RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS G~1TOS REMANDING:
A GENERAL PLAN AMENDMENT TO CHANGE THE LAND USE DESIGNATION FROM

WI3EREAS:
A. This matter came before the Council for public hearing on .July 6, 1999, pursuant to
written request from applicant, Braddock & Logan Group, LP {II) from a decision of the .Planning
Commission .and was regularly noticed in conformance with State and Town law.
B. Council received testimony and documentary evidence .from the .applicant and all
interested persons who wished to testify or submit documents. Council considered all testimony and
materials submitted, including the record of the Planning Commission proceedings and the packet
of .material contained in the Council Agenda Report dated June 25, 1999, along with subsequent
reports and materials prepared concerning this application.
C. -The applicant is requesting perrrrission to construct either 36 detached town homes
(which include five below market price units) or 39 detached town homes.(which would include five
below market price units). The site is currently zoned R-1:8 PD and is approximately 5.68 net acres.
The site adjoins University Avenue and Vasona County Park to the east, town homes and single
family residences to thenorth,town homes to the south, and single family residences (Monte Sereno)
to the west. Access to the site will continue to be from Winchester Boulevard. The site currently
contains the Villa Felice Restaurant, approximately 13,700 square feet of gross .floor area including
administrative offices and support services, a 31-unit hotel and apse-1941 duplex.
D. On Apri129, 1999 the Planning Commission recommended denial of the Planned
Development Application after a lengthy public input :process based on the applicant's inability to
adequately address the concerns of residents andthe concerns of the Planning Comrnssionregarding
the appropriate land uses and development for the site.
E. Council finds pursuant to Town Code section 29.20.300 that new information was
submitted to the Council during the requested hearing that was not readily available at the time of
the Planning Commission review; to wit, a representation that the applicant has prepared a revised
development plan that addresses the concerns of the .residents and the concerns of the Planning
Commission and clarifies the land use and development of the site.
itIESOLVED
1. That Project .Application PRJ-98-13.0 and negative declaration ND-98-0010 are
therefore remanded to the Planning. Commission for reevaluation of plans and design for the
development of the property located at 15350 Winchester Boulevard,
2. That the applicant shall pay such additional .fees as are required based on actual costs
incurred in further processing of the application on remand pursuant to Resolution No. 1996-67.
