APN 529-07-099. RECOMMENDATION: It is recommended that the Town Council: 1. Make the required findings (Attachment 1) and approve Conditional Use Permit U-11-003 (motion required); and 2. Adopt resolution approving a request to increase seating, establish outdoor seating, and modify hours of operation for an existing wine establishment (Enoteca La Storia) on property zoned C-1 (Attachment 2) (motion required). BACKGROUND: In 2008, the Town granted approval for exterior modifications to Los Gatos Shopping Center at 404 through 440 N. Santa Cruz Avenue. The modifications included an outdoor patio area. In 2009, the Town Council approved a retail wine establishment with food, beer, and wine service at 414 & 416 N. Santa Cruz Avenue (now addressed as 416 N. Santa Cruz Avenue). Staff analyzed the proposed Conditional Use Permit (CUP) modification against the Town's Alcoholic Beverage Policy (ABP) and the Town's standards for outdoor seating. DISCUSSION: A. Project Summary The applicant is requesting approval of a Conditional Use Permit (CUP) modification to allow outdoor seating in an existing outdoor patio area and expand the hours of operation. Please see Attachment 8 for additional information regarding the project. B. Planting Commission On June 22, 2011, the Planning Commission considered the subject application (see Attachment 8). See Attachment 6 for the Commission's full discussion. PAGE 3 MAYOR AND TOWN COUNCIL SUBJECT: 416 N. Santa Cruz Avenue/U-11-003 July 25, 2011 The Planning Commission recommended approval of the CUP with a modified condition to limit the number outdoor seats to 12 and the number of indoor seats to 16. The modified condition is included with Attachments 2 and 5. The seating condition recommended by staff established a maximum number of seats without specifying how many seats are allowed indoors or outdoors. This would allow the applicant the flexibility to move seats indoors when the weather is not conducive to outdoor seating. The Planning Commission recommended the modified condition because the application did not include information showing that 12 additional seats could fit inside. Staff is working with the applicant to provide this information at the Town Council meeting. PUBLIC COMMENTS: The Town received public comments contained in Attachments 7, 8, and 9. CONCLUSION: The project would allow an existing establishment to provide outdoor seating. The proposed modifications meet the requirements of the Town's Alcoholic Beverage Policy and the Standards for Outdoor Seating. The Planning Commission recommended approval of the application subject to the modified condition as discussed above. ENVIRONMENTAL ASSESSMENT: The project is Categorically Exempt according to Section 15061 of the State Environmental Guidelines as adopted by the Town because the project consists of permitting an activity where it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. APN: 529-07-099 CONDITIONAL USE PERMIT APPLICATION: U-11-003 PROPERTY LOCATION: 416 N. SANTA CRUZ AVENUE PROPERTY OWNER: LOS GATOS SHOPPING CENTER LLC. APPLICANT: MICHAEL GUERRA & JOSEPH CANNISTRACI. WHEREAS: A. This matter came before the Town Council for public hearing on May 11, 2011, and was regularly noticed in conformance with State and Town law. B. The applicant seeks approve for a Conditional Use Permit (CUP) modification to increase seating, establish outdoor seating, and modify hours of operation for an existing wine establishment (Enoteca La Storia) on property zoned C-1. The applicant is requesting 28 seats and hours of operation of Monday through Wednesday, 10:00 a.m.` to 11:00 p.m; Thursday through Saturday, 10:00 a.m. to 12:00 a.m.; Sunday, 12:00 p.m. to 10:00 p.m. C. On June 22, 2011, the Planning Commission considered the request for a Conditional Use Permit (CUP) to increase seating, establish outdoor seating, and modify hours of operation for an existing wine establishment (Enoteca La Storia) on property zoned C-1. The Planning Commission recommended approval of the request with one modified condition of approval. D. The Town's Alcohol Beverage Policy requires any new application for the service of alcoholic beverages to be approved by Council. Town Council reviews CUP requests for a new application for alcohol service on a case -by -case basis to ensure that the request is appropriate ATTACHMENT 2 for the specific use and its location. E. The Town's Alcoholic Beverage Policy gives the hearing body discretion to approve alcoholic beverage service on a case -by -case basis when the proposal will not negatively impact residential neighbors, alcohol related incidents will not occur, and when the application will provide a positive impact to the commercial area. F. Town Council received testimony and documentary evidence from the applicant and all interested persons who wished to testify or submit documents. Town Council considered all testimony and materials submitted, including the record of the Planning Commission proceedings and the packet of material contained in the Council Agenda Report dated July 5, 2011, along with any and all subsequent reports and materials prepared concerning this application. G. Council finds as follows: 1. Pursuant to Town Code section 29.20.190, the request for a CUP is desirable to the public convenience; will not impair the integrity and character of the zone; would not be detrimental to public health, safety or general welfare; and is in harmony with the various elements or objectives of the General Plan and the purposes of the Town Code. This finding is based on the evidence presented in the Council. Agenda Report dated July 5, 2011, and incorporates the findings made by the Planning Commission on June 22, 2011, regarding this application. 