LEVY AND COLLECTION OF ASSESSMENTS PURSUANT
TO THE LANDSCAPING AND LIGHTING ACT OF .1972

LANDSCAPING AND LIGHTING ASSESSMENT DISTRICTS NO. 1 & 2
FISCAL YEAR 2001-2002
RESOLVED, by the Town Council of the Town of Los Gatos, California, as follows:
WHEREAS, pursuant to Resolution No. 2001-30, "A Resolution Describing
Improvements and Directing Preparation of Engineer's Report for Fiscal Year 2001-2002," for
the Town of Los Gatos Landscaping and Lighting Assessment Districts No, 1 & 2, adopted on
Apri12, 2001, by the Town Counci'1 of said Town,. pursuant to the Landscaping and Lighting Act
of 1972, the Engineer of said Town has prepared and filed with the Clerk of this Town the
written report called for under said Act and by said Resolution No. 2001-30, which said report
has been submitted .and preliminarily approved by this Council in accordance with said Act;
NOW, THEREFORE, it is hereby found, determined and ordered, as follows:
1. In its opinion the public interest and convenience require and it is the intention of
this Council to order the levy and collection of assessments for Fiscal Year 2001-2002 pursuant
to the provisions ofthe Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets
and Highways Code of the State of California, for the construction or installation of the
improvements, including the maintenance or servicing, or both, thereof, more particularly
described in Exhibit '"A" .hereto .attached and by reference incorporated herein.
2. The costs and expenses of said improvements, including the maintenance or
servicing, or both, thereof, are to be made chargeable upon the assessment districts designated as
"Town of Los Gatos Landscaping .and Lighting Assessment Districts No. 1 & 2," the exterior
boundaries of which are the .composite and consolidated areas as more particularly described on
maps thereof on file in the office of the Clerlc of said Town, to which reference is hereby made
for further particulars. Said .maps indicate by a boundary line the extent of the territory included
in the districts and of any .zone thereof and the general .location of said districts.
3. Said Engineer's Report prepared by the Engineer of said Town, preliminarily
approved by this Council, and on file with the Clerlc of this Town is hereby referred to for a full
and detailed description of the improvements and the boundaries of the assessment districts and
any zones therein, :and the proposed assessments upon assessable lots and parcels of land within
the districts.
4. Notice ;is hereby given that Monday,. the 4th day of June, 2001., at the hour of 7:00
p.m, in the Council Chambers at 110 East Main Street, Los Gatos, California, be and the same is
hereby appointed and fixed as the time and place for a hearing by this Council on the question of
the levy .and collection of the proposed assessments for the construction or installation of said
improvements, including the maintenance and servicing, or both, thereof, and when and where it
shall consider all oral statements and all written protests made or filed by any interested person at
or before the conclusion of said hearing, :against said improvements, the boundaries of the
assessment districts and any zones therein, the proposed diagram or the proposed assessments, to
the Engineer's estimate of the cost thereof, and when and where it shall consider and finally act
upon the Engineer's report.
5. The Clerk of said Town be, and hereby is, directed to give notice of said hearing
by causing a copy of this Resolution to be published twice in the Los Gatos Weekly Times, a
newspaper published and circulated in said Town, and by conspicuously posting a copy thereof
upon the official bulletin board customarily used by the Town of Los Gatos for the posting of
notices, said posting and publications to be had and completed at least ten (10) days prior to the
date of hearing specified herein.
6. The Office of the Town Engineer be, and hereby is designated as the office to
answer inquiries regarding .any protest proceedings to be had herein, and may be contacted
during the regular office hours at the Town .Service Center, 41 Miles Avenue, Los Gatos,
California 95030, or by calling (408) 399-5770.

Larry I. Perlin, Engineer of Work for Landscaping and Lighting Assessment District No. 1, Town
of Los Gatos, 'Santa Clara County, California, makes this report, as directed by the Town Council,
pursuant to Section 22566, et seq. of the Streets and Highways Code (Landscaping and Lighting Act
of 1.972).
The improvements that are the subject of this report are briefly described as follows:
Maintaining the landscaping in the median island constructed as a part of Tract No.
8306 and maintaining the street lights installed along Blackwell Drive and National
Avenue as a part of Tract No. 8306.
This report consists of four parts, as follows:
PART A: Plans and specifications for the improvements are filed with the Town Clerk.
Although separately bound, the plans and specifications are a part of this report and
.are included in it by reference.
PART B: An estimate of the cost of the improvements.
PART C: An assessment of the estimated cost of the improvements on each benefitted parcel
within the assessment district, the method. by which the Engineer of Work has
determined the proposed assessment against each parcel, and a list of the owners of
real property within this assessment district, as .shown on the last equalized
assessment roll for taxes, or as known to the Clerk.
PART D: A diagram showing all of the parcels of real property within this assessment district.
The diagram is keyed to Part C by assessment number.

riparian and wetlands area described in the report by H. T. Harvey Associates, dated
November 11,1994.

The wetlands mitigation and monitoring plan was prepared by H.T. Harvey & Associates, Ecological
Consultants, dated November 11, 1994, their file number 733-04, 11 pages. A revised wetlands
mitigation plan is contained in a letter to theU.S. Army Corp of Engineers and California Regional Water
Quality Contro Board dated August 30, 1995 and as-built plans in a letter dated February 21,1995. The

report, as .directed by the Town Council, pursuant to Section 22566, et seq. of the Streets and
Highways Code (Landscaping and Lighting Act. of 1972).
The improvements that are the subject o;f this report are briefly described as follows:
The maintenance of trees, landscaping, trail and retaining walls, as shown on the
approved improvement plans for Tract No. 8400, Los Gatos, California.
This report consists of four parts, as follows:
PART A: Plans and specifications for the improvements are filed with the Town Clerk.
Although separately bound, the plans and specifications are-apart of this report and
are included in it by reference.
PART B: An estimate of the cost of the improvements.
PART C: An assessment of the estimated cost of the improvements on each benefitted parcel
within the assessment district, the method 'by which the .Engineer of Work 'has
determined the amount proposed to be assessed against each parcel,. and a Iist of the
owners ofreal property within this assessment district, as shown on the last equalized
