AUTHORIZE THE TOWN MANAGER TO EXECUTE CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF RP ENGINEERING CONSTRUCTION COMPANY AND AUTHORIZE
RECORDING BY THE CLERK ADMINISTRATOR.
RECOMMENDATION
Authorize the Town Manager to execute Certificate of Acceptance and Notice of Completion
accepting the work of RP Engineering Construction Company and authorize recording by the
Clerk Administrator.
BACKGROUND
The adopted Capital Improvement Program (CIP) for FY 2010/12 — 2014/15 designates funding
for concrete curb, gutter, and sidewalk repair and replacement project and is consistent with the
Town's goals to improve public safety.
DISCUSSION
On June 21, 2010, the Town Council awarded a construction contract to RP Engineering
Construction Company for this project. The contracted work has been completed by RP
Engineering Construction Company and is being recommended for acceptance by the Parks and
Public Works Department.

This project repaired and replaced damaged concrete curb, gutter, and sidewalk throughout the
Town. The primary cause of damage to the curb, gutter, and sidewalk is the overgrowth of tree
roots. As Los Gatos is an older community with many neighborhoods with large trees in the
relatively narrow planter areas, the tree root damage to the infrastructure is an on -going
challenge.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and/or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION
Staff recommends that the Town Council authorize the Town Manager to executive a Certificate
of Acceptance and Notice of Completion accepting the work of RPG Engineering Construction
Company and authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT
The project was completed within the budget as demonstrated in the table below.