2. The project is categorically exempt from environmental review pursuant to Section 15061 of the State Environmental Guidelines as adopted by the Town. 3. The proposed use is consistent with the Redevelopment Plan for the Central Los Gatos Redevelopment Project Area (section IV.B), as evidenced by the findings made by the Planning Commission on June 22, 2011. RESOLVED: 1. The CUP application U-11-003 to increase seating, establish outdoor seating, and modify hours of operation for an existing wine establishment (Bnoteca La Storia) on property zoned C-1 is granted. 2. The Conditions of Approval attached hereto as Exhibit A are hereby adopted as the Conditions of Approval for modification of this permit. 3. The decision constitutes a final administrative decision pursuant to Code of Civil Procedure section 1094.6 as adopted by section 1.10.085 of the Town Code of the Town of Los Gatos. Any application for judicial relief from this decision must be sought within the time limits and pursuant to the procedures established by Code of Civil Procedure section 1094.6, or such shorter time as required by State and Federal Law. APPROVAL. This application shall be completed in accordance with all of the conditions of approval listed below. Any changes or modifications shall be approved by the Community Development Director, the Development Review Committee, the Planning Commission, or Town Council, depending on the scope of the changes. 2. EXPIRATION. The approval will expire two years from the approval date pursuant to Section 29.20.320 of the Town Code, unless the approval has been vested. 3. APPROVED USE. The subject approval is for a retail wine establishment with food, beer, and wine service as generally described in the applicant's letter of justification (Exhibit A.1). 4. HOURS OF OPERATION. Maximum hours of operation shall be Monday through Wednesday, 10:00 a.m. to 11:00 p.m.; Thursday through Saturday, 10:00 a.m. to 12:00 a.m.; and Sunday, 12:00 p.m. to 10:00 p.m. 5. HOURS OF ALCOHOLIC BEVERAGE SERVICE. The service of alcoholic beverages shall not be permitted after 10:00 p.m., Monday through Wednesday; after 11:00 p.m., Thursday through Saturday; and after 9:00 p.m. on Sunday. 6. NUMBER OF SEATS. The maximum number of seats is 12 indoors and 16 outdoors. Note: The maximum number of seats is not in addition to the maximum number of individuals on -site limited during specials events (see EVENTS condition). 7. OUTDOOR SEATING. Patrons using outdoor seating must be seated by a restaurant employee. Prior to the use of outdoor seating, a sign shall be posted that no alcoholic beverages are allowed beyond the patio area. 8. EVENTS. Tasting events and/or classes exceeding eight (8) attendees shall be limited to four (4) per month. During tasting events and/or classes, the maximum number of attendees shall be limited to 25. The maximum number of individuals on site at any given time shall be 30, inclusive of employees, instructors, or presenters (based on ten (10) allotted parking spaces). Note: The maximum number of individuals is not in addition to the maximum seating of 28. 9. ENTERTAINMENT. Live entertainment and amplified music is prohibited. 10. SIGN PERMIT. A Sign Permit from the Community Development Department is required for any new sign or any change of face of an existing sign. 11. ALCOHOLIC BEVERAGE POLICY. The applicant shall be subject to comply with any new requirements in the Town's Alcoholic Beverage Policy within six (6) months from the date of the change in policy. Exhibit A of A.ttachment.2 12. TOWN INDEMNITY. Applicants are notified that Town Code Section 1.10.115 requires that any applicant who receives a permit or entitlement from the Town shall defend, indemnify, and hold harmless the Town and its officials in any action brought by a third party to overturn, set aside, or void the permit or entitlement. This requirement is a condition of approval of all such permits and entitlements whether or not expressly set forth in the approval, and may be secured to the satisfaction of the Town Attorney. UNIFORMED SECURITY: Uniformed privately provided security guards may be required in or around the premises by the Chief of Police if alcohol related problems recur that are not resolved by the licensed owner. 14. We will provide a selection of fine wines, available both by the glass (on -premise) and for retail purchase (off -premise) in combination with a selection of wine -related small plates to be enjoyed on -site. In keeping with our goal of creating a culture of passionate, informed and responsible wine and food enjoyment, we will provide a separate room, off the main retail space, to be used for private, intimate events such as hosted tastings, corporate meetings, private tastings, and wine education classes. We intend to conduct hosted wine tastings and wine education classes on a regular basis in order to increase our customer's knowledge and appreciation of fine wines and specialty foods. We also intend to capitalize on popular and powerful media, specifically our website, to expand our presence beyond local boundaries and increase our customer base by offering on-line wine courses, video - based wine commentaries and interviews, blogs and other content. Due to the increased popularity of wine and food related television programming and associated books, the interested consumer also has an eye toward broadening his/her experience, expanding his/her knowledge, becoming educated about wine & food pairing, and fostering healthy and responsible consumption in a casual, friendly setting. The Boot will provide both products