AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF JONES BROTHERS ENTERPRISES INC. AND AUTHORIZE
RECORDING BY THE CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Jones Brothers Enterprises Inc. and authorize recording by the Clerk
Administrator.
BACKGROUND:
The adopted FY 2010/11 — 2014/15 Capital Improvement Program Budget designates funding
for roadway improvement projects for the community and is consistent with the Town's goals to
improve public safety and to maintain quality infrastructure. Providing a functional and safe
bridge on Roberts Road is an important part of the Town's roadway system and contributes to
the efficient flow of vehicle, bicycle, and pedestrian traffic throughout Town.
This project provided for the construction of a new single span bridge on Roberts Road across
Los Gatos Creek. Failing retaining walls were also replaced on both sides of Roberts Road from
the bridge west to Brickway Court and Roberts Road was reconstructed from the new bridge to
Brickway Court. Custom aesthetic treatments were applied on the bridge abutment walls to
incorporate the natural setting of the creekside location into the new structure. Additionally, new
curbs, gutters, crosswalks, and sidewalks were constructed along the south side of Roberts Road.
The Los Gatos Creek Trail was also reconstructed in the vicinity of the new bridge to improve
sight lines and visibility for all trail users.

DISCUSSION:
On December 21, 2009, the Town Council awarded the contract for this project to Jones Brothers
Enterprises Inc. The contracted work has been satisfactorily completed by Jones Brothers
Enterprises Inc. and is being recommended for acceptance by the Parks and Public Works
Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and/or replacement caused by defective materials and worlananship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Jones Brothers Enterprises Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
The original contract for Jones Brothers Enterprises Inc. approved by Council was in the amount
of $2,075,429, with a contingency budget of $300,000 for a total. budget of $2,375,429. This
construction contract was completed for $2,262,209. The fiscal table below deinonstrates that
the project was completed within the approved budget.
