RESOLUTION REMANDING A REQUEST FOR APPROVAL OF A ZONE CHANGE FROM R-1:8
TO RM:S-12:PD TO CONSTRUCT NINE TOWNHOUSES. NO
.SIGNIFICANT .ENVIRONMENTAL IMPACTS HAVE BEEN IDENTIFIED AND A NEGATIVE
DECLARATION IS RECOMMENDED.

WHEREAS:
A. This matter came before Council for public hearing on October 15, 2001, on an appeal by
Syu Hwu (appellant) from a decision of the Planning Commission and was regularly noticed in
:conformance with State and Town law.
B. Council received testimony and documentary evidence from the appellant and all interested
persons who wished to testify or submit documents. Council considered .all testimony .and materials
submitted, including the record of the Planning Commission proceedings and the packet of material
contained in the Council Agenda Report dated October 4, 2001, and the Addendum dated October 10, 2001
along with subsequent reports and materials prepared concerning this application.
C. The appellant is requesting approval to construct nine attached single family :residences
.(townhouse style) and to rezone the subject property from R-1:8 to RM:S-12:PD. One of the proposed
residences would be a Below Market Price unit. The subject project is located on the northeast corner of
Celle Marguerite and Wedgewood Avenue, near the Route 85 freeway. The site is on the northern edge of
the Town boundary with the City of Campbell. The appellant is proposing a single access point from Celle
Marguerite.
D. The Planning Commission first considered this application on January 24, 2001 and
continued the matter to Apri125, 2001 to .allow the applicant time to review plans in response to concerns

raised at the meeting. On Apri125, 2001, the Commission considered the revised plans and continued the
matter to August 22, 2001 to allow for further plan .revisions. On August 22, 2001, the Commission
considered the revised plans and voted to deny the Planned Development based on the density of the proj ect
and the lack of community benefit.
D. The Town Council finds pursuant to Town Code section 29.20.300., that new information was
presented to the Council that was not readily available at the time of the Planning Commission review. The
appellant has demonstrated a willingness to consider modifying the application in .order to develop eight
attached single family residences {townhouse style). One ofthe units would be a Below Market Price unit..
RESOLVED:
Development Application PD-99-002 is therefore remanded to the Planning Commission for
consideration of the revised plans for the development of eight attached single familyresidences (townhouse
style) with one of the units identified as a Below Market Price unit.
Passed and adopted at a regular meeting of the Town Council of the Town of Los Gatos, California
held on the Stt' day of November, 2001 by the following vote.
