PARTICIPATION IN THE BAY AREA -WIDE TRASH CAPTURE
DEMONSTRATION PROJECT
RECOMMENDATION:
Authorize the Town Manager to execute an agreement with the Association of Bay Area
Governments for participation in the Bay Area -wide Trash Capture Demonstration Project
BACKGROUND:
The California Regional Water Quality Control Board adopted a new Municipal Regional
Stormwater Permit (MRP) in October 2009, establishing requirements for National Pollution
Discharge Elimination System (NPDES) for Bay Area counties. Provision C.10 of this permit
requires municipalities to install and maintain a minimum number of full trash capture devices
by July 1, 2014, to treat an area equivalent to 30% of the Retail/Wholesale (commercial) land
that drains to the municipal storm drain system. For Los Gatos, 49 acres must be retrofitted with
full capture devices to meet permit requirements. Full trash capture devices are intended to
capture trash in the storm drain system and prevent it from being discharged into the creeks and
San Francisco Bay.
DISCUSSION:
The San Francisco Estuary Partnership (SFEP) was awarded $5 million in federal stimulus funds
through the American Recovery and Reinvestment Act (ARRA) to support the Bay Area -wide
Trash Capture Demonstration Project. The funds are bein distributed to Bay Area cities

according to a formula based on population and permit requirements. The purpose of the project
is to allow cities to test different types of full trash capture devices and assist in compliance with
new MRP requirements. The project is managed by SFEP staff under the sponsorship of the
Association of Bay Area Governments (ABAG).
It is estimated that 18-22 full trash capture devices will be necessary to provide coverage for the
Town's 49 acres of commercial development. ABAG has allocated $33,225 for installation of
up to 22 trash capture devices, based on the estimated installed cost of $1,500 each. Parks and
Public Works staff is working with the SFEP on the specific locations where the trash capture
devices will be installed.
Through this agreement, the purchase of the trash capture devices will be paid for through the
grant. The Town, however, will be responsible for the ongoing maintenance of the trash capture
devices. It is currently estimated that each trash capture device will require maintenance and
cleaning two to three tunes per year. Inspection and maintenance will be shared between the
Town and the West Valley Sanitation District through an agreement with the West Valley Clean
Water Program. While West Valley Sanitation will perform the majority of inspection related to
the monitoring of the devices, the Town will be responsible for the cleaning and debris removal.
This work will be performed by staff funded through the Town's Non -Point Source Program.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute an agreement
with the Association of Bay Area Governments for the Bay Area -wide Trash Capture
Demonstration Project.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA, but is Categorically Exempt (Section 15301c). A
Notice of Exemption will not be filed.
FISCAL IMPACT:
The cost of purchase and installation of the devices will be fully funded through the ABAG
sponsored program and no matching local funds are required.