and services that will directly tap into these expanding areas of demand and create a unique, innovative and authentic business based on these principles in order to help support our retail operation. (as outlined above) and the purposes of the Town Ordinance. • BIOGRAPHIES OF BUSINESS PRLNIPALS: Joseph Cannistraei Joe's initial work background was in the trades as a Journeyman Plasterer. Before joining the trade union, he was an Apprentice Machinist at the Defrancisi Machine Corporation, a renowned manufacturer of commercial pasta machines from.1990 to 1991. Prior to developinghis passion for wine, Joe expanded his entrepreneurial pursuits and was a key founding owner of Coastal Sol,Foods,. an energy bar company, which he shepherded from conception to product launch. He did product research and development, worked closely with a consultant to create a business plan, recruited outside co -investors, and was responsible for all aspects of product development, including formulations and branding. Joe began his career in the wine industry by working at a South Bay wine retailer, which was one of the largest in the US. Joe immediately demonstrated a special knack for developing both customer and business relationships, as well as an aptitude for absorbing and utilizing a vast amount of wine knowledge. Within his first year, he was promoted to Assistant Manager and made the Italian Wine Buyer. HOURS OF ALCOHOLIC BEVERAGE SERVICE. The service of alcoholic beverages shall not be permitted after 10:00 p.m., Monday through Wednesday; after 11:00 p.m., Thursday through Saturday; and after 9:00 p.m. on Sunday. 6. NUMBER OF SEATS. The maximum number of seats is 12 indoors and 16 outdoors. Note: The maximum number of seats is not in addition to the maximum number of individuals on -site limited during specials events (see EVENTS condition). 7. OUTDOOR SEATING. Patrons using outdoor seating must be seated by a restaurant employee. Prior to the use of outdoor seating, a sign shall be posted that no alcoholic beverages are allowed beyond the patio area. 8. EVENTS. Tasting events and/or classes exceeding eight (8) attendees shall be limited to four (4) per month. During tasting events and/or classes, the maximum number of attendees shall be limited to 25. TOWN INDEMNITY. Therefore, as proposed and conditioned, the project would meet the limitations of the ABP. The deciding body must make specific findings for the service of alcoholic beverages after 10:00 pm. The Town has not received any complaints for Enoteca La Storia. The business remains in good standing and would continue to provide the community with an established, successful wine establishment. B. Outdoor Seating The applicant proposes to use an existing outdoor patio area for 12 outdoor seats. The patio area is located on private property within the shopping center. The patio separates the subject business from the parking lot; a common walkway separates the subject business from the patio. The patio is located approximately 130 feet from the public right-of-way. The Town has five standards for outdoor seating: 1. Outdoor seating is prohibited on public property. Outdoor seating may be allowed on private property with a Conditional Use Permit 2. A physical delineation in the form of landscaping or planters is required to separate public and private property. The height of the separation shall be a minimum of three feet but no higher than_ four feet. The physical design and plant material should complement the design of the building and prevent passing or carrying alcoholic beverages outside the restaurant seating area. Plant material shall be alive. 3. When alcoholic beverages are peiiiiitted in outdoor seating areas that are immediately adjacent to a public pedestrian way, the landscape separation shall be designed to clearly suggest that alcohol is not allowed outside the restaurant seating area. 4. For outdoor seating areas immediately adjacent to the public right-of-way, a hold harmless agreement shall be recorded releasing the Town from any liability related to the outdoor seating. 5. When alcoholic beverage service is permitted outside, a restaurant employee shall seat patrons. The applicant submitted explanation for the outdoor seating design (Exhibit 6). The explanation includes a description of the outdoor patio separation from the common areas and public right-of-way. The explanation also includes a description of the use of a host/hostess to seat the patrons of the outdoor seating area. In addition to meeting the standards for outdoor seating, the applicants would post signage that alcoholic beverages are not permitted beyond the patio area. C. Parking and Traffic The previously approved use required ten parking spaces based on the most intensive portion of the use — the special events (Exhibit 4). One parking space was required for every three attendees. The maximum number of individuals on site at any given time is limited to 30. This allows a 25 person maximum for attendees and a five person maximum for employees, instructors, and/or presenters. Based on this existing allotment, the proposed 28 seats would meet parking requirements. The condition that limits the number of individuals on site for events based on the parking space allotment is carried forward for the subject application. Additionally, the condition limiting the number of seats notes that the maximum number of seats is not in addition to the number of event attendees, The increase in seating will not increase required parking. The traffic impacts of proposed use are calculated using shopping center trip generation rates. Based on the shopping center trip generation rates, there