AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN
UNINHABITED TERRITORY, DESIGNATED
"EAST SIDE NUMBER THREE ANNEXATION"
TO THE TOWN OF LOS GATOS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
WHEREAS on the 18thday of September, 19 51, the Council
of the Town of Los Gatos did pass and adopt a Resolution giving
notice of the proposal to annex certain uninhabited territory to the
awn of Los Gatos, said territory being therein designated as
"East Side Number Three Annexation" , and said action being
taken by the Council of said Town as the legislative body of the
Town pursuant to a written petition therefore, said Resolution
describing the boundaries of the territory so proposed to be
annexed to said Town; and
WHEREAS, said Resolution did contain a notice of the
day, hour and place when and where the said Council of said Town
would hear protests made by any person owning real property with-
in the territory proposed to be annexed, the time of said hearing
being not less than twenty nor more than sixty days from the date
of the passage of said Resolution; and
WHEREAS, on the 16th day of October - 195-1
at the hour of 8:00 P.M. in the Los Gatos Council
Chambers in the Town Hall of the Town of Los Gatos, County of
Santa Clara, State of California, said time and place being the
day, hour and place fixed in said Resolution for healing protests
to said annexation, the said Council of said Town did hear and
pass upon all protests made to said proposed annexation and did
determine that no protests to said proposed annexation have been
made by or on behalf of the owners of one-half of the value of
the territory proposed to be annexed as shown by the equalized
roll, nor by public and private owners of equal to one-half of

the value of the territory proposed to be annexed as determined by
said legislative body; and
WHEREAS, said territory is contiguous to the Town of
Los Gatos, and is uninhabited territory in the County of Santa
Clara, and all of the procedural requirements of the annexation of
uninhabited Territory Act of 1939, particularly Government Code
Sections 35300 and 35314 inclusive have been fully complied with;
NOW.P THEREFORE, the said Council of the Town of Los Gatos
does hereby approve the annexation of said territory, hereinafter
described, to the Town of Los Gatos and does hereby further ordain
that the said territory be and is hereby annexed to the Town of Los
Gatos.
That said territory, the annexation of which to the
Town of Los Gatos is hereby approved, is all that territory situate
in the County of Santa Clara, State of California, more particularly
described as follows:

Beginning at the Southwest corner of Section 22, Township 8,
South Range 1 West, Mount Diablo Base and Meridian, said point of
beginning being also in the Town Limits of the Town of Los Gatos;
Thence, Easterly along the Southerly line of said Section 22,
T-8-S-R-1-W to the point of intersection of said line with a
Westerly line of that certain parcel of land conveyed by Hans F.
Birnie, et ux to Ralph B. Gilman, et ux by Deed dated June 24, 1946,
and recorded January 17, 1947, in Book 1366 Official Records, at
Page 152, Santa Clara County Records;
Thence, following the various courses and distance; of the
exterior boundaries of said Gilman parcel in a generally Southerly
and Easterly direction to the most Southeast corner thereof;
Thence, Northerly along the most Easterly line of said Gilman
parcel to the point of intersection of said line with the center
line of South Quarry Road, as the same now exists;
Thence, generally Westerly and Northerly following on and along
the center line of said South Quarry Road, as the same now exists,
and its various courses and distances to the point of intersection
of said line with the Northerly line of that certain parcel of
land conveyed by Carl H. Lipscomb to Carl H. Lipscomb, et ux by
Deed dated June 24, 1954., and recorded June 28, 1954, in Book 2933
Official Records, at Page 478, Santa Clara County Re-cords;
Thence, Westerly along the Northerly line of said Lipscomb
parcel to the point of intersection of said line with the
Westerly line of Section 22, T-8-S-R-1-W, said point being also
in the Town Limits of the Town of Los Gatos;
Thence, Southerly along the Town Limits of the Town of Los
Gatos and the Westerly line of said Section 22, T-8-S-R-1.-W to
the point of beginning.
