RESOLUTION DENYING AN APPEAL OF A DECISION OF THE PLANNING COMMISSION
APPROVING A REQUEST TO CONSTRUCT A NEW SINGLE .FAMILY RESIDENCE ON

WHEREAS:
A. This matter came before Council for public hearing on October 15, 2001, on an appeal by Ray
Davis (appellant) from a decision of the Planning Commission .and was regularly noticed in conformance
with State and Town law.
B. Council received testimony and documentary evidence from the appellant and all interested
persons who wished to testify or submit documents. Council considered all testimony .and materials
submitted, including the record of the Planning Commission proceedings and the pacl~et of material
contained in the Council Agenda Report dated October 1, 2001 and the Addendum dated October 10, 2001,
along with subsequent reports and :materials prepared concerning this application.
C. The subject property is located on the westside of Wooded ViewDrive at the end of the cut-
de-sac. The applicant is proposing to construct a 6,862 square foot two-story residence with a 1,017 square
.foot attached garage on an undeveloped 4.78 acre lot.

ID. The Planning Commission first consider this application on March 28, 2001 and continued
the matter to June 27, 2001 to allow the applicant to .review the plans in response to concerns that were
raised at the meting. On June 27, 2001, the Commission considered revised plans and continued the
application to August 8, 2001 requesting that the applicant make further changes to the plans to reduce the
roof area, the bulls and mass of the house, the amount of landscape and ornamental landscaping. The
.applicant submitted revised plans responding to the Commission's direction provided at the June 27t~'
meeting. The house was completely redesigned to address concerns fo the Commission .and on August 8,
2001 the Commission approved the project.
E. Appellant claims thatthe Planning Commission erred or abused its discretion and erroneously
failed to review the application for consistency with the General Plan, Hillside Specific Plan, Hillside
Standards and Zoning Ordinance.
F. The Planning Commission decision was correct.
RESOLVED:
1. The appeal of the decision of the Planning Commission on Architecture and Site Application
5-00-84 is denied. The Conditions of Approval, attached hereto as Exhibit L to the October 1,.2001 Staff
Report, are applied to this appeal.
2. The decision constitutes a final administrative decision pursuantto Code of Civil Procedure
section 1094.6 as adopted by section 1.10.085 of the Town Code of the Town of Los Gatos, Any application
for judicial relief from this decision must be sought within the time .limits and pursuantto the procedures
established by Code of Civil Procedure section 1094.6, or such shorter time as required by State and Federal
law.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos,
California, on .the 5"' day of November, 2001 by the following vote.
