OF A PLANNING COMMISSION DECISION APPROVING APPLICATIONS FOR A
CONDITIONAL USE .PERMIT FOR A MASTER PLAN OF HILLBROOK SCHOOL AND
APPROVAL OF AN ARCHITECTURE AND SITE APPLICATION TO DEMOLISH AN
EXISTING CLASSROOM BUILDING AND TO CONSTRUCT NEW CLASSROOM BUILDING

.APPELLANT: ELAINE AND ARTHUR MYERS
WHEREAS:
A. This matter .came before the Council for public hearing on Junes, 2000, on an appeal by
Elaine and Arthur Myers (appellant) from a decision of the .Planning Commission and was regularly
noticed in conformance with .State and Town law.
B. The Council :received testimony and documentary evidence from the appellant and all
:interested persons who wished to testify or submit documents. The Council considered all testimony
and materials submitted, including the record of the Planning Commission proceedings and the packet
of material contained in the Council Agenda Report datedMay 24,.2000, June 1, 2000, and June 5, 2000,
along with subsequent reporCs and materials prepared concerning this application.
C. The Development Review Committee .considered the applications on May 25,1999, and
deemed the applications. complete subject to conditions. The Planning Commission considered the
matter on April 12, 2000, and approved the applications subject to modified Conditions of Approval,
one of which being that the emergency access gate on Ann ArborDrive remain open during construction.
D. The appellants are appealing the Planning Commission decision because they believethat
the Commission erred or abused its discretion and that the decision was not based on evidence in the
record.
E. Council firias pursuant to Town Code section 29.2U.~~0 that new information was
submitted to the Council during the requested hearing that was not readily available at the time of the
Planning Commission review. Information was presented describing a willingness to further address
policies and guidelines concerning the traffic, school and evening activities and a limit on student
enrollment. Such information .should be reviewed by the Planning Commission for consistency with
Town. regulations, polices and guidelines.
RESOLVED:
The appeal of the decision of the Planning Commission on Proj ect Applications PRJ-99-062 and
PRJ-99-063 is therefore granted and the application are .remanded to the Planning Commission for
reevaluation of the plans .and design with reference to the number of parking spaces permitted under the
CUP, duration of after school and evening activities in the calendar year, and a limit on student
enrollment. Further, the Planning Commission should evaluate a traffic study and traffic calming
measures.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos,
California held on the 19TH day of June, 2000 by the following vote.
