RESOLUTION OF THE TOWN COUNCIL/REDEVELOPMENT AGENCY
OF THE TOWN OF LOS GATOS APPROVING THE RELOCATION IMPACT STATEMENT
AND LAST RESORT HOUSING PLAN FOR THE 20 DITTOS LANE PROPERTY
WHEREAS, the Town Council/Redevelopment Agency of the Town of Los Gatos (the
"Agency") and Dittos Lane Family Housing, L.P., an affiliate of Roem Development Corporation,
entered into an Exclusive Right To Negotiate Agreement setting forth terms for negotiation of a
disposition and development agreement for potential development of an affordable housing development
on an approximately 1.58 acre parcel at 20 Dittos Lane (APN 529-29-034) (the "Property") in the
Central Los Gatos Redevelopment Project Area that is currently owned by the Agency; and
WHEREAS, the .redevelopment of the Property will entail relocation of three households which
currently reside on the Property; and
WHEREAS, the Town Council'/ Agency and its consultant have prepared a Final Relocation
Impact Statement and Last Resort Housing Plan for the Dittos Lane Apartment Project (the "Relocation
Plan") (Exhibit A) in accordance with Section 6038 of the California Department of Housing and
Community Development Relocation Regulations (the "Relocation Regulations"); and
WHEREAS, the Town Council/Agency has considered the proposed Relocation Plan, the staff
report prepared by the Town Council/Agency staff in connection with consideration of the Relocation
Plan (the "Staff Report") and the comments of interested persons submitted to the Town
Council/Agency;
WHEREAS, timely general notice of the Relocation Plan designed to reach the occupants of the
Property was made in accordance with the provisions of paragraph 6046(a)(3) and subsection 6046(b) of
the Relocation Regulations, as required by Section 6038(e)(2) of the Relocation Regulations; and
RESOLVED, by the Town Council/Agency that the Town Council/Agency hereby finds .and
determines that the above recitals are true and correct.
BE IT FURTHER RESOLVED that the Town Council/Agency hereby finds and determines
that the Relocation Plan is consistent with the Housing Element of the Town of Los Gatos General Plan..
BE IT FURTHER RESOLVED, based on the information and analysis set forth in the above
Recitals and contained in the Staff Report and the Relocation Plan, the Town Council/Agency hereby
finds and determines, pursuant to Section 6010 of the Relocation Regulations, that:
1. Fair and reasonable relocation payments will be provided to eligible persons as required by
Article 3 of the Relocation Regulations;
2. A relocation assistance program offering the services described in Article 2 of the Relocation
Regulations will be established;
3. Eligible persons will be adequately informed of the assistance, benefits, policies, practices
and procedures, including grievance procedures, provided for in the Relocation Regulations;
4. Based upon recent survey and analysis of both the housing needs of persons who will be
displaced and available replacement housing and considering competing demands for that housing,
comparable dwellings will be available, or provided, if necessary, within a reasonable period of time
prior to displacement sufficient in number, size, and cost for the eligible persons who require them;
5. The Relocation Plan makes adequate provisions to provide orderly, timely, and efficient
relocation of eligible persons to comparable replacement housing available without regard to race, color,
religion, sex, marital status, or national origin with minimum hardship to affected households; and
6. The Relocation Plan meets the requirements of Section 6038 of the Relocation Regulations.
BE IT FURTHER RESOLVED that the Town Council/Agency hereby approves the
Relocation Plan and authorizes the Town Manager/Executive Director of the Agency, or his designee, to
take such steps as they deem necessary to facilitate the implementation of the Relocation Plan.
PASSED AND ADOPTED at a regular meeting of the Town Council/Board of Directors of the
Redevelopment Agency of the Town of Los Gatos, California held on the 16t~' day of February, 2010 by
the following vote:
