MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY/REDEVELOPMENT
AGENCY MEETING NOVEMBER 1, 2010
The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday,
November 1, 2010 at 7:00 P.M.

MEETING CALLED TO ORDER
ROLL CALL
Present: Mayor Diane McNutt, Vice Mayor Joe Pirzynski, Councilmember Steve
Rice, Councilmember Barbara Spector, and Councilmember Mike Wasserman.
Absent: None.
PLEDGE OF ALLEGIANCE
Morgan Polhemaus, Daves Avenue Elementary school led the Pledge of
Allegiance. The audience was invited to participate.
PRESENTATIONS
Proclamation - Pancreatic Cancer Awareness Month, Diane Borrison, Pancreatic
Cancer Action Network
Mayor Diane McNutt proclaimed October, 2010 as Pancreatic Awareness
Month and Diane Borrison, Pancreatic Cancer Action Network accepted the
proclamation on behalf of her organization.
Announcement - Helen Putnam Award - Town of Los Gatos Youth Commission
Rebecca Elliott, representing the League of California Cities, presented the
Helen Putnam award to the Town of Los Gatos for its "Youth Friendly Business"
program initiated by the Youth Commission.
Nicky Robinson, Chair of the Youth Commission, commented on the Youth
Friendly Business program and thanked the Chamber of Commerce, Police
Department, and the community for their support. Youth Commissioners Nicky
Robinson, Chair, Ben Baranovsky, Vice Chair, Rodd Farhadi, Erin Hughes,
Killian Jackson, James Marino, and Warren Nakazawa were also in
attendance.

Michael Martello stated that direction was given and that no reportable action was
taken.
CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
(Government Code Section 54956.9[b][1])
One Potential Case: Involving Los Gatos Bar and Grill
Michael Martello stated that the Closed Session item regarding an anticipated litigation
was not concluded. At the close of the public agenda, Council would reconvene in the
Town Council Chambers to complete the Closed Session item. At the conclusion of the
Closed Session the Council would adjourn the meeting in public session. No further
announcements were anticipated.

COUNCIL/TOWN MANAGER REPORTS
Council Matters
Mayor Diane McNutt
Commented that P.G. & E. will be hosting a Smart Meter Answer Center on
Thursday, November 4, 2010 at the Adult Recreation Center from 4:00 - 7:00
P.M.
Vice Mayor Joe Pirzynski
Commented that the outcome of the Association of Bay Area Government’s
Economic Session was that the nine bay area counties were still in a recession
and that Silicon Valley will continue to be in a recession until the first quarter of
2014.

Manager Matters
Mr. Larson
Commented that the Town Clerk’s Department will be accepting ballots until 5:00
p.m. on November 2, 2010.
Commented that on Tuesday, November 9, 2010, the Town of Los Gatos Parks
and Public Works Department will be holding the first community meeting for
design input on the new Los Gatos Creekside Sports Park.
Commented that the Town's Annual Report will be distributed to residents and
businesses in the next two weeks.
Did You Know?
Ms. Douglas, Los Gatos-Saratoga Recreation, Senior Services Coordinator
Commented about the Los Gatos-Saratoga Recreation Department’s senior
recreation programs & senior services to Los Gatos residents 55+.
Commented that the Senior Thanksgiving Luncheon will be held on November
20, 2010.
Commented that more information can be found at www.lgsrecreation.org or by
calling 408-354-8700.
CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION)
1. Adopt a resolution authorizing the Town Manager to execute the second
amendment to Grant Agreement by and between the Town of Los Gatos and a
Place for Teens and Los Gatos-Saratoga Community Education and Recreation
2009-2012. RESOLUTION 2010-099
2. Adopt a resolution authorizing the Town Manager to execute the FY 2010/11
Community Development Block Grant City-County contract with the County of
Santa Clara. RESOLUTION 2010-100
3. Adopt resolution making determinations and approving reorganization of an
uninhabited area designated as Peacock Lane No. 2, approximately 2.8 acres
located at 16417 Peacock Lane and 16200 Shannon Road (APNs: 532 -02-028 and
075); File #AN 10-002. RESOLUTION 2010-101
4. Adopt resolution making determinations and approving the reorganization of
territory designated Hilow Road No. 4, containing approximately 1.12 acres
located at 16397 Hilow Road (APN: 532-04-062.) File #AN10-001.

MOTION: Motion by Vice Mayor Joe Pirzynski to approve Consent Items
#1 - 5.
Seconded by Councilmember Mike Wasserman.
VOTE: Motion passed unanimously.
VERBAL COMMUNICATIONS
Ms. Anderson and Ms. Nassi
Commented that the Chamber of Commerce published a new cookbook featuring
recipes from the community. The Chamber's cookbook can be purchased from
the Chamber of Commerce website and various establishments in Los Gatos.

6. Town Council Consideration and approval of the 2007 to 2014 Housing
Element.
Staff report made by Wendie Rooney, Director of Community Development.
Open/Close Public Comments Portion
MOTION: Motion by Vice Mayor Joe Pirzynski to approve the 2007
to 2014 Housing Element as presented by staff.
Seconded by Councilmember Barbara Spector.
VOTED: Motion passed unanimously.

7. Town Council Consideration and approval of the Human Services Element for
the 2020 General Plan Update.
Staff report made by Wendie Rooney, Director of Community Development.
Council Comments
Thanked staff for their work in preparing the Human Services Element.
Questioned if there is any reference to a policy for HS-7.4 that addresses the
development of a full service senior center.
Recommended that staff create a Policy HS-7.6 which would address the
importance of a dedicated facility/place for seniors.
Suggested having a policy that is explicit and specifically embodies the action
item.
Mr. Larson
Clarified that Policy HS-7.3 may address senior services needs by working with
other agencies to provide a wide variety of services. However that would not be
meant to preclude that the Town could resume providing some or all senior
services directly in the future.
Commented that based on the Council’s direction under Action HS -7.4, it could
be viewed that the stage is set in HS-7.3 or staff could provide more explicit
direction as a new policy.
Suggested that staff could add a policy with language along the lines of "for
Council inclusion in any motion is to encourage the establishment and operation
of a dedicated place for elder adults and seniors."
Council Comments
Consensus for staff to add a policy which would include wording suggested by
Mr. Larson.
Questioned if staff could include some general information under the emphasis
on page HS-24.

Clarified that additional wording would be added to complete the paragraph.

MOTION: Motion by Vice Mayor Joe Pirzynski to approve the Human
Services Element for the 2020 General Plan Update.
Seconded by Councilmember Mike Wasserman.
VOTE: Motion passed unanimously.
Mayor Diane McNutt acknowledged Michael Martello for his exceptional work as the
Town's Interim Town Attorney.

There was no Other Business scheduled for this meeting.
