leaks from the siding area over the last several years due to
deterioration of the water- proofing material underneath the siding. This project is addressing both the
exterior appearance of this building located directly adjacent to the new library, as well as the water
intrusion issues associated with leaks during the storm season.
In July 2011, the Town Manager was authorized to execute a construction agreement with Bogard
Construction in an amount not to exceed $50,962. Additionally, staff was authorized to execute future
change orders to the construction contract, as necessary, in an amount not to exceed $5,000. During the
work, unforeseen conditions were exposed, comprised primarily of wood rot affecting several areas
discovered during siding and door replacement.

DISCUSSION:
Prior to the discovery of wood rot, the original contingency amount of $5,000 was used to mitigate
additional structural defects discovered during the project. It has become necessary to address these
additional areas of structural damage before the conclusion of the project to ensure a successful
outcome.
CONCLUSION:
It is recommended that the Town Council authorize the Town Manager to amend the construction
agreement with Bogard Construction in the amount of $9,999.74 to accommodate the mitigation of the
structural defects found in the building during the project. The amended total contract amount is
$65,961.74
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice of
Exemption will not be filed.
FISCAL IMPACT:
Sufficient funds are available for this amendment as shown in the table below.
