URGENCY ORDINANCE OF THE TOWN OF LOS GATOS
AFFIRMING FINDINGS OF LOCAL NECESSITY TO REGULATE ROOFING
MATERIALS AND INSTALLATIONS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
SECTION I
After extensive study and duly notice public hearings by the Town in 1992 and
1993 and following the Oakland Firestorm, the Town Council enacted Sections 6.30.030
and 9.30.130 of the Town Code to require the installation of certain types of roofing
materials in hazardous fire areas and regulating installation of roof tiles over wood
roofing material. The enacting ordinance did not clearly specify the findings required by
the State of California for amendments to the Uniform Codes adopted by the State,
although those findings had been delineated in the materials considered. Therefore, in
order to ensure that the significant advance in fire safety and community welfare that
these Code Sections brought to the Town are sustained and roofing installations continue
to conform to these important requirements, the Town Council adopts this ordinance as
an urgency measure in that continuing the requirements established by Ordinance 1931 is
vital to preserving the community's health and safety because:
A. The requirement of certain types of roofing materials and installations
diminishes the likelihood of firestorms as suffered by Los Angeles, Orange, and Alameda
Counties in the past 3 years.
B. Allowing a lapse in this requirement would needlessly expose innocent
purchasers, neighbors, and citizens to fire dangers that can be easily reduced by proper
installation of proper roofing materials.
C. The current drought in the area has caused one of the most serious fire
seasons in memory to arise.
SECTION II
The adoption of Ordinance No. 1931 which enacted Sections 6.30.030 and
9.30.130 is hereby reaffirmed with the following findings:
The requirement of certain roofing systems and materials and the regulation of
the installation of roofing tiles over existing wood roofing is necessary in Los Gatos
because Los Gatos contains an unusual number of high fire hazard areas, with limited
and restricted access routes that are often without dual access, restricted and substandard
water service systems, extreme fire loads from natural vegetation, extremely rugged and
hilly terrain, canyons and ravines where fire can smoulder undetected for a long period
of time, and difficult response time and access by fire suppression personnel and
equipment. In addition, a fire of even limited extent could quickly endanger the historic,
central downtown area because of the close proximity of the high fire hazard areas to the
Town's core.
SECTION III
This ordinance was introduced and adopted at a regular meeting of the Town
Council of the Town of Los Gatos on August 1, 1994 and takes effect immediately as an
urgency ordinance.
