AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF REDWOOD ENGINEERING CONSTRUCTION AND AUTHORIZE
RECORDING BY THE CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Redwood Engineering Construction. and authorize recording by the Clerk
Administrator.
BACKGROUND:
The adopted Capital Improvement Program Budget for FY 2010/11 — 2014/15 designates
funding, in the amount of $990,000 for this project. Improved access to the Pageant Grounds was
identified as a key component in the planning and development of the new Library.
The previous location of the emergency generator and cooling tower, which serves the Civic
Center building, prevented the development of the Pageant Grounds site as a complement to the
new Library. Staff was directed to explore alternative locations for this essential equipment.
The design and development of this project began in March of 2010 when the Town entered into
an agreement with Alfa Tech to provide design services for this project.

DISCUSSION:
The design was complete in July and the construction documents were bid in August 2010. The
existing cooling tower was relocated and a new standby generator was installed. In addition,
existing equipment not previously allocated to generator power was added to bring all electrical
components and•equipment in the Civic Center emergency power. All equipment was inspected
by the Town's Building Department and the Santa Clara County Fire Department.
On September 7, 2010, Town Council awarded the contract for this .project to Redwood
Engineering Construction. The contracted work has been satisfactorily completed by Redwood
Engineering Construction and is being recommended for acceptance by the Parks and Public
Works Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and/or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Redwood Engineering Construction
and authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
There are sufficient funds available in this project as demonstrated in the table below.
