AN ORDINANCE AMENDING ORDINANCE NO. 249 OF THE TOWN OF LOS GATOS,
ENTITLED " AN ORDINANCE ADOPTING A UNIFORM BUILDING CODE, ESTAB-
LISHING FIRE ZONES AND PROVIDING FOR PENALTIES."
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
Section 1. That Section I of Ordinance No. 249 entitled, "A
Ordinance Adopting a Uniform Building Code, Establishing Fire
Zones and Providing for Penalties," passed and adopted by the
Town Council of the Town of Los Gatos.on the 16th day of December,
1940, bey and the same is hereby amended to read as follows:
(a) Rules and regulations for the erection, construction,
enlargement, alteration, repair, moving, removal, conversion,
demolition, occupancy, equipment, use, height, area, and mainten-
ance of buildings and structures having been printed as a code
in book form, said code being entitled, "Pacific Coast Building
Officials Conference Uniform Building Code," 1949 Edition, three
copies of said code with the appendix thereto, having been filed,
for use and examination of the public, in the office of the I wn
Clerk of the Town of Los Gatos, reference being hereby made
to said code and appendix for all the regulations, provisions,
conditions, terms and requirements therein.shown, said regula-
tions, provisions, conditions, terms and requirements, and said
code, together with the appendix are hereby adopted and made a
part hereof, the same as if fully set forth in this ordinance, and
are by such reference adopted as Sections of this ordinance,
bearing the same numerical Section designations as appear in
said. Uniform Building Code with exceptions as are hereinafter
set forth in Subsection (b), and as such, is adopted as and for

the Building Code of the Town of Los Gatos.
(b)
SECTION 306 shall read as follows: No new building,
nor remodeled building nor addition to an existing building shall
be occupied or used for any use other than that shown on the
Building Permit until a certificate of occupancy shall have been
issued by the Building Official.
SECTION 1002 shall read as follows:
(a) General. Buildings or parts of buildings classed
in Group E because of the use or character of the occupancy shall
not exceed, in area or height, the limits specified in Sections
505$ 00, and 507.
(b) Special Provisions. Divisions 2 occupancies shall
have exterior galls of not less than one-hour fire-resistive con-
struction or shall be surrounded by public space, streets, or
_7ards, not less than sixty feet (601) in width.
The area increases allowed by Section 506 (e) shall not
exceed 500 per cent for aircraft repairs hangars.
Public garages over one thousand (1000) square feet in
floor area shall have exterior walls of not less than one-hour
fire-resistive construction.
Floors shall be of incombustible materials or of not less
than Type II construction. In public garages and where flammable
or explosive liquids are used or stored floors shall be entirely
protected with incombustible materials against saturation.

SECTION 1302 shall read as follows:
(a) General. Buildings or parts of buildings classed
Sri Groupe H because of the use or character of the occupancy shall
not exceed, in area or height, the limits specified in Sections
505$ 06, and 507.
(b) Special Provisions.. Division 1 occupancies shall
be one-hour fire-resistive construction throughout and shall be
of Type 1 construction if more than two stories in height.
Divisions 2 occupancies more than two stores in height
shall be of not less than one-hour fire-resistive construction
throughout.

3205.
SECTION 4504 shall read as follows: Oriel windows.,
balconies, unroofed porches, cornices and belt courses and appen-
dages such as watertables, sills, capitals, bases and other decora-
ti e features may project over the public property of the building
site a distance as determined by the clearance of the lowest point
of the projection above the grade immediately below, as follows:
Clearance above grade less than eight (81) feet--no
projection permitted.
Clearance above grade over eight feel (8')--one inch (18)
of-projection is permitted for each additional foot of clearance,
provided that no such projection shall exceed a distance of Iwo
feet.

(b) Projection and Clearance. The horizontal-clearance
between a marquee and the curb line shall be not less than three
feet (3'
A marquee projecting more than two-thirds of the distance
from the property line to the curb line shall be not less than
twelve feet (121) above the ground or pavement below.
A marquee projecting less than two-thirds of the distance
from the property line to the curb line shall be not less than

nine feet (91) above the ground or pavement below.
(c) Length. A marquee projecting more than two-thirds
the distance from the property line to the curb line shall not
exceed twenty-five feet (251) in length along the direction of
the street.
(d) Thickness. The maximum height or thickness of a
marquee measured vertically from its lowest to it
shall not exceed three feet (31) when the marquee
than trio-thirds of the distance from the property
line and shall not exceed nine feet (91) -,hen the

(e) Construction. A marquee shall be supported entirely
from the building and constructed as specified under Types of
Construction and shall be of incombustible material.
(f) Roof Construction. The roof or any part thereof may
be a skylight provided wire glass is used not less than one-fourth
inch (i") thick with no single pane more than eighteen inches (1811)
wide.
Every roof and skylight of a marquee shall be sloped to
aownsuouts which shall conduct any drainage from the marquee under
the sidewalk to the curb.

(g) Location Prohibited. Every marquee shall be so located
as not to interfere with the operation of an exterior standpipe
or to obstruct the clear passage of stairways or exits from the
building or the installation or maintenance of electroliers.
(h) Any application for the erection of a marquee shall
be approved by the City Council before a permit is issued therefor.
SECTION 4506 shall read as follows: Movable awnings
or hoods may have combustible coverings supported on incombustible
Frames attached to the building.
Such awning or hood may extend over the public property
not more than two-thirds the distance from the property line to
the nearest curb in front of the building site.
The lowest part of any movable awning or hood frame shall
be not less than seven feet (71) above the ground immediately
below, and the lowest part of any fringe attached to such awning
or hood, in the front or curb side, shall be not less than six
feet (61) above the grade immediately below; and the lowest part
of any fringe attached to such awning or hood on the other sides
be not less than six and one-half feet (6-1) above the grade
immediately below.
SECTION 4714A A new section to be 'designated. Section
4710A is hereby adopted and wade a part of the Pacific Coast Con-
Terence 'uniform Building Code (1949)Edition) reading as follows.
All Type V buildings over one story in height shall have
solid sheathing under exterior plaster. On type V buildings hav-
ing solid sheathing, the third or finish coat may be a wash coat.
Section 2. This Ordinance shall take effect and be in force
thirty (30) days from and after date of its passage and before
the expiration of fifteen (15) days after its passage it shall
be published once with the names of the members voting for and
against the same in the
a newspaper published in the Town of Los Gatos.
