A RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT
TOWN OF LOS GATOS
LANDSCAPING AND LIGHTING ASSESSMENT DISTRICTS N0.1 & 2
FISCAL YEAR 2004-.2005
RESOLVED, by the Town Council of the Town of Los Gatos, California as follows:
WHEREAS., pursuant to the Landscaping and Lighting Act of 1972, on the 5th day of April,
2004, said Council did adopt its Resolution No. 2004-38, "A Resolution Describing Improvements
and Directing Preparation of Engineer's Report For Fiscal Year 2004-2005," for the Town of Los
Gatos Landscaping .and Lighting Assessment Districts No. 1 & 2, in :said Town and did refer the
proposed improvements to the Engineer of the Town ..and did therein direct said Engineer to prepare
and file with the Clerk of said Town a report,. in writing, all as therein more particularly described;
and
WHEREAS, said Town Engineer prepared and filed with he Town Clerk a report in writing
as called for in said Resolution No. 2004-38 and under and pursuant to said Act, which report has
been presented to this Council for consideration; and
WHEREAS, said Council has duly considered said report and each and every part thereof,
andfinds that each and every part of saidreport is sufficient, and that neither said report, nor any part
thereof should be modified in any respect.
NOW, THEREFORE, it is hereby found, determined and ordered, as follows:
L That the plans and specifications for the existing improvements and the proposed new
improvements to be made within the assessment districts or within any .zone thereof, contained in
said report, be, and they are hereby ;preliminarily approved.
2. That the Engineer's estimate of the itemized and total costs and expenses of said
improvements, maintenance and servicing thereof, and of the incidental expenses in connection
therewith, contained in said report, be, and .each of them are hereby preliminarily approved.
3. That the diagram showing the exterior boundaries of the assessment districts referred
to and described in said Resolution No. 2004-38, and also the boundaries of any zones therein, ..and
the lines and dimensions of each lot or parcel of land within said districts as such lot or parcel of land
is shown on the County Assessor's maps for the fiscal year to which the report applies, each of which
lot or parcel of land has been given a separate number upon said diagram, as contained in said report,
be, and it hereby is preliminarily approved.
4. That the proposed assessment of the total amount of the estimated costs and expenses
of the proposed improvements upon the several lots or parcels of land in said assessment districts
in proportion to the estimated benefits to be received by such lots or parcels, respectively, from said
improvements including the maintenance or servicing or both, thereof, and of the expenses incidental
thereto, as contained in said report, be, and they are hereby preliminarily approved.
5. That said report shall stand as the Engineer's Report for the purpose of all subsequent
proceedings to be had pursuant to said Resolution No. 2004-38.

DESCRIBING IMPROVEMCNTS AND
DIRECTING PREPARATION OF ENGINEER'S REPORT
FOR FISCAL PEAR 2004-2005

LANDSCAPING AND LIGHTING ASSESSMENT DISTRICTS NO.1 & 2
RESOLVED, by the Town Council of the Town of Los Gatos, California, as follows:
1. The Town Council did, pursuant to the provisions of the Landscaping .and Lighting
.Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of California, conduct
proceedings for the formation of the Town of Los Gatos Landscaping and Lighting Assessment
Districts No. 1 8z 2.
2. The public interest, convenience and necessity :require, and it is the intention of said
Council to undertake proceedings far the levy and collection of assessments upon the several lots
or parcels of land in said Districts, far the construction nr instaIlation of improvements, including
the .maintenance or servicing, or bath, thereof, for the fiscal year 2004-2005.
3. The improvements to be constructed or installed, including tl~e maintenance or
servicing, ar both, thereof, are more particularly described in Exhibits "A" and "$" hereto attached
and by reference incorporated herein.
4. The costs and expenses of said improvements, including the maintenance or servicing,
or both, thereof, .are to be made chargeable upon said Districts, the exterior boundaries of which
Districts are the composite and consolidated area as snore particularly shown on a map thereof on
file in the office of the Clerk of the Town of Los Gatos to which reference is hereby made for further
particulars. Said map :indicates by a boundary Tine the extent of the territory .included in said
Districts and of any zone thereof and shall gave~m far all details as to the extent of the assessment
districts.
5. The Engineer of said Town be, and is hereby, directed to prepare and file with said
Clerk a report, in writing, referring to the assessment districts by their distinctive designations,
specifying the fiscal year to which the report applies, and, with respect to that year, presentirtg the
following:
a} plans and specification of the :existing improvements and for proposed new
improvements, if any, to be made within the assessment districts or within
any zones thereof;
b) an estimate of the costs of said proposed new improvements, if any, to be
made, the costs of maintenance or servicing, or both, thereof, and of any
existing improvements, together with the incidental expenses in connection
therewith;
c) a dzagramshowing the extezior• boundaries of the assessment districts and of
any zones within said districts and the lines and dirnensioz7s of each lot or
parcel of land within the districts as such lot or parcel of land is shown on the
County Assessor's map for the fiscal year to wltich the report applies, each of
which lots or .parcels of land .shall be identified by a distinctive number or
letter on said diagram; and
d) a proposed assessment of the total amount of the estimated costs and
expenses of the proposed new improvements, including the maintenance or
servicing, ar both, thereof, and of any existing improvements upon the
several lots or parcels of land in said districts in proportion to the estimated
particular and distinct benefits to be received by each of such lots or parcels
of land, respectively, from said improvements, including the maintenance pr
servicing, or both, thereof, and of the expenses incidental thereto.
6. The Office of the Engineer of said Town be, and is hereby designated as the office
to answer inquiries regarding any protest proceedings to be had herein, and may be contacted during
