RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
MAKING CERTAIN FINDINGS AND CONTINUING PUBLIC HEARING ON OTHER
FINDINGS TO APPROVE A MOBILE HOME PARK CONVERSION
PERMIT ON PROPERTY ZONED RMII.
DEVELOPMENT APPLICATON: DEV-97-007.
PROPERTY LOCATION: 484 WOODLAND AVE.
PROPERTY OWNERS/APPLICANTS: MALCOLM AND MARGARET MCNELLY
WHEREAS:
A. Applicants have filed an .application {DEV-97-007) to close the .Los Gatos Mobile
Home Parl{ ("Park") in an effort to pursue the development of areplacement project on the Park site.
B. Division 8 oftitle 29 oftlle Los Gatos Town Code (section 29.20..805 et sec .)governs
conversions of mobile home parles to other uses and. requires that no application shall be deemed
complete until a. conversion impact report has been prepared with the information specified in
section 29.20.8.35.
C. A .Mobile Home Parlc Conversion Impact Report, Los Gatos. Mobile .Home Park,
Final Draft dated December 7,1998 (Exhibit"C" to Attaclunent 8 to the Town Council Staff Report
dated April 29, 1999) was prepared by Thomas Derr, the consultant selected by the 'Town in
accordance with section 29..20.835(1) ("Report"). Copies of the Report were disseminated to
residents pursuant to section 29.20.840(a). On July 8,1998, November 11,1998, December 8,1998,
and January 11„ 1999, eac11 date prior to the public hearing on the conversion impact report before
the Planning Commission, informational meetings were held for the mobile home owners and non-
owner tenants of t11e Parlc regarding the status of the application for conversion and related issues

pursuant to section 29.20.840(b). The Plam~ing Commission held public 1learings on the Report on
January 27, 1999 and March 10, 1999.
D. The Town Council, iii considering the Report submitted as a component of the
application for a mobile home park conversion permit, accepted,lleard and considered evidence, and
makes the following findings which shall constitute part of the findings that will ultimately be
required in order to issue a conversion permit:
1. Pursuant to subsection (2) of section 29.20.820, that evidence in the.record,
specifically at pages 12 through 19 and 29 of t11e Report, demonstrates that there are no vacant
spaces in mobile home parks located within a 20 mile radius around the Parlc, that the vacant spaces
that are located within a 100 mile radius around the Parlc ai e in parks that are not comparable to the
Park in terms of location, and that many of the coaches in the Parlc are too old to be accepted for
relocation in any vacant spaces, notwithstanding the lack of comparability of those parks to the Park.
Therefore, at present, there does not exist sufficient mobile home space availability withinthe Town
and/or within the area surveyed in the impact study to accommodate the mobile homes to be
displaced.
2. Pursuant to subsection (3) of section 29.20,820, that evidence in the record,
specifically at pages 6 tluough 7, 14 through 17 and 29 of the Report, demonstrates that the age,
type, condition, and style of mobile homes within the Parlc are. such that the majority of them are
unable to be moved and accepted into other parks within the area surveyed in the impact study.
3. Pursuant to subsection {4) of section 29..20.820, that evidence in the record,
specifically at pages 12 through 19 and 29 of t11e Report, demonstrates that there are no vacant
spaces in mobile home parks located within a 20 mile radius around the Park and that the vacant

spaces that are located within a 100 mile radius around the Parlc are in parks that are not comparable
to the Park in terms of location. That location is critical to determining comparability because the
only vacant spaces are found at the outer limit of the 100 mile radius which is too far to be
reasonably convenient to j obs, family and health care professionals. In addition, Los Gatos provides
a high quality lifestyle that is unique in terms ofproximity to San Francisco Day Area services and
culture, jobs, climate, proximity to the ocean and natural beauty, and that is not easily duplicated in
the areas where vacant spaces have been identified. Therefore, mobile home owners cannot relocate
to a comparable mobile Home park within the impact study area.
4. Pursuant to subsection (4) of section 29.20.820, that evidence in the record,
specifically at pages 2 through 3 of the Town Council 'Staff Report dated April 29, 1999,
demonstrates that all required notices, distribution of copies of the Report, and meetings :required
pursuant to section 29.20.840 of the Town Code 11ad been completed.
E. All other items related to the conversion permit application are bifurcated, and the
public hearing on those items is continued to August 2, 1999.
RESOLVED:
1: That the Town Council hereby makes findings 2, 3, 4, and 9 as requiredunder section
29.20.820 of the Town Code.
2. That actions regarding the remaining findings in section 29.20.820, along with any
other issues related to the application for a mobile home park conversion permit are hereby
bifurcated,. and the public hearing thereon is hereby continued to August 2, 1999.
