SUBJECT: ADOPT RESOLUTION AUTHORIZING THE CONTINUED USE OF
SUPPLEMENTAL LOCAL LAW ENFORCEMENT SERVICES FUNDS (SLESF) TO
PROVIDE FUNDING FOR TWO (2) FULL -TIME POLICE OFFICERS ASSIGNED
AS MOTORCYCLE TRAFFIC OFFICERS
RECOMMENDATION
1. Open public hearing to adopt resolution authorizing the continued use of Supplemental Local
Law Enforcement Funds (SLESF) to provide funding for two (2) full -time police officers
assigned as motorcycle traffic officers.
2. Close Public Hearing.
3. Adopt resolution .
BACKGROUN
In July 1996, the Governor signed AB 3229, known as the "COPS" Act (Citizens Option for Public
Safety). In passing this bill, the Legislature declared, "that there is a compelling need for additional
resources to be applied at the local level for the purpose of ensuring public safety...." The COPS Act
guaranteed a base of $100,000 to be distributed to each city and county in California. The Legislature
also allocated $107.1 million in additional funds to be distributed among the counties and cities
following a distribution formula that was based on population. The Town of Los Gatos does not meet
the threshold for a portion of the additional funds.
Beginning in 2008 and coinciding with the State's revenue shortfalls, the monies set aside for additional
funding were reduced resulting in decreased payments to those qualifying jurisdictions. However, the
base allocation of $100,000 per city and county remain unchanged.

The law required that these fiends be used exclusively for front line municipal police services, and that a
written request for the use of these funds be submitted by the Chief of Police. By a separate action, the
City of Monte Sereno also qualifies for and receives $100,000 each year. These fiends are passed to the
the Town of Los Gatos. The combined monies from the City of Monte Sereno and the Town of Los
Gatos have enabled the Police Department to partially fund two motorcycle traffic officer positions to
provide traffic safety for both communities.
DISCUSSION:
As in the past, SLESF funds may be used only to supplement, and not supplant, the existing Police
Services budget. Unlike grant programs which are one -time awards, the "COPS" Act is ongoing and. is
part of the State Legislature's yearly budget appropriations. COPS payments are distributed in four
equal installments of $25,000 for each jurisdiction in September, December, March and June.
SLESF funds will be applied to two existing FTE motorcycle officer positions within the Los
Gatos /Monte Sereno Police Department. These funds partially support 2.0 FTE of traffic services to the
Los Gatos and Monte Serene communities (the cost of each position is approximately $208,000 per year
not including vehicles, assignment specific training, overtime, supervision and other overhead). These
positions provide for traffic enforcement, accident investigation and supplemental patrol support. Two
FTE positions equate to 80 hours of total time per week shared by both communities with a dedicated
minimum of 8 of those 80 hours spent within the Monte Sereno city limits.
Dedication of these fiends provide for specialized traffic enforcement and accident investigation,
consistency of effort between patrol personnel and traffic personnel, coordinated targeted traffic
enforcement including the ability to very quickly and flexibly respond to traffic concerns, ubiquitous
service addressing traffic impacts affecting both communities, speed of response to dangerous
conditions or accidents, consistency of supervision and a personal connection between individual
officers and the individual communities the department serves.
CONCLUSION
Staff recommends the continued use of SLESF funds for two full -time motorcycle traffic officers.

This is not a project as defined under CEQA
FISCAL IMPACT
All revenue related to the Supplemental Law Enforcement Services Fund will be deposited to account
43409 in program 4302. The Monte Sereno City Council met on October 19, 2010 and approved the
continued use of their portion of SLESF funds towards these two motor officer positions.
The Town of Los Gatos receives a quarterly payment from the County of Santa Clara of $25,000. The

City of Monte Sereno transfers $25,000 to the Town of Los Gatos each quarter. Total funds received
from this program equal $200,000 annually.

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AUTHORIZING THE CONTINUED EXPENDITURE OF FUNDS FROM THE
SUPPLEMENTAL LAW ENFORCEMENT SERVICES FUND FOR TWO ADDITIONAL
POLICE OFFICERS TO BE ASSIGNED AS MOTORCYCLE TRAFFIC OFFICERS
WHEREAS, Chapter 6.7 of Division 3 of Title 3 of the Government Code was
amended with the Governor's approval of Assembly Bill 2885; and
WHEREAS, the Town of Los Gatos is entitled to receive approximately $100,000
under the terms of the Supplemental Law Enforcement Services Fund if specified requirements are
met as well as $100,000 from the City of Monte Sereno under the terms of the fund; and
WHEREAS, the State funding cannot be used to supplant current Town costs for law
enforcement and must be expended exclusively for front -line police services; and
WHEREAS, the Town Council has considered the written request separate and apart
from the allocation of general funds for police services;
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara,
State of California, that the Town of Los Gatos authorize the continued expenditure of funds from
the Supplemental Law Enforcement Services Fund for two additional police officers to be assigned
as motorcycle traffic officers.
BE IT FURTHER RESOLVED,
1. The'Town Manager is directed to continue the Supplemental Law Enforcement
Services Fund (SLESF) within the Town for receipt and disbursement of money received from the
County Supplemental Law Enforcement Services Fund.
2. The Town Manager is directed to promptly remit to the General Fund all funding
deposited in such SLESF fund for the additional funding of two Police Officer positions to be
assigned as motorcycle traffic officers.
3. The Town Manager is directed to submit reports concerning the expenditure of
SLESF funds to the Santa Clara County Supplemental Law Enforcement Oversight Committee
PASSED AND ADOPTED at a public hearing meeting of the Town Council of the
Town of Los Gatos, California, held on the 20' day of December, 2010 by the following vote:
