RECOMMENDATION: -
Authorize the Town Manager to execute a Cet~tificate of Acceptance and Notice of Completion
accepting the work of Lewis and Tibbitts Inc. and authorize recording by the Clerlc
Administrator.
BACKGROUND:
The adopted Capital Improvement Program designates funding for the improvements to the
Town infrastructure, and facilities and is consistent with the Town's goals to improve public
safety and improve the quality of life in Town:
Tl1e construction of new Los Gatos Library required relocation of existitlg utility lines that are
within the proposed project site. Staff began the process of design for relocation of the utilities in
fa112009 and the final design was completed in January 2010. The relocation of utility plans was
approved by PG&E, Comcast, and Verizon before proceeding with the actual constructions. This
utility relocation project involved both overhead and underground utilities lines (electric,
telephone, cable TV, Town Communication, gas) along Villa Avenue and Fiesta Avenue.

DISCUSSION:
On February 1, 2010, The Town Council awarded the construction contract for this «~orlc to
Le«~is and Tibbitts Inc. The contracted work has been satisfactorily completed by Lewis and
Tibbitts. Inc. and is being recommended. for acceptance by the Parlcs and Public Worlcs
Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and/or replacement caused by defective materials and worlcinanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the «~orlc of Lewis and Tibbitts Inc, and
authorize recording by the Clerlc Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed..
FISCAL IMPACT:
T'he original contract approved was for $171,665, with a contingency of $20,000, for a total
project budget of $191,665. The project was completed for $189,794 which is within the
authorized budget amount.
