02 Staff Report - Donated Artwork "Cruiser"MEETING DATE: 12/07/09 ITEM NO: COUNCIL AGENDA REPORT DATE: NOVEMBER 30, 2009 TO: MAYOR AND TOWN COUNCIL FROM: GREG LARSON, TOWN MANAGER SUBJECT: ACCEPT THE DONATED ARTWORK ENTITLED, "CRUISER," IN ACCORDANCE WITH THE TOWN PUBLIC ART SELECTION POLICY AND PROCEDURES AND THE TOWN SOLICITATION AND DONATION POLICY. RECOMMENDATION: Accept the donated artwork entitled, "Cruiser," in accordance with the Town Public Art Selection Policy and Procedures and the Town Solicitation and Donation Policy. BACKGROUND: "Cruiser," a 48 inch by 68 inch oil on canvas painting was painted by local artist Gordon Smedt and donated to the Los Gatos Police Foundation for auction at their Saturday, September 20, 2009 fundraising event, "A Taste of Los Gatos." The artwork was purchased at the auction by community members, Jennifer Krach and Catherine Fitzsimmions, who wish to gift it to the Town. An image of "Cruiser" is attached. (Attachment 1) DISCUSSION: All art being gifted to the Town with a value in excess of $5,000 must go through the Public Art Selection and Procedure process, which includes review by the Arts and Culture Commission, and acceptance by Council. "Cruiser" is valued at $13,000, the price it was purchased for at auction. The current owners would like to gift the artwork to the Town to be displayed in the Police Operations Building located at 15900 Los Gatos Blvd. The artwork is currently hanging in the desired location of the building, near the main entrance, and will remain there pending Council's approval. Criteria for the acceptance of public art includes aesthetics, quality, style, permanence, public liability diversity, technical feasibility, duplication and placement. The Arts and Culture Commission has previewed the art and recommends that Town Council accept it. CONCLUSION: Staff recommends that this generous donation of artwork be accepted by Council. The artwork will enhance the facility and, if approved, will continue to be displayed in the current location in which it is hanging within the Police Operations Building. ENVIRONMENTAL ASSESSMENT: The recommended action is not a project defined under CEQA, and no further action is required. FISCAL IMPACT: Accepting this art does not have a fiscal impact.
