ORDINANCE OF THE TOWN OF LOS GATOS AMENDING
SECTIONS 2.40.010, 2.40.015, AND 2.40.020 OF THE TOWN CODE
TO ESTABLISH COUNCIL AUTHORITY TO REQUIRE RESIDENCY
IN TOWN FOR MEMBERS OF TOWN BOARDS AND COMMISSIONS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION I
Sections 2.40.010, 2.40.015, and 2.40.020 of the Town Code are amended to read as follows:
Sec. 2.40.010. Definition.
"Permanent Town boards and commissions" are those bodies which are established by
ordinance or resolution, whose members are appointed by the Town Council, and which are expected
to exist for more than one year.
Sec. 2.40.015. Residence requirement.
The Town Council may provide that residence in the Town is a requirement for membership
on a Town board or commission.
Sec. 2.40.020. Failure to meet qualifications and vacancies.
If a member of a board or a commission for which residency in the Town is a requirement
ceases to be a resident of the Town, the member's office shall become automatically vacant. With
respect to appointment and tenure of replacements, and in all other matters, the vacancy will be
treated like any other on that board or commission.
SECTION II
This ordinance was introduced at a regular meeting of the Town Council of the Town of Los
Gatos on March 20, 1995 and adopted by the following vote as an ordinance of the Town
of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos on April 17, 1995.
This Ordinance takes effect 30 days after it is adopted.
