APPROPRIATION OF FUNDING TO THE CURB, GUTTER, AND
SIDEWALK REPLACEMENT PROJECT (411-813-9921)
RECOMMENDATION:
1. Adopt a resolution authorizing application for Proposition 1B Local Streets and Roads Funds
for FY 2009/10.
2. Upon confirmation of State approval to appropriate Proposition 1B funds to the Curb, Gutter,
and Sidewalk Replacement Project (411-813-9921).
BACKGROUND:
In 2008, State Budget Act (AB 88) made $187 million in additional Proposition 1B funds
available to cities on a first-come, first serve basis for FY 2009/10. Each city is able to apply for
a portion of these funds based on population.
In order to be eligible to apply, it is required that a resolution be adopted and that the funds being
requested are part of an approved budget plan. T11e purpose of this staff report is to formally
request Town Council's approval and authorization to apply for Proposition 1 B (Prop 1 B) Local
Streets and Road funds for FY 2009/10, and fiuther to appropriate Proposition 1B fiulds to the
Curb, Gutter, and Sidewalk Replacement Project for concrete repair and replacement projects.

DISCUSSION:
Proposition 1 B was instituted in November 2006 as part of the statewide infrastructure bond
pacleage. Proposition 1B is the transportation portion, out of which funds were dedicated to
cities and counties for local streets and roads. These funds can be used for street pavement
maintenance, traffic congestion relief projects, transit facility improvements, safety projects, or
as local match for state and federal funded projects. The Town last received $472,992 in FY
2007/08, which were used for street repair and resurfacing projects during that period. These
projects were approved by Council under the adopted FY 2008/09-.2012/13 Capital Improvement
Program budget.
The State Controller's Office has allocated $437,175 in Prop 1B funds to the Town for FY
2009/10. If the Prop1B funding is appropriated, these funds will be allocated to the Curb, Gutter,
and Sidewalk Replacement Project for concrete repair and replacement. The repair and
replacement of hazardous curbs, gutters, and sidewalles throughout the Town is an on-going issue
and maintenance resources have historically been limited. The Prop 1B funds will be budgeted
in the FY 2009/10 budget under the Curb, Gutter, and Sidewalk program to allow the Town to
enhance pedestrian and bicyclist safety and ADA compliance. The monies received from Prop
1B will fund a concrete and repair replacement project town wide.
In order for the Town to apply for the Prop 1 B funds, the Council must adopt a resolution
accepting a plan for the use of these funds.
CONCLUSION:
Staff recommends the Town Council adopt the attached Resolution authorizing application for
Prop1B Local Streets and Roads funds for FY 2009/10 and appropriate these funds to the Curb,
Gutter, and Sidewalk Replacement Project (411-813-9921).
ENVIRONMENTAL ASSESSMENT:
Council approval of the attached resolution is not a project defined under CEQA, and no further
action is required.
FISCAL IMPACT:
The adoption of this Resolution will allow the Town to apply for Prop1B allocated funding in the
amount of $437,175. The funds, if approved by the State, will be allocated to the Curb, Gutter, and
Sidewalk Replacement Account 411-813-9921.

OF THE TOWN OF LOS GATOS
AUTHORIZING APPLICATION FOR PROPOSITION 1B
LOCAL STREETS AND ROADS FUNDS FOR FY 2009/10
AND APPROVING USE OF THE FY 2009/10
PROPOSITION 1B FUNDS
WHEREAS, the Town of Los Gatos (Town) is eligible to apply for additional
Proposition 1B fielding for local street and maintenance; and
WHEREAS, the Town last received an allocation during FY 2007/08 and submitted an
approved plan to the State Department of Finance for use of those funds; and
WHEREAS, if the FY 2009/10 Proposition 1B fiind are received, the Proposition 1B
funds will be encumbered prior to July 1, 2010; and
WHEREAS, the Town agrees that the fiords from FY 2009/10 allocation will be used for
projects that are not currently fully funded with a dedicated funding source or sources; and
WHEREAS, the Town will report the use of FY 2009/10 Proposition 1B fiords to the
State of California Department of Finance by the requested time.
NOW, THEREFORE BE IT RESOLVED that the Town Council of the Town of Los
Gatos authorizes application for Proposition 1B Local Streets and Roads Funds for FY 2009/10
and approves the Town's plan for use of its Proposition 1B funds.
