Ord 0471- APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "ROBERTS ROAD NUMBER ONE ANNEXATION" TO THE TOWN OF LOS GATOS.ORDINANCE NO, 97/ AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "ROBERTS ROAD NUMBER ONE ANNEXATION" TO THE TOWN OF LOS GATOS. THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: WHEREAS, on the 2nd day of June, 1958, the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the Town of Los Gatos, said territory being therein designated as "ROBERTS ROAD NUMBER ONE ANNEXATION", and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries. of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than twenty no more than sixty day from the date of the passage of said Resolution; and WHEREAS, on the 21st day of July 1958, at the hour of 8:00 o'clock p.m in the Los Gatos Town Council Chambers in the Town Hall. of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in, said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests made to said pro- posed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the last equalized roll, nor by public and private owners of equal to one-half of the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguousto. the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly government Code sections 35300 to 35314 inclusive have been fully complied with; NOW, THEREFORE, the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter des- cribed, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the Town of. Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as. follows. Beginning at the point of intersection of the Easterly Town limits line of the Town of Los Gatos with ;she Southerly Tract line of the Nino Tract, the Map of which was filed for record in the office of the Recorder of the County of Santa Clara, State of California, on November 20, 1920, in Book Q, of Maps, at page 29, records of said County; thence from said point of beginning easterly along, said Southerly Tract lineAof said Nino Tract to the point of intersection with the Westerly line of the San Jose -Los Gatos Road, as. the same now exists; thence Northerly following the Westerly line of said San Jose - Los Gatos Road,, as the same now exists, to the point of intersection with the Northerly line of said herein before mentioned Nino Tract; thence Westerly along said Northerly line of said Nino" Tract to the point of intersection with the Easterly lire of Lot 1 of the Roberts Subdivision , the Map of which was filed for record in the office of Recorder of the the/County of Santa Clara, State of California on August 20, 1896, in Book I of Maps, at page 41, records of said County; thence Northerly along said. Easterly line of said Lot 1 of said Roberts Subdivision to the point of intersection with the Southeasterly line of Roberts Road, as the same now exists; thence Northwesterly across Roberts Road and across San Jose Water Works Lot 19-A to the point of intersection of the Northerly line of said San Jose Water Works Lot 19-A with the Northeasterly line of the State of California Division of Highways Freeway Route 5 right-of-way line as the same is described in Parcel One of the Deed from Charles J. Thelen and Mary Ea Thelan to the State of California, recorded January 23, 1957 in Book 3713 of Official Records, at Page 389, Santa Clara County Records;thence following the various courses and distance5of the above mentioned State of California Division of Highways Freeway Route 5 right-of-way line in a generally Westerly direction to ._oint on said right-of-way line located approximately seventy five feet Northerly from the North line of Roberts Road (40 feet in width) and Sixty feet Westerly from the East line of Lot 3 of said Roberts Subdivision, as herein before mentioned; thence Northerly along the Easterly line of said State of California Freeway Route 5 right -of -Way line 850 feet M/L to the point of intersection with the Southerly line of Lot 5 of the aforementioned Roberts Subdivision, thence Southeasterly along the Southerly line of said Lot 5, Roberts Subdivision to the point of intersection with the Westerly line of the San Jose -Los Gatos Road, as the same now exists; thence Northerly along said Westerly line of said San Jose -Los Gatos Road to the point of intersection with the Northerly line of Lot 7, of the hereinbefore mentioned Roberts Subdivision; thence Northwesterly along said Northerly line of said Lot 7, Roberts Subdivision, to the point of intersection with the Easterly line of that certain parcel of land described in the Deed from O.E. Reed and Nan Elizabeth Reed to Gerald Richard Graham and Jane Reed Graham, recorded March 21, 1946, in Book 1329 of Official Records, at Page 498, Santa Clara County Records; thence following the exterior boundary of said Graham parcel Southerly 143.50 feet, Wresterly 108 feet, Northerly 203.41 feet to the point of intersection with the Northerly line of the herein before mentioned Lot 7 of the Roberts Subdivision; thence Northwesterly 150 feet M,'L along the Northerly line of said Lot 7, Roberts Subdivision to the point of inter- section with the Easterly Totn Limits line of the Town of Los Gatos; thence following the Town Limits line of the Town of Los Gatos in a generally Westerly and -Southerly direction to the point of beginning.
