ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING ORDINANCES 1876 AND 1933 GOVERNING THE
DOWNTOWN LOS GATOS BUSINESS IMPROVEMENT DISTRICT
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS AS
FOLLOWS:
SECTION I
Pursuant to the Parking and Business Improvement Area Law of 1989, Sections 36500
and following of the California Streets & Highways Code ( "Act "), the Town Council adopted
Resolution No. 1993 -168 indicating the Council's intent to consider modifications to the
boundaries of benefit zones within the Downtown Business Improvement District, the basis
of the assessments, and to levy the assessments for 1994. Notice of this resolution and the
Council's intent was given by both publication and mailing pursuant to the Act (Streets &
Highways Code § 36523) and Government Code § 54954.6.
SECTION II
Section 1.055 of Ordinance 1876, as amended by Ordinance No. 1933, is amended to
read as follows:
Section 1.055 - Annual Assessment Process
After approval of the annual report, the Town Council may adopt a resolution of
intention to levy an assessment for that fiscal year, consistent with the requirements of
the Act. In its discretion, the Council may decide not to levy assessments pursuant to
this ordinance and may decide to suspend the levy of assessments indefinitely as the
Council determines is appropriate.
SECTION III
If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason,
held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect
the validity or constitutionality of the remaining portions of this ordinance, it being expressly
declared that this ordinance and each section, subsection, clause and phrase hereof would
have been prepared, proposed, adopted, approved and ratified irrespective of the fact that
any one or more other sections, subsections, sentences, clauses, or phrases be declared
invalid or unconstitutional.
SECTION IV
This ordinance takes effect 30 days after it is adopted. Within 15 days after this
ordinance is adopted, the Town Clerk shall cause a summary to be published once in a
newspaper of general circulation published and circulated in the Town.
This ordinance was introduced at a regular meeting of the Town Council of the Town
of Los Gatos on February 7, 1994 and adopted by the following vote as an ordinance of the
Town of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos
on February 22, 1994.
