Ord 0398-REQUIRING ALL DOGS OVER 90 DAYS OLD TO BE VACCINATED WITH ANTI-RABIES VACCINE BEFORE THEY ARE LICENSED AND PROVIDING FOR EMERGENCY VACCINATION OF SAID DOGS AND PROVIDING REGULATIONS TO CONTROL RABIEST
ORDINANCE NO. AN ORDINANCE REQUIRING ALL DOGS OVER 90 DAYS OLD TO BE
VACCINATED WITH ANTI-RABIES VACCINE BEFORE THEY ARE
LICENSED AND PROVIDING FOR EMERGENCY VACCINATION OF SAID
DOGS AND PROVIDING REGULATIONS TO CONTROL RABIES.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
Section 1. RABIES - NOTICE
- If a dog is believed to have rabies or has been bitten
by an animal suspected of having rabies, such dog shall be confined
by a leash or chain, or separate enclosure on the owner's premises
and shall be placed under the observation of a licensed veterinarian
at the expense of the owner for a period of two (2) weeks. The
owner shall notify the Poundmaster or a Police Officer of the
fact that his dog has been exposed to rabies, and at his dis-
cretion the Poundmaster is empowered to have such dog removed
from the owner's premises to a Veterinary Hospital and there
placed under observation for a period of two (2) weeks at the
expense of the owner.
It shall be unlawful for any person knowing or suspecting
a dog has rabies to allow such dog to be taken off his premises,
or beyond the limits of the Town of Los Gatos without the written
permission of the Poundmaster. Every owner or other person upon
ascertaining a dog is rabid shall immediately notify the Pound-
master or a Police Officer, who shall remove the dog to the pound.
Section 2. VACCINATION
It shall be unlawful for the owner of any dog over ninety (90)
days old to keep and maintain such dog within the Town of Los
Gatos unless it shall have been vaccinated by a licensed
veterinarian with anti-rabies vaccine within two (2) years if

avianized vaccine is used, and within one (1) year if phenolized
vaccine is used preceding the date on which such dog is kept or
maintained in the Town of Los Gatos.
Section 3. LICENSING
Before a dog license is issued under the provisions
of Ordinance Nom 268 of the Town of Los Gatos, a certificate
of anti-rabies vaccine covering the license:?.period must be
furnished to the Town License. Collector for all dogs over ninety
(90) days old, and the owner of such dog must present such
certificate of vaccination, issued to said owner by a duly
authorized Health Department Clinic, or by a duly licensed
veterinarian, licensed under the laws of the State of California,
which such certificate must describe the dog and must indicate
the period of time the vaccination is valid to wit: Two (2)
years if avian.ized vaccine is used, and one (1) year if
phenolized vaccine is used.
Section 4m PENALTY
Any person, firm or corporation., whether as principal,
agent, employee or otherwise, violating or causing the violation
of any of the provisions of this ordinance shall be guilty of a
misdemeanor and upon conviction thereof shall be punishable
by a fine of not more than Five Hundred Dollars ($500.00) or
by imprisonment in the County Jail of the County of Santa Clara
for a term not exceeding six (6) months, or by both such fine
and imprisonment. Such person, firm or corporation shall be
deemed guilty of a separate offense for each and every day during
any portion of which any violation of this ordinance is committed,
continued or permitted by such person, firm or corporation, and
shall be punishable as herein provided.

Section 5. SEPARABILITY OF PROVISION
It is the intention of the Town Council of the Town of
Los Gatos that each separate provision of this Ordinance shall
be deemed independent of all other provisions herein, and it
is further the intention of the Town Council of the Town of
Los Gatos that if any provision of this Ordinance be declared
invalid, all other provisions thereof shall remain valid and
enf orceable.
y Section 6d URGENCY - EFFECTIVE DATE
This Ordinance shall be and is hereby declared to be an
Urgency-Ordinance and shall take effect immediately, and the
following is a declaration of the fact constituting the urgency:
The State Department of Public Health declared on May 25, 1956,
the entire County of Santa Clara, including all incorporated
areas thereof as "rabies endemic area." as the result of the re-
cognition of rabies in Santa Clara County and in order to prevent
the spread of rabies among animals, and to avoid the possibility
of human beings becoming infected with this fatal disease, this
Ordinance is passed for the immediate preservation of the public
health and safety.
The above and foregoing Ordinance was duly and regularly
introduced at a regular meeting of the Town Council of the Town
of Los Gatos held on the day of t , 1956, and there-
