A. This matter came before the Council for public hearing on September 7, 1999, on an appeal
by Larry J. and Karen Willard from a decision of the Planning Commission and was regularly noticed in
conformance with State and Town law.
~. 'T'he Council received documentary evidence from the appellant, Neither the appellant or
their representative were present for the public hearing. The Council considered all testimony and materials
submitted, including the record of the Planning Commission proceedings and the packet of material
contained in the Council Agenda Report dated June 24, 1999, August 2, 19.99, and August 17, 1999 along
with subsequent reports and materials prepared concerning this application.
C. Applicant is requesting approval of plans to add 479 square feet to the first floor of an
existing 3,163:7 square foot, two-.story, single family residence on a 13,190 square foot lot. The total square
footage proposed for the single family residence is 3,642.7. The site also has a legal 743 square .foot
secondary dwelling unit. The allowable FAR is .284 and the proposed is .332.
D. The Los Gatos Historic Preservation Committee consideredthe application on March3,1999.
The Committee recommended approval of the application in terms of architecture only subj echo conditions
vdhich were incorporated in the conditions. of approval if the project was approved:
E. The Planning Commission considered the matter on 1blay 12,1999 and deniedthe application
on the basis that there was insufficient information provided which would enable the Commission to make
the required findings that the FAR was compatible with the surrounding neighborhood.
F. Appellant. claims that the Planning Commission erred or abused its discretion, and declined
to consider that the proposed FAR was compatible with the surrounding neighborhood.
G. 'fhe Planning Commission decision was correct.

1. The appeal of the decision of the Planning Commission on Proj ect PRd-98-250 is therefore
denied.
2. The decision constitutes a final .administrative decision pursuant to Code of Civil Procedure
section 1094.6 as adopted by section 1.10.085 of the Town Code of the Town of Los Gatos. Any application
for judicial relief from this decision must be sought within the time limits and pursuant to the procedures
established by Code of Civil Procedure section 1094.6, or such shorter time as required by State and Federal
law.
PASSED AND .ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos,
California, on the 20t" day of September, 1999. by the f®llowing vote.
