2004-124-Setting Date For Consideration Of Reorganization Area Designated Oka Road No 9 Located At 14800 And 14840 Oka Road Approximately 6.68 AcresRESOLUTION 2004-124 RESOLUTION OF THE TOWN COUNCIL OF THE'TOWN OF LOS GATOS SETTING DATE FOR CONSIDBRATION OF REORGANIZATION AREA DESIGNATED "OKA ROAD NO. 9", LOCATED AT 14800 AND 14840 OKA ROAD; APPROXIMATELY 6:68 ACRES, (APN'S: 424-08-057, 058, 059 AND 060) WHEREAS, the Town Council of the Town of Los Gatos has received a request for annexation of territory designated "Oka Road No. 9" from Thomas Yuki; .and WHEREAS, the property, 6.68± acres on the east side of Oka Road, between Lark and Mozart Avenues (APN's: 424-08-057.,. 058, 059 and 060) is contiguous to the Town of Los Gatos and is within its urban service area; .and WHEREAS, the following special district would be affected by the proposed annexation: Santa Clara County Library Service Area No. 1; and WHEREAS,. annexation would provide for use of Town services; and WHEREAS, this territory was pre-zoned R1:8 over 25 years ago, when the Urban Service Area boundaries were originally set; and WHEREAS, the Town of Los Gatos, as Lead Agency for environmental review for the reorganization has determined that annexation of the subject property is exempt for the California Environmental Quality Act guidelines, pursuant to 'Section 15061(b)(3); and WHEREAS,the County Surveyor of Santa Clara County has found the map and description :(Exhibits "A" and "B") to be in accordance with Government Code Section 56757, the boundaries to be definite and certain, and the proposal to be in compliance with LAFCO's road annexation policies; and WHEREAS, as provided in Government Code Section 56757, the Town Council of the Town of Los Gatos shall be conducting authority for a reorganization including an annexation to the Town; and WHEREAS, said territory is uninhabited and all owners of land included in proposal have consented to this annexation; and WHEREAS, Government Code Section 56663 (a) provides that if a petition for annexation is signed by all owners of the land within the affected territory the Town Council may approve or disapprove the annexation without public hearing; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Los Gatos hereby initiates annexation proceedings .and will consider annexation of the territory designated as Oka Road No. 9 and detachment for the Santa Clara County Library Service Area No. 1 at their regular meeting of November 1, 2004. .PASSED AND ADOPTED at a regular meeting of the Town Council held on the 18`'' day of October, 2004, by the following vote: COiJNC1I, MEMBERS: .AYES: Sandy Decker, Diane McNutt, Joe Pirzynski, Mike Wasserman, Mayor Steve Glickman, NAYS : None ABSENT: None ABSTAIN: None SIGNED: ~~ MAYOR OF THE TOWN OF LOS GATOS LOS GATOS, CALIFORNIA ATTEST: CLERK OF THE TOWN OF LOS GATOS LOS GATOS, 'CALIFO'RNIA 17-S99-B 06-22-04 Revised 08-24-04 DESCRIPTIQN EXHIBIT "A" ANNEXATION TO THE TOWN OP LOS GATOS OK.A ROAD NO. 9 .Page 1 of 2 All that certain real property situate in the Town of Los Gatos,.