will be no increase in traffic impacts. D. Police Department Comments The Police Department reviewed the proposal and has no comments. E. Conditional Use Permit Findings In order to grant approval of a Conditional Use Permit, the deciding body must make the following findings: (1) The proposed uses of the property are essential or desirable to the public convenience or welfare; and (2) The proposed uses will not impair the integrity and character of the zone; and (3) The proposed uses would not be detrimental to public health, safety or general welfare; and (4) The proposed uses of the property are in harmony with the various elements or objectives of the General Plan and the purposes of the Town Code. Redevelopment Plan for the Central Los Gatos Redevelopment Project Area The Redevelopment Plan contains a Redevelopment Land Use Map'' ---that ,designates proposed land uses to be permitted in the Central Los Gatos Redevelopment Project Area. The subject property is designated commercial and, per the Redevelopment Plan, shall be used for the general commercial uses set forth and described in the Town's General Plan. The proposed use falls under general commercial uses. PUBLIC COMMENTS: The Town received multiple public comments in support of the project (Exhibit 8). SUMMARY AND RECOMMENDATION: A. Summary The project would allow an existing establishment to provide outdoor seating. Friday and Saturday nights). Most nights it terminates at 9:00 PM Explanation of Design Elements and Monitoring of Alcoholic Beverage Service In compliance with the Town's Policy re: Outdoor Service and as shown in drawing of patio design, there will be a host/hostess stand located near the entrance of the patio. The host/hostess will not only seat customers, but monitor customer activity and enforce all applicable company, Town, and ABC rules, regulations and laws. In addition, as further depicted in the drawing, we intend to use large flowerpots and existing columns to decrease the one and only open side of the patio from 32 feet down to 19.42 feet, effectively decreasing the opening by almost 50%, making it easier to regulate egress and ingress and provide clearer delineation between public walkway and the private patio space. We will also provide signage stipulating that alcoholic beverages are not permitted beyond the patio boundaries. Furthermore, it should be noted that our patio area is defined on two of three sides by solid, permanent structures (the stone wall and wrought iron railing) as delineated on the submitted drawing, rather than simple planter boxes or other portable and/or non -continuous objects that can be easily traversed; again, making this particular setting unique from most others in town. We also ask that you take into consideration that our patio space is separated from the nearest public right away (i.e., sidewalk) by approximately 300 feet and located on private property, making it much lesslikelythat a casual passerby will inadvertently enter the premises or that customers will exit the delineated area with alcoholic beverages in their possession. This additional attribute also makes our patio space much different than most others in town in which the outdoor seating area is directly adjacent to public space. We are confident that all these unique factors will make it easier for us to enforce and monitor effective and problem -free alcoholic beverage service on the outdoor patio. Our first year of business has flown by! Our landlord is enthusiastically working to complete construction as soon as possible. The only "obstacle" to overcome now is to get approval from the Town - both from the Planning Commission and the Town Council. We don't foresee any problems with the approval process — other than getting on the agendas of these busy groups. At this point, we are "tentatively" scheduled on the June 22nd meeting agenda for the Planning Commission (though we may get "bumped" to a later date). If all goes well and we get approved, we must then wait to be scheduled on the Town Council agenda, which will take place in July (at the earliest). Unfortunately, what this means is that — without an expedited meeting — our patio won't be approved for use until AFTER Summer, sometime in August - or worse — September (post the Town Council's August break). Would that we could speed up the. process... (and no, you can't bring out your own chairs and glasses in the meantime...) Here's where you can help us — if you are a Los Gatos resident and have any plans to make use of this beautiful space — or are simply in favor of the project - we ask that you contact the representatives of the Town and let them know that you are in support them giving us their approval to open the new ELS patio. What has been fun more recently is to see its popularity grow among neighboring communities, whose residents recognize a gathering place both stylish and different, yet somehow Los Gatos in feel. Just the night before last, my friend from Saratoga emailed me mid day to say 'Y keep hearing about a great wine place on N. Santa Cruz... Can we meet there tonight!" We were happy to see that Enoteca plans to extend and provide outdoor seating with food and wine/beer service on the new patio located in front of their existing establishment. Such an additioin would only enhance the ambiance in Los Gatos and be a positive upgrade for all of us. The backdrop of outdoor dining elicits thoughts of old -European villages, and is new and different. It would be appreciated not only by those dining, but those traveling by, as well, adding to the charm we know to be Los Gatos. I encourage you to take steps to make this happen THIS summer 2011.
