RESOLUTION ACCEPTING OPEN SPACE EASENfENT.
RESOLVED, the grant of open space easement evidenced by
the attached instrument dated March 27, 1973, exe cuted by
SAVING YADROFP, WILLIAM YABROFF and ESTHER LOU YABROFF is
hereby accepted by 'the T own of Los Gatos.
PASSED AND ADOPTED at a Regular meeting
of the Town Council o£ the Town of Los Gatos held on the
2nd day of April 1973, by the following vote:

For a valuable consideration, receipt of which is hereby
acknowledg€d, Irving Yabroff, William Yabroff and _
Esther Lou Yabroff ,. Grantors., grant to
Towx OF LOS GATOS, a municipal corporation of the State of California,
Grantee, a permanent easement in gross for open space purposes upon
all the real property in the Town of Los Gatos, County of Santa Clara,
State of California, marked "Open Space Easement" on the Parcel D2ap,
recorded in Bpok `, at Page , Santa Clara County
Ree:ords, hereinafter called °fthe land".
This instrument conveys to Grantee the right to have
Grantors and their successors in interest refrain from doing any
act an the land, including acts permitted by th€ express terms of
this instrument, which will be inconssstent with the land's con-
tinuing in an open and rural state. Grantors and their sueo®ssors
in interest shall refrain from placing structures and performing
grading, cut or fill vrork an the land, except as hereinafter pro-
vided, shall use the land only in the mannor specified 'in this
instrument, and shall net divide the land. The land may be used
as a site for hiking and riding trails, orchard, pasture, private
-~ picnicking and a stable and riding ring for no mare than ten
horses for. private, noncommercial use. The .7,and may also be used
as a route for underground utility lines serving residences not
w3.thn the easement on the land d€gict€d in the above-mentioned
parcel. map, sa long as the land Surface is fully restored. Any
grading or cut ar fill work shall be the minimum necessary for
the alloor€d uses. Any stable shall not be ]zrger than 3,60o square
feet ist area.
This grant of easement is made pursuant to the provisions
of Gav€rcvnant Ccde Sections 695(i - fi9S4 and tho parties intend

that the Lurden imposed on the land by this grant shall be an
enforcJh1e restr. fiction within the meaning of Article XXVIII~
Section ?, of. the Constitution of the State of California, and
Sections 421 throldgh 429 of the t~evenne and Taxatipn Cede.
